Questions and Answers Posted 13 August 2020
1. In reference to the Amendment 5 addition of clause FAR 52.215-23, Limitations on Pass-Through Charges, and provision, FAR 52.215-22, Limitations on Pass-Through Charges Identification of Subcontract Effort.
According to FAR part 15.408(n), this clause and provision are not applicable to DoD fixed-price contracts with economic price adjustment awarded on the basis of adequate price competition or fixed-price contracts with economic price adjustment for the acquisition of a commercial item.
Can you explain why this clause and provision were added by Amendment 0005 since this solicitation is for a fixed-price contract with economic price adjustment for the acquisition of commercial items? Will 52.215-22 will only need to be completed if DLA finds that the contract cannot be awarded on the basis of adequate competition, e.g. only one responsive offer is received?
Applicability and use of FAR 52.215-22 and FAR 52.215-23 will be determined based on offers received.
2. In reference to submission of Volume 5, Solicitation and Amendments (Section L.7.1).
Which documents need to be returned with Volume 5, Solicitation and all Amendments? For example, would it be sufficient to return a completed and electronically signed SF 1149 with amendment acknowledgements along with any completed solicitation provisions from the file “1 SPE4A520R0150 SF1149.plain” if not answered in a separate part of the offeror’s proposal, e.g. offeror information, offeror representations and certifications?
Volume 5, Solicitation and all Amendments, should consist of one signed copy of the SF 1449 solicitation and one signed copy of each of the SF 30 amendments. Electronically dated signatures will be accepted.
Vendor fill-ins for clauses/provisions within the SF 1449 and SF 30s are expected to be completed and returned with signature pages of each document. If there are portions of the SF 1449 or SF 30s that are also supported by documentation in another Volume of the proposal, offerors are encouraged to cross-reference as necessary.
