JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
FOR PURCHASE OF CHASSIS
UNDER AUTHORITY OF lO.U.S.C. § 2304(c)(1) ONLY ONE RESPONSIBLE SOURCE
OR A LIMITED NUMBER OF RESPONSIBLE SOURCES
.L Summary/Introduction: This justification is executed by the Defense Logistics Agency
(DLA) Energy, the contracting activity. It is for the solicitation and award of three (3) contracts for the purchase of 156 airliftable chassis on a basis of other than full and open competition under the statutory authority of IO U.S.C. § 2304 (c)(!), only one responsible source or a limited number of responsible sources, as defined in FAR Part 6.302-I(b)(l)(ii). The dollar value ofthis procurement is estimated at $2,340,000. The resultant three (3) contracts' duration will be based on the production lead time of each supplier.
2. Description of Agency Needs (I 0 U.S.C. 2304(f)(3)(A)):
a. Background: In early FYI 0, the US Army announced a second surge of Aerostats to be deployed to Afghanistan. In support of this second surge, DLA Energy required additional
ISO containers to support the customers' OEF helium requirements. As a result of DLA
Energy's inquiry as to whether the additional ISOs should be procured with or without chassis, US Forces Afghanistan (USFOR-A) 14 confirmed in December 20 I 0 that DLA Energy should procure all bulk helium ISOs for the second surge of US Army Aerostats without chassis.
USFOR-A 14's decision was based on the Material Handling Equipment (MHE) available in
Afghanistan at that time. As a result, DLA Energy awarded multiple Indefinite
Delivery/Indefinite Quantity ISO Container contracts (without chassis) to Weldship Corporation
(Weldship), FIBA Technologies (FIBA), and GTM Manufacturing (GTM} under two separate procurements. However, since USFOR-A 14's decision in 20I 0, different MHE is now being used in Afghanistan. USFOR-A 14 has requested that DLA Energy provide chassis for all existing ISO containers, as well as those ISOs yet to be delivered, to accommodate the type of
MHE now being used by the US Army in Afghanistan. In order for the ISO containers to be considered "airliftable" under their existing ATTLA certification, the chassis must be of the same make and configuration that each Contractor's original A TTLA certification encompasses.
In other words, only the chassis that is specially configured to accommodate each Contractor's
ISO, and at the same time retain the A TTLA certification for that ISO with chassis, will satisfy the Government's requirement.
b. Requirement: DLA Energy has an immediate requirement for I 56 Custom, Airliftable
23 Yz' Extendable Chassis for use with ISO Containers that, when attached to the ISO container, meet the Air Transportability Test Loading Activity (ATTLA) certification for airlift. The chassis in the following configurations are needed by 30 September 20 I2:
(I) 41 Custom Airliftable, 23~' Extendable Chassis for use with Weldship ISO
Containers that meet Air Transportability Test Loading Activity (A TTLA) Certification dated 21 April 20 II for airlift of Weldship I 0 and 12 Tube Compressed Gas Systems, specifically, Cheetah Chassis Model Number 7235SNFSX with airlift modifications.
(2) 43 Custom Airliftable, 23Yz' Extendable Chassis for use with ISO Containers that meet ATTLA Certification dated 23 March 2012 for airlift of FIBA I 0 Tube and 12 Tube
Compressed Gas Systems, specifically, Chassis King Model number CK-232FB with airlift modifications.
(3) 72 Custom Airliftable, 23~' Extendable Chassis for use with ISO Containers that meet the ATTLA Certification dated 7 January 2011 for airlift of GTM 9 Tube
Compressed Gas System, specifically, Chassis King Model number CK-232FB with airlift modifications.
3. Authority for Other than Full and Open Competition (10 U.S.C. 2304 (D(3)(B)): The statutory authority for this contracting action is 10 U.S.C. § 2304 (c)(l), as implemented by FAR 6.302-1
"Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency
Requirements" or in the case of DoD, a limited number of sources or suppliers with unique capabilities. This authority permits contracting without full and open competition for DoD, NASA, and the Coast Guard when, according to paragraph (b )(I )(ii), "there is a reasonable basis to conclude that the agency's minimum needs can be exclusively satisfied by unique supplies or services available from one or a limited number of sources or from only one or a limited number of suppliers with unique capabilities."
Weldship, FIBA, and GTM are the original manufacturers of the ISO containers that now require, in accordance with USFOR-A J4 direction, these specific airliftable chassis. In addition, each company holds the airlift certification from ATTLA for the ISOs with chassis. Only these three (3) suppliers have the airlift certification and ISO Container/chassis designs as well as technical drawings to retrofit the chassis to meet the ATTLA specification.
4. Price/Cost Considerations (10 U.S.C 2304 (f)(3)c)): The three (3) contracts will be awarded under FAR Part 12, Acquisition of Commercial Items, so no certified cost or pricing data will be obtained. DLA Energy has previously procured ISO containers, both with and without chassis on a competitive basis after exclusion of sources. As a result, DLA Energy has previous pricing history whereby prices for a stand-alone chassis can be extrapolated by comparing previous competitively awarded contract prices for ISOs with chassis with contract prices for ISOs without chassis. All previous contract prices for ISOs, both with and without chassis, have been determined fair and reasonable based on adequate price competition.
5. Market Research/Efforts to Obtain Competition (10 U.S.C. 2304(f)(3)(d & e)): Through market research efforts, Weldship, FIBA and GTM were notified of DLA Energy's requirement for chassis to fit the ISO containers that they have previously provided and/or wiH provide under current DLA Energy contracts. Additional market research will be conducted if, in the future, a requirement for ISO containers with chassis materializes.
6. Actions Being Taken to Overcome Barriers to Competition (1 0 U .S.C. 2304 (f)(3)(F): DLA
Energy will be procuring the exact amount of chassis to accommodate existing ISO containers without chassis, as well as those ISOs without chassis still on order. As such, it is not anticipated that any future procurements for standalone chassis will be required.
I hereby certify that the information contained in this justification is accurate and complete to the best of my knowledge and lief.
