This work shall include planning, programming, administration, management, supervision, maintenance of accurate and complete records and files, quality control inspection, facilities, and personnel necessary to operate and maintain Government-owned facilities and equipment. The Contractor shall personally supervise the work or always have a competent Superintendent on the site. The superintendent shall possess full authority to act on behalf of the Contractor and to legally bind the Contractor. The work will be performed in recreation and operational areas, as well as various remote locations, in and around the Ouachita, Greeson, and DeGray Lake projects. Work under this contract will be performed as orders are placed. Ouachita, Greeson, and DeGray Lakes are located in Southwest Arkansas. The projects are split over 5 counties including Garland, Montgomery, Pike, Clark, and Hot Spring County, AR. Cities around the projects include Hot Springs, Murfreesboro, Caddo Valley, and Arkadelphia, AR.

1.1.1 Government-Furnished Equipment, Materials, and Supplies: The Government shall not be responsible for providing any equipment, materials, or supplies associated with the performance of any work to be done by the Contractor.

1.1.2 Contractor-Furnished Equipment, Materials, and Supplies: The Contractor shall provide all labor, materials, supplies, and other items necessary for the operation, maintenance, repair, and replacement requirements as specified in each technical provision, or as negotiated via task orders.

1.1.3 Industry Standards/Quality of Product: It is the intent of this requirement to ensure that all work is performed in accordance with appropriate industry standards to obtain quality products.

Replacement parts and facilities will be equal or better than those being replaced. Replacement of parts with lower quality parts will result in the work being determined as non-compliant with this contract and shall be re-done at the Contractors expense. Work which does not meet industry standards or is otherwise not in accordance with contract requirements will be re-done at the Contractor's expense.

1.1.4 Term: This contract will have a base ordering period with four options and a 6-month ordering period.

1.1.5 Other Contracts: Other contractors may be on site performing other work for USACE. The Contractor shall cooperate with such other Contractors, its employees and/or Government employees. The Contractor shall not commit or permit any act of interference in the performance of work of other Contractors or Government forces. If there appears to be a conflict, the contractor shall notify the COR and Contracting Officer to deconflict.

1.1.6 Pre-work Conference: The Contractor shall attend a pre-work conference as soon after task order award as practical, depending on when actual performance is to begin. The intent is to conduct the conference prior to work and start no later than 15 days after award of a task order.

During this conference, USACE shall establish the line of authority and Government procedures for contractual, administrative, and work matters. The schedule of required submittals and reports will also be discussed.

1.1.7 Coordination Meeting: The coordination meeting will be separate from the Pre-work Conference as required in the previous paragraph. Before work commences, the Contractor and its staff shall meet with the COR. Discussion will be held to develop a mutual understanding of quality control requirements, details of the reporting requirements, implementation of the accident prevention plan, the interrelationship of the Government's inspection system to the Contractor Quality Control (CQC) plan, and all other aspects of the contract. These computers are to be used for tasks including inventory control, Maintenance Management, use of the Facilities and Equipment Maintenance (FEM) system, and access to the Government e-mail system. The contractor's management and administrative staff who will be using Government-furnished computer equipment and network shall obtain Common Access Cards (CACs). The Contractor shall provide and maintain all other Information Technology equipment, such as computers, printers, and scanners, necessary to fulfill the technical requirements of this contract.

1.2.0 Government Furnished Facilities: The Government shall not provide any office, storage, or operational facilities for the Contractor. 1.2.2 Experience and Qualifications of Personnel: The Contractor shall provide an adequate and efficient number of trained and fully qualified personnel to accomplish tasks at Ouachita, Greeson, and DeGray Lakes in accordance with these specifications. All employees shall be subject to such Government regulations as are applicable during the time spent on Government property. The Contractor shall inform the COR of any personnel changes.

Subcontractors may be utilized to perform highly specialized or one-time type repair work. The Contractor shall provide an adequate number of fully qualified personnel at Ouachita, Greeson, and DeGray Lakes to comply with these specifications efficiently and effectively. In some instances, and for some duties, contract employees will be required to undergo background investigations prior to performing the duties.

1.2.3 Background Checks: The Contractor shall be required to provide background checks on all employees who must access Government secure facilities. Examples are Dams, offices, Welcome Visitor Centers, etc.

General Requirement

Prior to onboarding any employee, subcontractor, or agent for performance under this contract, and strictly prior to initiating any U.S. Army Corps of Engineers (USACE) security requirements

(including but not limited to background investigations, e-QIP/NBIS submissions, or Common Access Card (CAC) processing), the Contractor shall conduct an independent, comprehensive pre-employment security and suitability screening. The Contractor is solely responsible for ensuring that only individuals of sound character and conduct are proposed for work on USACE facilities or systems.

Scope of Contractor-Conducted Screening

The Contractor's internal pre-employment screening must be completed at the Contractor's expense. At a minimum, the screening shall include the elements detailed in the table below:

Screening Component and Minimum Requirements:

Criminal History Check: National and local jurisdiction criminal record searches covering a minimum of the past seven (7) years.

Sex Offender Registry: Verification against the Department of Justice National Sex Offender Public Website (NSOPW).

Employment Verification: Confirmation of the previous five (5) years of employment, including inquiries into any terminations for cause or workplace misconduct.

Reference Checks: Minimum of two (2) professional references to assess general character, reliability, and past behavioral conduct.

Suitability and Disqualifying Factors

The Contractor shall review the results of the screening to determine the candidate's suitability for performance under this contract. The Contractor shall not present any candidate for USACE security processing if the pre-employment screening reveals "bad behavior" or derogatory information that would logically preclude the individual from obtaining federal facility or network access.

Disqualifying Category and Description of Derogatory Information:

Criminal Conduct: Felony convictions, pending felony charges, or recent (within 5 years) misdemeanor convictions involving violence, theft, fraud, or drug-related offenses.

Domestic Violence: Any conviction of a misdemeanor crime of domestic violence (Lautenberg Amendment compliance).

Workplace Misconduct: Documented history of workplace violence, sexual harassment, gross negligence, or insubordination.

Suitability and Disqualifying Factors

Prior to submitting any candidate's information to the USACE Security Office or the Contracting Officer's Representative (COR) for official government background processing, the Contractor must provide a written certification.

The certification must state: "The Contractor certifies that a comprehensive pre-employment background and conduct screening has been completed for [Candidate Name] in accordance with contract requirements. No derogatory information or criminal history was identified that would preclude the candidate from performing duties under this contract or meeting USACE security standards."

Government Right of Refusal

Compliance with this pre-screening requirement does not guarantee that the individual will successfully pass the official USACE security adjudication process. The Government retains the absolute right to deny access to USACE facilities, networks, or information to any Contractor employee based on the results of the official government investigation, regardless of the Contractor's preliminary screening results.

1.2.4 Removal of Contractor's Employee(s): All contract employees shall always conduct themselves in a proper manner. The Contractor shall remove or reassign from work under this contract any employee who, in the opinion of the COR, is objectionable or incompetent. The COR may require the Contractor to immediately remove from the work site any employee of the Contractor who is considered incompetent, or who endangers people or property, or whose physical or mental condition is such that it would impair the employee's ability to satisfactorily perform the work. Contractor employees found to be under the influence of any drug or alcohol, mental or physical impairment, negligent in the use of personal safety equipment or established safety policies or procedures, may be subject to immediate removal from the Ouachita, Greeson, and DeGray Lakes Site, depending on the nature of incident. Repeated or continual ongoing safety infractions shall be grounds for removal from all Government facilities related to this solicitation.

Notification of objection by the COR will be made promptly to the Contractor in writing if time or circumstances permit. Otherwise, notification shall be made by telephone and shall be confirmed in writing as soon as possible. These requirements shall not be the basis of any claim for compensation and/or damages against the United States and/or any of its officers or agents. In addition, no such removal will reduce the Contractor's obligation to perform all the work under this contract, and immediate replacement will be made as required.

1.2.5 Management and Administrative Personnel Scope of Work: The Contractor shall provide adequate personnel to conduct appropriate management and administrative duties for all work performed under this contract. These functions include, but are not limited to supervision, personnel management, work planning and scheduling, quality control, maintenance, data entry, recordkeeping, safety, and property management. Multiple responsibilities can be held by single employees. For purposes of this contract, crew leader responsibilities are not considered managerial in nature and are not covered by this Technical Provision (TP). Any general management and or administrative costs (to include Facilities and Equipment Maintenance (FEM) system support) are to be applied to the work being performed as part of the fully burdened CLIN amounts.

1.2.6 Supervision: The Contractor shall establish a defined chain of command including superintendent, contractor representative, and quality control personnel. It is intended that these positions are administrative in nature and required to ensure compliance with contract specifications.

1.2.7 Superintendent: The Contractor shall have a superintendent on site to provide adequate supervision, management, coordination, and work performance management. The superintendent shall possess full authority to act on behalf of the Contractor on all matters related to the contract.

Superintendent shall have a minimum of 2 years experience performing management duties.

1.2.8 Contractor Representative: The Contractor shall have personnel on site with the authority to act on behalf of the superintendent during times in which the superintendent is absent from the project.

1.2.9 Contractor Quality Control Officer (CQCO): The Contractor shall ensure that all work performed under this contract, including any performed by subcontractors, is in accordance with specifications and workmanship standards. The Contractor shall designate, in writing, a Contractor Quality Control Officer (CQCO) who shall be responsible for ensuring the implementation of the CQC Plan. The site Superintendent can perform CQCO duties. The Contractor shall have competent quality control inspector personnel as defined in EM 385-1-1, to ensure that the Contractor's Quality Control Plan is functioning as required. The Quality Control Officer shall be:

1. Employed directly by the Contractor with limited collateral duties beyond those specified in QC Plan.

2. Responsible only to the Contractor's top-level managers/owners (excluding the on- site superintendent).

3. Have minimum experience of five (5) years in quality control work.

4. The CQCO's time shall be utilized at Ouachita, Greeson, and DeGray Lakes.

The CQCO shall provide inspection of all items of work and rework to ensure conformance to specifications and drawings. Inspection activities performed should also include monitoring of subcontractor performance. The CQC plan shall provide for ongoing inspections of the CQC functions described herein. Government QA inspectors will assure that the CQC plan is being implemented and is effective, but the presence or absence of a Government inspector shall not relieve the Contractor of responsibility for the proper execution of work in accordance with the specifications. All contractor documentation developed to monitor quality control, to include records of deficiencies observed and corrective action(s) taken shall be furnished to the Government monthly. If recurrent deficiencies indicate that the quality control system is inadequate, corrective action will be taken. The COR must approve any proposed changes to the plan prior to its implementation.

1.3.0 Identification of Contractor Employees: Within 30 days of contract award, the Contractor shall provide employees' uniforms approved by the COR. Company identification shall be on the breast pocket or left shoulder. The Contractor shall also provide uniforms for subcontractors working on the project full time. Vests will remain required in accordance with applicable safety standards. If a safety shirt and/or vest is utilized, the company logo shall be placed on the front and back of the shirt and vest. Subcontractors working on the project full-time shall also be appropriately identified. All workers are to be fully clothed in accordance with EM 385-1-1 and maintain a neat and clean appearance. Vehicles and equipment shall be identified with company name or logo. No shirt tails hanging outside of pants and no unbuttoned shirts shall be worn while working on the project. Violations will be brought to the attention of the superintendent; continued violations will be documented in COR reports and in the Contracting Performance Assessment Reporting System (CPARS). Name plates are required for Welcome/ Visitor Center Attendants (on desk).

1.3.1 Personal Hygiene and Health: The Contractor shall insure that all employees involved in the performance of services under this contract maintain their personal hygiene in such a manner so as not to be offensive to the public. Also, under no circumstances shall the Contractor allow any employee to work if they have a communicable disease or infection, or if they are intoxicated or under the influence of alcohol or drugs. In addition, the Contractor shall ensure that all employees are physically and mentally capable of performing within their position description.

1.3.2 Unauthorized Activities by the Contractor and Employees: Within the limits of Government- owned property, the Contractor and his employees shall not engage in any activities with members of the public or private business which would be extracurricular to the services required under this contract. Specifically included in this prohibition is the sale of any goods or services to the public. The Contractor shall not accept or solicit any gratuities or favors from members of the public for any reason or under any circumstances.

1.3.3 Plans: The Contractor shall furnish the following plans within 30 days after award date for approval by the Contracting Officer (unless noted otherwise).

1. Contractor Quality Control Plan (CQC)

2. Accident Prevention/Hazardous Analysis Plan

1.3.4 Contractor Quality Control (CQC) Plan: The Contractor shall establish a comprehensive quality control program in accordance with the contract clause entitled "Inspection of Services".

This plan shall be submitted within 10 days after award and should address in detail the proposed Quality Control Program to be used to ensure compliance with the contract specifications. The plan should describe quality control concepts, purpose, and provide a general program overview. It should address the methods to be utilized to ensure that the CQC program is effective and efficient, including the inspection program to be utilized to ensure quality control goals are met. It should also include the frequency and schedule for inspecting significant project facilities and how corrective measures will be applied. The plan should address the interaction and coordination efforts that will occur between the Contractor and Government personnel involved in Quality Assurance (QA). The plan will be in sufficient detail to indicate to the Government that the

Contractor is cognizant of the contract requirements. In addition to the above, the plan should address the following areas of concern:

1. Employee performance and evaluation.

2. Identification of declines in quality of product and how substandard performance and deficiencies will be corrected.

3. Employee health and hygiene.

4. Maintenance of facilities and equipment.

5. Preparation and submission of required reports to appropriate Government personnel.

Inspections shall also include subcontractor performance. Government QA inspectors will assure that the CQC plan is being implemented and is effective, but the presence or absence of a Government inspector shall not relieve the Contractor of responsibility for the proper execution of work in accordance with the specifications.

Compliance inspections shall be documented, and records of deficiencies observed, and corrective actions taken shall be furnished to the Government. If recurrent deficiencies indicate that the quality control system is inadequate, corrective action will be taken. The COR must approve any proposed changes to the plan prior to its implementation.

1.3.5 Accident Prevention/Hazardous Analysis Plan to include Hazard Control Plan and Confined Space Entry Plan in compliance with EM 385-1-1.

The Contractor shall develop, submit, and maintain a comprehensive Accident Prevention Plan (APP) and Activity Hazard Analyses (AHA) in strict accordance with the USACE Safety and Occupational Health Requirements Manual (EM 385-1-1). This safety plan must be tailored to the specific operation, maintenance, and repair activities conducted at Ouachita, Greeson, and DeGray Lakes. The Contractor shall submit the APP to the Contracting Officer Representative (COR) for review and acceptance prior to the initiation of any on-site work. It is the Contractor's sole responsibility to ensure all personnel, subcontractors, and visitors strictly adhere to the accepted plan.

Accident Notification: The Contractor shall provide immediate notification to the COR of any accident which involves personal injury, death, and/or any property damage (to include Government property, Contractor property, and Privately Owned property). Initial notification will be verbal with follow-up in writing. All accidents involving on-the-job injuries or property damage will be telephonically reported to the COR as soon as reasonably possible after the accident, but no later than the end of shift on the day of the accident. The Contractor shall also be required to complete all appropriate reports and submit them within 24 hours of the accident or 48 hours under unusual circumstances. The COR will provide the Contractor with guidance regarding the proper forms to submit for each type of accident which might occur on the job.

The Contractor shall submit accident exposure and experience incidental to this work in accordance with Section 2, EM-385-1-1.

The Contractor shall be responsible for safeguarding all work sites in all areas. Appropriate signs, warning devices, and barriers will be used to protect the public, Contractor employees, and Government employees where work is being accomplished.

1.3.6 Invoicing: Will be in accordance with the instructions provided in each task order.

1.3.7 ANTITERRORISM AND OPERATIONS SECURITY (AT/OPSEC)

In accordance with OPORD 2013-74, Annex A, the following paragraphs apply to this requirement:

a. General security requirements and guidance: The security requirements described below apply to all contract personnel (including employees of the prime Contractor ("Contractor") and all subcontractor employees) supporting the performance requirements of this contract. The Contractor is responsible for compliance with these security requirements. Questions regarding security matters shall be addressed to the designated Government representative (e.g., Contracting Officer Representative (COR), Requiring Activity (RA) representative, or Contracting Officer (if a COR or other RA representative is not appointed)). Contract personnel are critical to the overall security and safety of US Army Corps of Engineers (USACE) installations, facilities and activities, and security awareness training contributes to those efforts. The Department of Defense (DoD) and Army security training requirements specified below, if applicable, are performance requirements; all applicable contract personnel shall complete initial training within 30 days of contract award or the date new contract personnel begin performance on the contract. Within five business days from the completion of training, the Contractor shall provide written documentation (e.g., email or memorandum) to the Government representative. The documentation shall include the names of contract personnel trained and which training they completed; the Contractor shall maintain training records as part of their contract files and be prepared to provide copies of training certificates to the Government representative. Contractor personnel and vehicles are subject to search when entering federal installations. Additionally, all contract personnel shall comply with Force Protection Condition (FPCON) measures, Random Antiterrorism Measures (commonly referred to as "RAMs"), and Health Protection Condition (HPCON) measures. The Contractor is responsible for meeting performance requirements during elevated FPCON and/or HPCON levels in accordance with applicable RA plans and procedures, to include identifying mission essential and non-mission essential personnel. In addition to the changes otherwise authorized by the changes clause of this contract, should the FPCON or HPCON levels at any individual facility or installation change, the Government may implement security changes that affect contract personnel. The Contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identified in local policies or procedures.

b. Antiterrorism (AT) Level 1 training: All contract personnel requiring routine access to Army installations, facilities, and controlled access areas, or requiring network access shall complete initial and annual refresher AT Level I awareness training. Online AT Level I awareness training is available at https://jko.jten.mil/ (website subject to change).

https://jko.jten.mil/

c. Physical security and access control requirements: All contract personnel requiring physical access to a federal installation or facility shall comply with the access control procedures of that location. Contract personnel requiring unescorted access to meet contract performance requirements on a DoD installation in the US shall be vetted by the installation/facility Provost Marshal/Directorate of Emergency Services/Security Office using the National Crime Information Center-Interstate Identification Index (commonly referred to as "NCIC-III") and Terrorist Screening Database (commonly referred to as "TSDB"). Contract personnel shall comply with all personal identity verification requirements specified in installation/facility policies and procedures. Contract personnel who do not meet requirements for unescorted access to USACE facilities shall coordinate escorted access with the Government representative, as needed. Contract personnel who receive keys, access cards, or lock combinations that provide access to government-owned property shall comply with key and lock control procedures of the RA.

d. Contract personnel requiring a common access card (CAC): Contract personnel will be issued a common access card (CAC) only if duties involve one of the following: (1) both physical access to a DoD facility and access to DoD information systems or networks; (2) remote access to a DoD information system or network using DoD-approved remote access procedures; or (3) physical access to multiple DoD facilities or multiple non-DoD federally controlled facilities on behalf of the DoD on a recurring basis for a period of 6 months or more. Before CAC issuance, contract personnel must have at a minimum, a favorably adjudicated Tier 1 investigation or an equivalent or higher investigation in accordance with applicable Army regulations and Homeland Security Presidential Directive-12 (HSPD-12). At the discretion of the RA, an initial CAC may be issued based on a favorable review of a fingerprint check and a successfully scheduled Tier 1 investigation with the National Background Investigations Bureau. The RA provides contract personnel with additional information and forms to initiate the CAC issuance process, and/or to initiate background investigations, when required. Contract personnel shall complete these processes within established timelines to avoid delays.

e. Suspicious Activity Reporting training (e.g., iWATCH, CorpsWatch, or See Something, Say Something): All contract personnel shall receive initial and annual refresher training from the RA representative on the local suspicious activity reporting program. This locally developed training provides contract personnel with general information on suspicious behavior, and guidance on reporting suspicious activity to the project manager, security representative or law enforcement entity.

f. Contract personnel requiring access to Government information systems: All contract personnel with access to a government information system (including USACE business systems and CAC-enabled websites) shall comply with applicable DoD and Army regulations and shall use the organization's UserID-Password Administration and Security System (U-PASS) at commencement of services to request network user accounts. Contract personnel shall complete DoD Information Assurance Awareness training prior to accessing information systems, and annually thereafter.

h. Escorting in classified and/or sensitive areas: In accordance with applicable regulations, all contract personnel who do not possess the appropriate security clearance or access privileges will be escorted in areas where they may be exposed to classified information or operations, sensitive information or activities, or restricted areas.

i. Pre-screen candidates using E-Verify Program: Contractors shall comply with the requirements set forth in FAR clause 52.222-54 Employment Eligibility Verification and FAR Subpart 22.18 in using the E-Verify Program at (https://www.e-verify.gov/) (website subject to change) to meet the contract employment eligibility requirements.
