The purpose of amendment 0001 is to notify offerors the closing date remains unchanged at 6 May 2024, 4:00PM Central Time.

A. Additionally, provide the following Government responses to industry questions:

1. Request DLA provide name and contact information for logistics companies that Government uses to secure the empty drums, a marine surveyor to approve the shipment and a Hazmat trucking company to bring the empty container from the port and then return it to the port with the empty drums. Does the Government have points of contacts in California?

Government Response 1: The Government doesn’t have any companies that they can provide for the west coast support.

East Coast: American Maritime Consulting Inc., Dominique Digeon (Surveyor), Email: ddinmi@hotmail.com, cell# 954-940-8280 , Packing cargo: Antonio (Tony) Gonzalez, 321-508-0878, email: tgonzalez@ottrans.com

2. Can MMH be delivered in isotainers to Cape Canaveral (CC) or VSFB?

Government Response 2: At present, ISO containers are not considered acceptable for delivery. However, they may be deemed acceptable if the offeror provides offloading procedures, drawings, etc. Once this information is provided to both locations (Cape Canaveral and VSFB), an offloading operating procedure will need to be developed. Please note that this approval process may take up to six months.

3. Can MMH be deliver in drums to CC or VSFB?

Government Response 3: Drums are not acceptable it must be a pressure vessel to transfer a secondary container.

Currently the only acceptable containers are UN & DOT 4BW cylinders.

4. Can we deliver a full isotainer (39,683 LBS)?

Government Response 4: At present, ISO containers are not considered acceptable for delivery. However, they may be deemed acceptable if the offeror provides offloading procedures, drawings, etc. Once this information is provided to both locations (Cape Canaveral and VSFB), an offloading operating procedure will need to be developed. Please note that this approval process may take up to six months.

5. Or is there a preference for delivery by truck (approx. 15,000 LBS)?

Government Response 5: At present, the only acceptable bulk tanker is the MC338, as per DOT SP 10631. Any other larger vessels must undergo approval as outlined in Government Response 2.

6. Will CC and VSFB off load product upon arrival or will isotainer/truck need to remain on base as storage?

Government Response 6: Historically, the government takes approximately 60 days to offload MMH from the date of receipt from the vendor. During the initial 60 days, the cylinder is in the possession of the government at no charge.

7. There is a requirement to submit both an SDS and an MSDS. As SDSs replaced MSDSs several years ago, we only have an SDS for MMH. Will this be acceptable?

Government Response 7: Yes, it is acceptable for offeror to submit Safety Data Sheet (SDS) instead of Material Safety Data Sheet (MSDS).

8. Dates for Item 0003 do not match. Period of Performance listed initially as 07/16/2025 – 7/15/2026. And later as 07/16/2026 – 07/15/2027.

Government Response 8: The period of performance for CLIN 0003 is correct: 07/16/2025 – 07/15/2027. CLIN 0003 represents Year 2 MMH for Cape Canaveral, FL, as customer will not receive any product during Year 1.

9. The SOO requests a “cylinder lease rate” after 60 days and up to 6 months. What happens after 6 months?

Government Response 9 : Historically, the government takes approximately 60 days to offload MMH from the date of receipt from the vendor. During the initial 60 days, the cylinder is in the possession of the government at no charge.

The cylinder lease rate will apply after the initial 60 days. The government is requesting that the vendor propose a monthly rate for the period after the initial 60 days.

10. Attachment G includes line items (0006 and 0007) for Tank Usage Fee. Is this the Cylinder Lease Rate noted above?

How do we calculate extended price without the number of lease days?

Government Response 10: Historically, the government takes approximately 60 days to offload MMH from the date of receipt from the vendor. During the initial 60-day period, the cylinder remains in the possession of the government at no charge. After the initial 60 days, the cylinder lease rate will apply. The government kindly requests that the vendor propose a monthly rate for the period following the initial 60 days.

11. Attachment K requires the offeror to include “total price along with discount terms” on the Cover Page.

Conversely, instructions for the Price Proposal state that “no price data of any kind” should be included in any other part of the proposal. Please let us know which is correct.

Government Response 11: To clarify “no price data of any kind should be included in any other part of the proposal” specifically the technical proposal. In accordance with solicitation Note to Offerors, paragraph 11, STANDARD FORM

SPE60124R0304 - 0001

1449 AND PRICING WORKSHEET: Prices shall be annotated on BOTH, the SF 1449 and Attachment G -Pricing. Worksheet SPE60124R0304 provided as part of this solicitation. Pricing worksheet shall be submitted in Excel format and remain unlocked. Proposed prices shall not exceed second decimal placed. Additionally, offeror may include and annotate discount terms on SF 1449 in block 12.

12. Regarding the Statement of Objectives, several items in the product specification were listed with a < and Max.

For example: < 0.5 ppm max Tin. We believe that all the items paragraph (2)(1)(a) should be listed as “max”.

(Specifically, items ii through vii). Please confirm.

Government Response 12: Correct, this was an oversight and the Government neglected to delete the < symbol.

13. What is desired for Carbonaceous material analysis?

Government Response 13: This question is unclear. DLA specifically call out methylamine and ammonia and then lump all other organics together; each with its own limit.

14. The solicitation does not include an economic price adjustment clause. Will the government consider adding the economic price adjustment clause at FAR 52.216-2 Economic Price Adjustment-Standard Supplies to the solicitation?

Government Response 14: The Government may consider adding FAR Clause 52.216-2 Economic Price Adjustment Standard Supplies through mutual agreement of the parties at the time of award.

15. Shipping of MMH to the US is not always feasible with a US-flag vessel. Will the government consider deleting or modifying FAR 52.247-64 Preference for Privately Owned U.S.-Flag Commercial Vessels?

Government Response 15: The government will not consider deleting or modifying FAR 52.247-64 Preference for Privately Owned U.S.-Flag Commercial Vessels, as it is mandated by law to ship supplies via US-flag vessels. Additionally, if the contractor notifies the contracting officer that no U.S.-flag vessels are available, the contracting officer shall request confirmation of nonavailability from Military Sealift Command (MSC) or Military Surface Deployment and Distribution Command (SDDC) prior to requesting a waiver or granting an exception.

16. Will the contractor be permitted to rely on exchange rates current as of the time of shipment when invoicing the government? If not, will the government consider allowing the contractor to do so?

Government Response 16: No, foreign exchange rates are not applicable to this solicitation, as offerors shall submit unit prices in US Dollars.

17. Can the government confirm whether this contract will include or require the use or creation of any covered defense information, as that term is defined in DFARS 252.204-7012?

Government Response 17: This requirement does not include “Covered Defense Information” as defined in DFARS 252.204-7012 or Controlled Unclassified Information (CUI) Registry at http://www.archives.gov/cui/registry/category-list.html.

18. FAR 52.203-13 Contractor Code of Business Ethics and Conduct. In brief, this clause requires the contractor to have an ethics program in place, including for reporting fraud, waste, and abuse, as well as a written code of business ethics and conduct. This is new to us and we would like to get further detail on our obligations.

Government Response 18: In accordance with FAR 3.1004 (a) Insert the clause at FAR 52.203-13, Contractor Code of Business Ethics and Conduct, in solicitations and contracts if the value of the contract is expected to exceed $6 million and the performance period is 120 days or more. Offeror shall review FAR 52.203-13, which outlines what the contractors shall do.

19. DFARS 252.204-7019 Notice of NIST SP 800-171 DOD Assessment Requirements and DFARS 252.204-7020 NIST SP 800-171 DOD Assessment Requirements. This requires the contractor to provide DOD with an assessment of the contractor’s NIST SP 800-171 compliance, if applicable.

Government Response 19: In accordance with DFARS 204.7304(d) use the provision at 252.204–7019, Notice of NIST SP 800– 171 DoD Assessment Requirements, in all solicitations, including solicitations using FAR part 12 procedures for the acquisition of commercial items. The effective date of the clause is November 2023.

20. DFARS 252.204-7012, which subjects a contractor to NIST SP 800-171 if it uses or transmits controlled unclassified information (CUI) or other protected information. A scan of the CUI registry does not indicate to that this contract is covered. Clarification whether DLA has modified their position about cybersecurity.

Government Response 20: In accordance with DFARS 204.7304(c) use the clause at 252.204-7012, Safeguarding Covered Defense Information and Cyber Incident Reporting, in all solicitations and contracts, including solicitations and contracts using FAR part 12 procedures for the acquisition of commercial items. The effective date of the clause is January 2023.

B. Offerors are required to submit the completed DLA Small Business (SB) Subcontracting Plan form along with their proposal. The Solicitation Attachment N, which contains the DLA SB Subcontracting Plan form, is being issued with amendment 0001.

PART 1 - SUBCONTRACTING GOALS Instructions

Calculating Total Planned Subcontracting Dollars

A. Total estimated dollar value of all planned subcontracting for an Individual

Contract Plan; or the offeror's total projected sales, expressed in dollars, and the total value of projected subcontracts to support the sales for a Commercial

Plan; i.e., the sum of LB and SB: $___________________ (This number will be auto calculated when the total Large Business (LB) and total Small Business (SB) fields are populated.)

B. Total estimated dollar value of planned subcontracting with large businesses (LB):

Total estimated dollar value of planned subcontracting with small businesses (SB):

C. Total estimated dollar value and percent of planned subcontracting with small businesses (include veteran-owned, service-disabled veteran-owned, HUBZone, disadvantaged and women-owned small business concerns):

$_____________ (Percentage of total dollars will auto populate)

Calculating Small Business Subcategories

These numbers have already been captured in SB dollars; therefore, you don't need to roll them up to equal the total small business dollars allocated above. It is possible to have one company that fits into more than one category (i.e. SDVOSB and HUBZone) and the same dollar amount would be allocated to both categories.
