The purpose of this amendment is to answer further vendor questions.
• Please can I have the name and address of the port/terminal where the cargo will discharge?

• Is there any restrictions on the type of ships, vessel flag to be used i.e. does it need to be a US Flagged vessel (Jones Act)?
Ocean tanker movements are the responsibility of MSC, which manages vessel chartering and requests for CPA waivers. Since FY12, DLA Energy has not awarded a FOB Tanker Destination tanker contract except for two deliveries to fulfill urgent needs in Qatar and Pearl Harbor. Mission Subordinate Command does charter foreign tankers because U.S. flag tankers do not normally participate in the international trades as they are not cost competitive with foreign tankers. There has been no discernable difference in the number of waivers of the CPA to vessels carrying DLA Energy owed fuel due to non-availability since FY 12.
DLA Energy has discussed Non-U.S. Flagged Vessels in the past. There will be a lot of red tape with a Non-U.S. Flagged Vessel Hawaii. However, the Offeror is encouraged to leverage the Vendor Notes Section of the Offeror Submission Package in Attachment 2 of the solicitation to communicate any capability restrictions and/or conditions to your offer.
Will we need to send the vessels to someone for vetting, clearance? No, not at this time, however, vendor is required to follow delivery notes in the schedule for any deliveries.
• Will a QAR need to inspect the cargo/vessel prior to loading?
No, for FOB Destination, the contractor is responsible for cleaning and inspecting the vessel prior to loading. See below wording from the E1 QAP
(I) For f.o.b. destination Contractor-supplied tankers/barges. Procedures for the preparation of vessel cargo systems, in accordance with Energy Institute (El) HM 50, Guidelines for the Cleaning of Tanks and Lines for Marine Tank Vessels Carrying Petroleum and Refined Products, that ensure the vessel is suitable to load the intended product(s). Particular attention shall be given to vessels that previously carried a Fatty Acid Methyl Ester (FAME) cargo. As a minimum, f.o.b.
destination Contractors shall ensure that all cargo systems on the vessel intended for loading product under this contract, to include tanks, lines, manifolds, and pumps, are washed, gas freed, and inspected.
In the event a solvent degreaser is utilized in the tank preparation process, a minimum of two rinses shall be performed by the vessel prior to loading aviation fuel. These procedures, and others deemed necessary by the Contractor, shall be included to ensure that the product meets the specification requirements at the CTP.
• What is the nomination clause for the delivery? It will need to be a minimum of 30 days as our cargo is coming from Asia Pacific.
Depending on delivery, if Offeror plans to deliver by FOB Destination Tanker please refer to clause F54 TANKER UNLOADING CONDITIONS (DLA ENERGY AUG 2007).

• What is the offer validity i.e. when will it be awarded
DLA Energy plans to award by April 17, 2023, however that will depend on evaluation of offers and negotiations. DLA Energy would like delivery by mid-May; however, we can discuss any offer conditions and/or capability restrictions during negotiations.
