Amendment 0003

Amendment 0003 is hereby incorporated into solicitation SP3300-11-B-5003 and shall become part of any resulting contract.

Amendment 0003 is being issued to provide answers to vendor questions.

Questions/Answers

Question 1: At our walk-thru we saw that all the equipment on roof has lightning protection but there is no mention of it on the drawings or specs.

Is it required?

Answer 1: Yes, lightening protection is required on any new equipment that is being added to the roof.

Question 2: The core sample does not indicate the existing Gypsum sheathing - are we to assume they stopped at the "existing" vapor barrier? - Detail 3 calls for field match of existing sheathing. Just want to make sure that existing sheathing and vapor barrier exists.

If in fact there is no existing vapor barrier or gypsum sheathing; do you still want vapor barrier and sheathing over the areas scheduled for deck replacement?

Answer 2: As mentioned above, No, we do not need to have these items added.

Question 3: The specifications for this project as delivered, however, do not make it clear what fresh air ventilation requirements are required for Bldg. 87, a key element in the solar air heating design for this building. The specified surface area of approximately 4,600 ft2, however, suggests that 20,000 to 30,000 CFM is required in solar pre-heated air for Bldg. 87.

Answer 3: Solar wall requirements are listed on drawing A-202 and total ventilation is listed in the Makeup air unit schedule.

Question 4: The specifications for Bldg 87 also refer to the polycarbonate panel product being promoted by Conserval as a generic design feature, but there is no indication of the purpose of this panel. which in our view would not offer any performance benefit to alternate heating system design.

We would hesitate to offer this particular product, as we are unaware that is has been certified by CSA international or SRCC standards organizations, tested by Exova or recognized by the NREL (National Renewalble Energy Lab, the U.S. Department of Energy's agency for renewable energy and energy efficiency research, development and deployment).

Given that the effectiveness of the panel is undocumented and therefore experimental, could you please provide information on what performance specifications are required that would justify its addition to the project?

Answer 4: The 2 stage (glazed) product has been independently tested by the National Solar Test Facility which is an SRCC (Solar Rating &Certification Corporation) accredited laboratory and shows a 30-35% increase over standard unglazed products. the reference to "see how it works" is to verify that under our actual site conditions we see the claimed increase in efficiency over a standard unglazed product. The product specified is currently installed at multiple sites and is not experimental. The product characteristics for the successful product must be able to

SP3300-11-8-5003

Amendment 0003 produce a 49.4 degree temperature rise at 2CFM/ft2, with a 7.6 MPH wind and 900 watts/m2 radiation.

Question 5: We are aware that Conserval Engineering's top collector solar air heating patent expired several years ago, but we believe that the idea of adding the polycarbonate panel may be one of the Canadian company's current patents.

Can you confirm for us that the supply of the specified non-patented solar-air heating system is open to all qualified suppliers and their certified products, and that - with respect to Conserval's polycarbonate add-on panel - it is not required by the project's mechanical and technical specifications?

Please confirm also that as an uncertified product, the supply of the polycarbonate panel is optional, and not specifically tied in any way to the supply of the solar air heating system itself.

An alternate Air Heating product qualifies for this tender in every respect, including ARRA requirements. In our view, however, requiring the use of an uncertified, proprietary panel in combination with an industry- standard product - for which no proprietary claim exists - could be interpreted as a means of constraining competition in the context of this bid.

Finally, I would like to formally request authorization to substitute Conserval's solar air heating system (and add-on panel) with that of the product designed and developed by an alternate source.

Answer 5: The glazed (2 stage) product system as described above has been certified by an independent testing agency(see question 4 response) and is required where indicated on the drawings or similar products with the same operating characteristics. The use of unglazed (single stage) panels is also open to similar product with the same operating characteristics.

All other terms and conditions remain unchanged.
