EVALUATION CRITERA
Addenda to FAR 52.212-2 -- Evaluation -- Commercial Products and Commercial Services
(NOV 2021)
The Government will award a contract to the offeror with the lowest evaluated price meeting or exceeding the acceptability standards for non-cost factors, which is deemed responsible in accordance with the Federal Acquisition Regulations (FAR), DFARS and DLAD, and which has submitted a quote conforming to the solicitation requirements. The requirements include all stated terms, conditions, completion of representations and certifications, and all other requirements of this solicitation. The initial offer should contain the offeror’s best terms from a cost and technical standpoint. Technical tradeoffs will not be made, and no additional credit will be given for exceeding acceptability. Award will be made on all or none basis.
The following factors will be used to evaluate quotes:
• Technical
• Past Performance
• Price
Technical and past performance, when combined, will not be weighed because the LPTA evaluation method will be utilized instead.
The award decision process is being conducted under FAR Part 12 and FAR Part 13, wherein the
Contracting Officer is permitted to engage in communications with individual contractors that do not rise to the level of “discussion” or “negotiations” as understood in FAR Part 15, evaluations of proposals.
The Government reserves the right to evaluate quotes and may seek to make an award without asking for revised quotes or entering substantive discussions. Accordingly, contractors are encouraged to provide their most realistic and competitive terms with their initial quotes.
If the Contracting Officer does determine it is in the Government’s best interest to conduct communications with quoters, and a contractor is given an opportunity to correct any clerical errors and/or obvious mistakes in a quote, and after correction the quote is still determined to be unacceptable, such determinations may be cause for rejection of the quote. The Government reserves the right to make a final determination whether a quote is acceptable or unacceptable solely on the basis of the information submitted and proceed without requesting additional information.
Technical: Technical Factor will be evaluated on an acceptable/unacceptable basis and shall not be rated. The offeror’s quote will be evaluated to determine if the quoter has demonstrated compliance with the requirements of Attachment 1 – Statement of Work.
The Government will also review the offeror’s quote to confirm the vendor has provided a Letter of
Supply from Hewlitt Packard (HP) and has submitted 508 VPAT documentation.
A quote deemed “unacceptable” in this factor will not be further evaluated or considered for award.
Past Performance: The Government evaluates past performance information as a predictor of future contract performance. Past Performance Factor will be evaluated on an acceptable/unacceptable basis.
The Government will evaluate the Offeror’s past performance by utilizing any or a combination of any of the following methods: accessing vendor information in Supplier Performance Risk System
(SPRS) [See DFARS 252.204-7024 Notice on the Use of the Supplier Performance Risk System
(MAR 2023)], Federal System for Award Management (SAM) database, Contractor Performance
Assessment Reporting System (CPARS) database, or other databases; interviews with Managers, Officers, and Officials; and any other information available to determine the quality and relevance of the Offeror’s past performance. The Government reserves the right to independently seek past performance information through open market contacts, government systems, and other government agencies.
In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance.
Therefore, the Offeror shall be determined to have unknown past performance.
In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”. Should the Government discover adverse past performance information to which the Offeror(s) had not had a prior opportunity to respond, the Contracting Officer will conduct communications if deemed appropriate.
The Government will rate Offeror’s Past Performance as follows:
Acceptable: Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable: Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
Quotes found to be acceptable for the non-cost factors will be evaluated for the lowest price.
Price: Technically acceptable quotes found to have an acceptable record of past performance will be evaluated for the Lowest Total Price (inclusive of all options). Prices must be submitted for all contract line item (CLINs) to be evaluated for a single contract award. Offers that do not propose on or cannot perform all CLINS shall not be considered.
In accordance with FAR 13.106-3(a), the quote will be evaluated for fairness and reasonableness utilizing price analysis techniques.
Award will be based on the Lowest Total Priced quote that meets or exceeds the acceptability standards for the non-cost factors.
Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
