SECTION E - INSPECTION AND ACCEPTANCE
52.246-4 INSPECTION OF SERVICES - FIXED PRICE (AUG 1996)
Definition: “Services,” as used in this clause, includes services performed, workmanship, and material furnished or utilized in the performance of services.
The Contractor shall provide and maintain an inspection system acceptable to the Government covering the services under this contract.
Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.
The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The Government shall perform inspections and tests in a manner that will not unduly delay the work.
If the Government performs inspections or tests on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties.
If any of the services do not conform with contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by reperformance, the Government may --
(1) Require the Contractor to take necessary action to ensure that future performance conforms to contract requirements; and
(2) Reduce the contract price to reflect the reduced value of the services performed.
(f) If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may --
(1) By contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service; or
(2) Terminate the contract for default.

SECTION M - EVALUATION FACTORS FOR AWARD
52.212-2 EVALUATION - COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
(i) Technical/Management;
(a) Staffing
(b) Operations
(c) Maintenance
(d) Safety
(e) Security
(f) Environmental
(g) Training
(h) Furnished Items
(i) Other Performance Requirements
(ii) Past Performance;
(iii) Price;
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
ADDENDUM TO 52.212-2 – EVALUATION – COMMERCIAL ITEMS (OCT 2014)
Basis for Award. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Award of these contracts will be made using formal source selection procedures. The Source Selection Authority will make a final selection based on each offerors ability to satisfy the requirements of the solicitation and is determined to be the Lowest Price Technically Acceptable (LPTA) offeror. In order to be acceptable for award there must be an acceptable rating in every factor and subfactor as per source selection procedures. If one technical subfactor is rated unacceptable then the overall technical rating will be unacceptable. The following factors shall be used to evaluate offers:
Factor 1 – Technical/Management, Factor 2 – Past Performance, and Factor 3 – Price.
FACTOR 1. TECHNICAL / MANAGEMENT: The offeror’s proposal must demonstrate a clear understanding of the nature and scope of the work required. Failure to provide a realistic, reasonable, and complete proposal will reflect a lack of capability to perform the work requirements and will result in a determination that the offeror’s proposal is unacceptable. Technical/Management criteria will be rated Acceptable or Not Acceptable.
Subfactors:
(a) Operations - Technical, managerial, and operational details of supporting normal and contingency operations, accounting, and fuel quality assurance/surveillance on multiple fuel systems capable of meeting all of DLA Energy’s service requirements.
(b) Personnel / Training – Technical, managerial, and operational details to ensure contractor personnel have requisite skills and associated training to accomplish all government requirements.
(c) Maintenance – Technical, managerial, and operational details of planning and conducting operator and preventive maintenance and identifying corrective maintenance items for resolution.
(d) Safety / Environmental – Technical, managerial, and operational details of planning and conducting operations in compliance with environmental laws and regulations and safety policies and procedures.
(e) Security - Technical, managerial, and operational details of meeting physical, information, and personnel security requirements.
(f) Environmental - Technical, managerial, and operational details of planning and conducting operations in compliance with environmental laws and regulations.
(g) Training - Technical, managerial, and operational details to ensure contractor personnel have requisite skills and associated training to accomplish all government requirements.
(h) Furnished Items - Technical, managerial, and operational details of providing and maintaining Contractor furnished items and handling government furnished items to support normal and contingency operations to meet mission requirements.
(i) Other Performance Requirements - Technical, managerial, and operational details to ensure Contractor is familiar with special programs and periodic requirements.
Note: The ratings are established in accordance with (IAW) 52.212-2 Evaluation - Commercial Items (OCT 2014). Questions and/or comments will be addressed during negotiations. An offer can be made “Acceptable” after negotiations have been conducted. The offeror must provide additional written details for all areas marked “Unacceptable” by the date set for submission of the Final Proposal Revision.
The Technical Evaluation Team will rate the technical proposals according to the definitions below:
ACCEPTABLE Proposal clearly meets the requirements of the solicitation.
UNACCEPTABLE Proposal clearly does not meet the requirements of the solicitation.
Note: Any offeror who receives an overall Technical/Management rating of less than Acceptable after final proposal revisions will not be eligible for an award. Subfactors A through I are of equal importance to each other.
FACTOR 2. PAST PERFORMANCE: Past Performance will be rated as Acceptable or Not Acceptable. To be considered awardable, offerors must have an Acceptable Past Performance rating.
The Government may evaluate the offeror's recent and relevant past performance using the information from references provided by the offeror. The past performance evaluation may include a past performance questionnaire, reports from the Contractor Performance Assessment Report System (CPARS), the Past Performance Information Retrieval System (PPIRS), and the Federal Awardee Performance and Integrity Information System (FAPIIS). The Government reserves the right to consider any additional information on the offeror obtained from other sources available to the government. The relevant experience (similar work experience) of key personnel may also be considered for this factor. A record of poor performance may be considered as an indication that the offeror has failed to conform to contract requirements and/or to standards of good workmanship, adhere to contract schedules, including the administrative aspects of performance, provide reasonable and cooperative behavior and commitment to customer satisfaction, and/or display a business-like concern for the interests of the customer.
Offerors are instructed that past performance information submitted may include that for performance still in progress; however, it should have a minimum of six months of performance history and no more than three years old from the closing date of the solicitation. The past performance evaluation shall consider whether the offeror’s relevant present/past performance effort involved similar magnitude of effort and complexities this solicitation requires. The evaluation shall also evaluate the offeror’s past performance to determine how well the offeror performed on those efforts.
In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated acceptable or unacceptable on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability, “Unknown” shall be considered Acceptable. A record of acceptable past performance will not result in a favorable assessment of an otherwise unacceptable proposal. As a Joint Venture, each partner’s experience and past performance may be evaluated and weighted against their respective roles identified in the Joint Venture agreement. This evaluation may be combined for a final past performance rating.
A questionnaire format will be used to solicit information from an offeror’s submitted references in the following areas: (1) schedule,
(2) management of key personnel, (3) quality of services, and (4) business relations. The Source Selection Evaluation Board (Contract Team) will review this past performance information and determine its quality and usefulness as it applies to the procurement.
Past Performance Relevancy Ratings Rating Definition Relevant Present/past performance effort involved scope and magnitude of effort and complexities this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
Upon determining how recent past performance was, relevancy, and how well the offeror performed, past performance will be rated “Acceptable” or “Unacceptable”.
Past Performance Evaluation Ratings
RATING DESCRIPTION
Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
FACTOR 3. PRICE: The Contract Team of the SSET will perform the evaluation of the offered price. Firm Fixed Price (FFP) contract(s) will result from this solicitation. Price will always be evaluated for reasonableness. The Government will evaluate offers for award purposes in accordance with FAR 52.212-2 – Evaluation – Commercial Items and Addendum to FAR 52.212-2 as follows:
The total price offered for AETC Randolph for Contract Line Item Number (CLIN) 0001 (BASE PERIOD) will be multiplied by 48. The total price for the option period under CLIN 0002 (OPTION PERIOD) will be multiplied by 60. The Government may determine that an offer is unacceptable if the OPTION price is significantly unbalanced.
In accordance with FAR 52.217-8 (Option to Extend Services), the Government has the unilateral right to extend any resulting contract under the same terms and conditions for a total of not more than six months. The method for evaluating the extension is to multiply an additional six months of requirements by the offered monthly price of CLIN 0002 (OPTION PERIOD)
CLIN 0001 CLIN 0002
The total price offered for AETC Laughlin for CLIN 0004 (BASE PERIOD) will be multiplied by 48. The total price for the option period under CLIN 0005 (OPTION PERIOD) will be multiplied by 60. The Government may determine that an offer is unacceptable if the OPTION price is significantly unbalanced.
In accordance with FAR 52.217-8 (Option to Extend Services), the Government has the unilateral right to extend any resulting contract under the same terms and conditions for a total of not more than six months. The method for evaluating the extension is to multiply an additional six months of requirements by the offered monthly price of 0005 (OPTION PERIOD) CLIN
000 CLIN 0005
The Government reserves the right to perform a price realism to determine whether the offeror understands the requirements and to determine the firm’s responsibility IAW FAR 9.104-1(b). If price realism is performed and an unfavorable determination is made, the Government reserves the right to award to other than the lowest price offeror.
Competitive Range:
The Government reserves the right to limit the number of offers included in the competitive range for the purposes of efficiency in accordance with FAR 15.306(c)(2).
M-0002 M72 EVALUATION OF OFFERS (EXCEPTIONS/DEVIATIONS) (DLA ENERGY APR 1997)
(a) Offerors are expected to submit offers in full compliance with all terms and conditions of this solicitation.
(b) Any exceptions/deviations to the terms and conditions of this solicitation will result in the Government's determination that either—
