5. This amendment is being issued to revise clause I209.18 paragraph (c) as follows:

(c) The total duration of this contract, including the exercise of any options under this provision, shall not exceed 60 months, which consists of a three-year (36 months) base period, plus an option period of two years (24 months).

# Question Answer

7 Kindly advise what kind of document does the DLA provide to support the contractor’s in obtaining the PM NOC from the Iraqi government?

The PMNOC process does not apply to the northern Iraq/Syria area.

PMNOC approvals are required in southern Iraq. DLA Energy submits the fuel requirement to our vendors but does not supply any documents for obtaining the PMNOC approvals from the Iraqi government.

1. To clarify - PM NOC is required on the following CLINs:

• CLINs 1 through 4,

• CLIN 8, and

• CLINs 12 through 14.

2. PM NOC is NOT required at the following CLIN’s:

• CLINs 5 through 7, and

• CLINs 9 through 11.

3. See Attachment 6 for additional details of the approval process.

7. This amendment is being issued to revise Factor 3, paragraph (b) of the solicitation :

(b) When evaluating Price, the Government reserves the right to conduct a price realism evaluation in order to determine whether the pricing offered is so low as to indicate a misunderstanding of the requirements.

11. This amendment is being issued to clarify the use of the PLATTS escalator and the Supplier Notification method.

a. PLATTS Escalator – This method for escalating fuel pricing only applies to CLINs 0005, 0006, 0007, 0009, 0010, and 0011. PLATTS’ product prices will escalate monthly based on the average of high and low assessments contained in the Platt’s publication of each month in which deliveries are made. Therefore, the effective price for the period of the 1st through the 30th /31st will be the average of the high and low assessments for the previous month’s assessments posted on the 1st of each month. Saturdays and Sundays shall be considered as Platt’s non-publication days. If assessments are not posted by Platts during the period that delivery was made due to a holiday or another occurrence, only the posted assessments for that period will be used in the calculation.

b. Supplier Notification – This method only applies to CLINs 0001, 0002, 0003, 0004, 0008, 0012, 0013, and 0014.

These CLINs must be source from Iraq local refineries. To ensure that the actual cost of the fuel will be captured in the award price, the awardee(s) will be required to provide DLA Energy with the monthly fuel prices posted by OPDC.

This price will be used to determine the monthly award price by adding the awardee’s price differential. The awardee’s differential should remain constant during period of performance, only fluctuating in according with contract clause B19.02.

12. This amendment is being issued to revise and clarify FAR 52.212-2.

The following factors and subfactors shall be used to evaluate offers.

Volume 1 – Factor I: Technical

Sub-factor 1 – Supply Plan and COQ/COA Sub-factor 2 – Transportation Plan

Sub-factor 3 – Storage/Distribution Plan

Volume 2 – Factor II: Past Performance Volume 3 – Factor III: Price

13. This amendment is being issued to revise and clarify FAR 52.212-1(b)(4) as follows:

(4) A response addressing each subfactor under Factor 1, Technical in sufficient detail to evaluate compliance with the requirements of each subfactor.

14. This amendment is being issued to clarify the term “Source” in the solicitation:

The “Source” used in Subfactor 1 – Supply Plan paragraph (3)(a)ii, is referring to the oil refinery. In the LOC instructions, “Supplier” is referring to the same refinery referenced in Subfactor 1, if the LOC is for the fuel. If the LOC is from the company that is transporting and/or storing the fuel, then the “Supplier” or “Source” is referring to that company.

15. This amendment is being issued to revise the answer to question #35 and to clarify the information required for the Proposals. See the table below:
