About this file
This is a contract terms and conditions document for a Master Agreement between the State of Maine's Department of Environmental Protection and a vendor to supply sorbent booms and sorbent pads. The contract covers the period from June 1, 2011 through May 31, 2012, with an option for two additional one-year extensions. Deliveries will be made to three Department of Environmental Protection warehouse locations in Augusta, Portland, and Bangor, Maine. Contractors must provide 24-hour advance notice prior to delivery and are responsible for delivering items in first-class condition. The contract requires the contractor to accept the State of Maine Procurement Card as a form of payment without surcharge or additional compensation.
The estimated contract value is approximately $25,000 annually, though actual expenditures will be based on quantities ordered during the contract term. All contract prices remain firm throughout the duration and include transportation charges with FOB destination delivery. Delivery orders of $5,000 or less will be emailed directly to the vendor by the using agency, while orders exceeding $5,000 require approval and encumbrance by the Division of Purchases. The State is exempt from excise taxes and will provide exemption certificates upon request. Separate invoices are required for each order and must reference the contract number and Federal ID number to avoid payment delays. The State reserves the right to cancel the contract with thirty days' written notice or immediately if the contractor fails to conform to contract terms or changes product specifications. Additionally, the successful bidder's willingness to extend contract pricing to Maine political subdivisions and school districts will be considered in the award decision.
