Amendment 0005
The purpose of this Amendment 0005 is to make revisions to SP0600-14-R-0206 as follows:
1) Section M – EVALUATION FACTORS FOR AWARD, FAR 52.212-2 -- Evaluation -- Commercial Items. (Jan 1999) reads as follows:
The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Awards will be based on a Lowest Price Technically Acceptable methodology. Evaluation will occur at the Factor level, for an overall rating for Technical. All factors except price will be rated either “Acceptable” or “Unacceptable”. If any factor is rated Unacceptable, then the entire offer will be considered Unacceptable.
(a) The following factors shall be used when evaluating offers :
Factor 1: Past Performance
Using CPARS, PPIRS, and equivalent past performance systems used by the United States Government and other past performance information reasonably available, an offeror shall be considered Acceptable if the Company’s past performance overall rating is “Acceptable”.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”.
Factor 2: Technical Capability
Subfactor 1:
READINESS PLAN. The readiness plan factor evaluates the effectiveness and efficiency of the offeror’s plan in rapidly responding to the government’s requirements after the contract is activated. It assesses the offeror’s understanding of all aspects of the effort to be performed and the likelihood of success in meeting the Government’s requirements. The factor also evaluates the likelihood of successful performance. The readiness plan will also be assessed for completeness and ingenuity.
Subfactor 2:
RESPONSE AND SUSTAINMENT PLAN. The response and sustainment factor evaluates the effectiveness and efficiency of the offeror’s plan in responding to and sustaining the government’s requirements after the contract is activated and its ability to maintain a high level of performance for a span of time, usually with only 24 hours notice. It assesses the offeror’s understanding of all aspects of the effort to be performed and the likelihood of success in meeting and exceeding the Government’s requirements by augmenting the offeror’s normal commercial distribution capability.
The factor also evaluates the offeror’s capability to swiftly react to a situation. The response and sustainment plan will also be assessed for completeness and ingenuity.
Subfactor 3:
EQUIPMENT. The equipment factor evaluates whether the contractor has the necessary equipment which is required to deliver to an area (without any guaranteed infrastructure), such as special hoses, nozzles, trucks with built in capability to provide a metered ticket at the site at the time of delivery for accountability purposes, safety equipment, communications equipment, etc.
Factor 3: Price
Price will be evaluated by multiplying the estimated amount by the unit price per line item. DLA Energy will evaluate all line items within a region as a group for an overall total price per region. Awards will be made on a region basis.
Amendment 0005
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
2) Section B - SUPPLIES OR SERVICES AND PRICES/COSTS, B19.27-3 Economic Price Adjustment - Market Price (PC&S) (Ethanol) (DLA Energy Jan 2012) reads as follows:
ULSD PLATTS DAILY US GULF WATER #AATGZOO $2.987500
28 PLATTS DAILY US GASOLINE GULF WATER #PGACU00 $2.619200
