Amendment 0003, Page 2

A. This amendment is hereby issued to incorporate the CLIN structure for the one year option period (see below) which was omitted from the solicitation. Due to this omission, the deadline for proposal submissions has been re-opened and extended to April 17, 2013 9:00AM EST. This extension is only granted to those whose proposal was received prior to the April 15, 2013 9:00AM EST deadline.

B. In accordance with FAR clause 52.212-2 Evaluation -- Commercial Items (Jan 1999) Factor 3 Price: The low offer will be determined by computing the total cost to the Government for one year of service. This will be accomplished by multiplying the monthly service charge offered in Line Item 1001 of the schedule by 12 months (for Base Period) then for the one (1) one-year option. The Government will then add the total price for the option to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.

LINE ITEM 2001 – MONTHLY USE CHARGE (MUCC): (OPTION PERIOD: (1) one-year option)

NOTE: IAW DLA ENERGY I-0007-I209.03, Extension Provision (Storage), the contractor is accepting that price for the six one (1) – month extensions (if required) will remain the same as the offered price under CLIN 2001 (MUCC) unless otherwise stipulated.

NOTE: For clarification of THROUGHPUT:

The Government expects to receive the first 105,000 barrels of product into storage after initial fill, per year or prorated for part thereof for any part year that the use of the storage is limited to a period of less than one year at NO ADDITONAL CHARGE (Include TANKAGE charge).

The Government expects to ship the first 105,000 barrels of product out of storage after initial fill, per year or prorated for part thereof for any part year that the use of the storage is limited to a period of less than one year at NO ADDITIONAL CHARGE (Include TANKAGE charge).

LINE ITEM 2001AA - EXCESS THROUGHPUT (EXTP):

Excess Throughput: Excess throughput will be calculated by multiplying the total number of barrels received and shipped in a 12-month period above the allowed throughput quantity by the excess throughput charge
