GENERAL INFORMATION
A.1 CONTRACT TITLE: Multi-Media Environmental Compliance Services, with an Emphasis on Storm Water, Wastewater, and Drinking Water for the Naval Facilities Engineering Command (NAVFAC) Washington DC Area of Responsibility (AOR) and US Territories.
A.2 TYPE OF CONTRACT: Award of this solicitation will result in a single, firm fixed price (FFP), indefinite delivery indefinite quantity (IDIQ) contract for environmental services.
A.3 SET- ASIDE: This contract is solicited as 100% Women-Owned Small Business (WOSB) set-aside.

A.6 CONTRACT TERM: The resulting award will provide for a five-year ordering period and the Federal
Acquisition Regulation (FAR 52.217-8 Option Period), for up to six months, if necessary.
The total period of performance is not to exceed a total of 66 months.

– WATER FOCUSED
PART 1.0 GENERAL DESCRIPTION AND PERSONNEL REQUIREMENTS
C.1 GENERAL
The intention for this contract is to provide a full range of multi-media environmental compliance services with an emphasis on Stormwater, Wastewater and Drinking Water. This basic contract will be tailored to identify specific Contract Task Order (CTO) requirements. A firm-fixed price, Indefinite Delivery/Indefinite Quantity (ID/IQ) contract will be established to perform the required services and shall be performed as outlined below.
C.2 PERFORMANCE OBJECTIVES
The Contractor will provide the full range of methods and technologies supporting activities necessary to be in compliance with environmental laws and regulations and meeting budgets and schedules. Requirements shall be carried out under CTOs for various locations primarily within Naval Facilities Engineering Command Washington footprint. To a lesser extent, work may occur at any sites located in the lands and waters of the Continental United States (CONUS) that support the U.S. Navy, Marine Corps and other federal entities supported by NAVFAC Washington. The exact location of the required effort will be specified in the individual CTOs.
CTOs will be either presented as a statement of work or as a performance-based product delivery, where desired outcomes of the work are identified without specifying the methods or technologies to be used. Contracted work is performed with minimal focus on government process and maximum focus on results. A results-based product delivery CTO enables the Contractor to select actions best suited to the site requirements and ensures that the most up-to-date and best management practices are employed.
C.2.1 GENERAL INFORMATION
The Contractor shall conduct such work to enable the customer to be in compliance with all applicable laws and regulations. The Contractor shall engage early in the process to allow for the development of the most cost-effective and technically sound solution and use its expertise to recognize and address problematic issues in executing work under the CTOs. Typical activities may include, but are not limited to, the following:
Primary Scope Stormwater Compliance:
• Survey, inspection and design of Low Impact Development (LID) facilities and stormwater Best Management Practices (BMP) and post construction award services
• Preparation or review of LID and structural and nonstructural BMP documentation
• Develop maintenance manuals for LID/BMP features
• Inventory and documentation for LID/BMP features
• Assess and evaluate the condition of stormwater system and components
• Maintenance and repairs of LID/BMP features
• Permit application and support
• Identify non-point source pollution areas including land use changes
• Investigation and evaluation of illicit discharges
• Stormwater and ambient water quality sampling and analysis including associated Quality Assurance and/or Sampling Analysis plans and self-monitoring reports
• Development of Geographic Information Systems (GIS) data and computer aided design and drafting drawing production
• Developing storm water pollution prevention plans and site compliance evaluations

Proximity to Naval District Washington Facilities The Contractor shall maintain offices within a two-hour drive of each of the major Navy and Marine Corps installations within the Naval District Washington area of responsibility. The Contractor can use multiple offices to achieve this requirement. Personnel must be available to work on this contract in each of the offices used to satisfy this two-hour requirement. Major Navy and Marine Corps installations include: Washington Navy Yard, NSF Bethesda, NSA Annapolis, NAS Patuxent River, NSF Indian Head, NSF Dahlgren, and MCB Quantico.
C.3 PERSONNEL QUALIFICATIONS
The proposed teams shall be multi-disciplinary and shall demonstrate appropriate disciplines to perform the types of work addressed above. The Contractor shall furnish sufficient technical, management and administrative personnel at all times to ensure timely execution of the work.
If, during the performance of this contract, the Contractor must remove, replace, or divert any of the listed or specified personnel, the Contractor must: (1) Notify the Contracting Officer and the Contracting Officer Representative (COR) within (3) three business days; (2) submit justification (including proposed substitutions) in sufficient detail to permit evaluation of the impact on this contract; and (3) obtain the Contracting Officer's written approval. Notwithstanding the foregoing, if the Contractor deems immediate removal or suspension of any member of its management team is necessary to fulfill its obligation to maintain satisfactory standards of employee competency, conduct, and integrity the Contractor may remove or suspend such person at once, although the Contractor must notify Contracting Officer and the COR prior to or concurrently with such action.
If Qualified Personnel are found to devote less effort than stated in the technical proposal or are performing unsatisfactorily, the KO may direct replacement of such personnel, modify or terminate the task order or contract, whichever is appropriate.
The Contracting Officer reserves the right to request resumes and documentation at any time to verify qualifications, and to require such documentation prior to use of personnel on any contract task order. Personnel qualification must include but is not limited to the following:
Principal/Program Manager. Person that is a principal, officer or senior manager of the contractor with full and unlimited authority to represent the interest of the contractor in all matters relating to the contract or to a specific Contract Task Order (CTO). The Program Manager shall be responsible for liaison between contract personnel and the Contracting Officer (KO), Contracting Officer’s Representative (COR) or Navy Technical Representative (NTR), and for maintaining a fully staffed and equipped work force. CTO negotiations shall be accomplished on a one-to-one basis between the Program Manager and the Contracting Officer. The Program Manager shall have a minimum of 10 years of full time professional experience in project management, and shall have a minimum of 2 years of experience in a program manager capacity.
QA/QC Manager. The Quality Assurance/Quality Control (QA/QC) Manager shall have a minimum of 5 years of QA/QC experience, with at least 1 of those years involved with multimedia environmental projects. Responsibilities include developing, maintaining and enforcing the contractor’s QA/QC Program.
Project/Task Order Manager. Minimum of 5 years of full time professional experience in Stormwater, Wastewater, and Drinking Water. Each Project/Task Order Manager is not required to demonstrate experience in all categories. Collectively, the Project Manager’s resumes must demonstrate experience in all categories with a minimum of a BS degree.
Project Managers must have at least 2 years full-time professional experience as a Project Manager for similar scope projects in Maryland, Virginia, and the District of Columbia. Each Project Manager is not required to demonstrate experience in all regulatory jurisdictions. Collectively, the Project Manager’s resumes must demonstrate experience in Maryland, Virginia, and the District of Columbia. The Project Manager coordinates the efforts of the other disciplines (including sub-contractors), ensuring timeliness, forecasting delays, financial performance, etc.
Additionally, this person will be the main point of contact for all required results and/or progress on projects.
Technical Specialist. This position shall be filled by persons with a BS degree in the appropriate engineering/science discipline and 10 years in a technical specialty that does not typically fall into one of the standard environmental engineering or science categories. This person would typically have a PhD or some other specific training/certification/specialization that is required for the project.
Senior Engineer. This position shall be filled by persons with a BS degree in the appropriate engineering discipline and 10 years of specifically related experience. Responsible for managing technical groups and/or management of projects of significance, prepares estimates, schedules work to meeting completion dates, directs assistance, reviews progress, evaluates results, makes changes in methods or equipment, operates with some latitude, performs technical work in support of project efforts and may serve as the Site Manager on major field efforts.
Mid-Level Engineer. This position shall be filled by persons with a BS degree in the appropriate engineering discipline and 5 years of specifically related experience. Collects and analyzes data, develops sections of reports and assists in development and design of projects. Capable of leading projects with a mid to low degree of difficulty.
Junior Engineer. This position shall be filled by persons with a BS degree in the appropriate engineering discipline with 0 to 5 years of experience. This position documents and evaluates projects and experiments and largely collects and compiles data.
Senior Scientist/Geologist. This position shall be filled by persons with a BS degree in the appropriate science discipline and 10 years of specifically related experience. Responsible for managing technical groups and/or management of projects of significance, prepares estimates, schedules work to meeting completion dates, directs assistance, reviews progress, evaluates results, makes changes in methods or equipment, operates with some latitude, performs technical work in support of project efforts and may serve as the Site Manager on major field efforts.
Utilizes theories and principles to formulate solutions to complex problems.
Mid-Level Scientist/Geologist. This position shall be filled by persons with a BS degree in the appropriate science discipline and 5 years of specifically related experience. Collects and analyzes data, develops sections of reports and assists in development and design of some aspects of a project.
Junior Scientist/Geologist. This position shall be filled by persons with a BS degree in the appropriate science discipline. Documents and evaluates projects and experiments by collecting and compiling data.
Senior Field Technician. Minimum of 10 years of experience. The qualified individual for this position is responsible for major field operations, performs more complex/sophisticated assignments, and supervises lower level technicians. Performs field-testing and prepares reports associated with data collection.
Mid-Level Field Technician. Minimum of 5 years of experience. The qualified individual for this position performs non-routine and complex assignments; performs technical services, experiments or tests which may require non-standard procedures and complex equipment, programs and/or instrumentation; records computes and analyzes test or study data; prepares appropriate documentation and may supervise lower level technicians.
Junior Field Technician/Laborer. The qualified individual for this position performs assignments that are normally standardized, may troubleshoot malfunctioning equipment or programs and make simple repairs, extracts and processes test or study data.
GIS Analyst. Minimum of 5 years of computer mapping experience with ESRI compatible products. The analyst must be able to collect and interpret mapping data from a variety of sources including field survey data and aerial photography. Knowledge of RDMS (Relational Database Management Systems) and SQL (Structural Query Languages) such as Oracle is required. Produces engineering drawing and other documents from data.
CAD Operator. This position requires someone with demonstrated knowledge and skill in computer graphics or mapping techniques. Produces engineering drawing and other documents from data.
Health & Safety Manager. Minimum of 2 years of experience with environmental sites where EPA Level C and/or Level B personal protective equipment was in use. Has specialized training in personal and respiratory protective equipment, program implementation, proper use of air monitoring instruments, air sampling methods, and interpretation of results. Has working knowledge of applicable Federal, State, and local occupational safety and health regulations. Responsibilities include ensuring that the elements of the approved site health and safety plan are implemented and enforced on site. Closely monitors worker compliance/accident statistics and implements corrective action.
Administrative. This position requires someone with demonstrated ability to handle administrative duties.
Compiles and maintains files and records for project invoices and correspondence. Supports contract from proposal development through project closeout.
Senior Contracts. Minimum of 10 years of experience with government contracting.
Junior Contracts. Minimum of 2 years of experience with government contracting.
Scientist (Chemist). Must have at least 1 year experience providing up to Level III data validation.
Stormwater Project Manager. This position is responsible for managing projects related to Stormwater. This position shall be filled by persons with at least 10 years of experience working with Stormwater collection and treatment systems. Must have experience evaluating effluent monitoring data for projects in DC, MD, or VA to assist with identifying potential sources of contamination and providing recommendations. Must have experience performing Illicit Discharge investigations, Inflow & Infiltration inspections, and system mapping projects at industrial facilities greater than ten (10) acres in DC, MD, or VA. Must have experience completing Stormwater System permitting projects in DC, MD, or VA.
Drinking Water Project Manager. This position is responsible for managing projects related to Drinking Water.
This position shall be filled by persons with at least 10 years of experience working with Drinking Water treatment and distribution systems. Must have experience performing potable water treatment and system-related projects in DC, MD, or VA, including: water quality assessments, sanitary surveys, sampling siting plans, hydraulic modeling, wellhead protection and vulnerability assessments, standard operating procedures and O&M manuals, and condition assessments. Must have experience completing drinking water treatment and distribution systems permitting projects in DC, MD, or VA.
Wastewater Project Manager. This position is responsible for managing projects related to wastewater. This position shall be filled by persons with at least 10 years of experience working with wastewater collection and treatment. Must have experience performing Wastewater projects in DC, MD, or VA, including: preparation of permit applications and monitoring reports for indirect and direct wastewater discharges and wastewater collection and treatment systems; permit compliance sampling and analysis, wastewater system operator training, wastewater characterization studies, pollution minimization plans, permitting and evaluation of land application of sludge and wastewater reuse, standard operating procedures and O&M manuals, process operability assessments. Must have experience completing Wastewater collection and treatment systems permitting projects in DC, MD, or VA.

252.201-7000 CONTRACTING OFFICER'S REPRESENTATIVE (DEC 1991)
(a) "Definition. Contracting officer's representative" means an individual designated in accordance with subsection 201.602-2 of the Defense Federal Acquisition Regulation Supplement and authorized in writing by the contracting officer to perform specific technical or administrative functions.
(b) If the Contracting Officer designates a contracting officer's representative (COR), the Contractor will receive a copy of the written designation. It will specify the extent of the COR's authority to act on behalf of the contracting officer. The COR is not authorized to make any commitments or changes that will affect price, quality, quantity, delivery, or any other term or condition of the contract.

252.232-7006 WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (DEC 2018)
(a) Definitions. As used in this clause— “Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.
“Document type” means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).
“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.
“Payment request” and “receiving report” are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.
(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232- 7003, Electronic Submission of Payment Requests and Receiving Reports.
(c) WAWF access. To access WAWF, the Contractor shall—
(1) Have a designated electronic business point of contact in the System for Award Management at https://www.sam.gov; and
(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.
(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/.
(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data Interchange, or File Transfer Protocol.
(f) WAWF payment instructions. The Contractor shall use the following information when submitting payment requests and receiving reports in WAWF for this contract or task or delivery order:
(1) Document type. The Contractor shall submit payment requests using the following document type(s):
(i) For cost-type line items, including labor-hour or time-and-materials, submit a cost voucher.
(ii) For fixed price line items—
(A) That require shipment of a deliverable, submit the invoice and receiving report specified by the Contracting Officer.

52.203-16 Preventing Personal Conflicts of Interest (DEC 2011)
(a) Definitions. As used in this clause--
Acquisition function closely associated with inherently governmental functions means supporting or providing advice or recommendations with regard to the following activities of a Federal agency:
(1) Planning acquisitions.
(2) Determining what supplies or services are to be acquired by the Government, including developing statements of work.
(3) Developing or approving any contractual documents, to include documents defining requirements, incentive plans, and evaluation criteria.
(4) Evaluating contract proposals.
(5) Awarding Government contracts.
(6) Administering contracts (including ordering changes or giving technical direction in contract performance or contract quantities, evaluating contractor performance, and accepting or rejecting contractor products or services).
(7) Terminating contracts.
(8) Determining whether contract costs are reasonable, allocable, and allowable.
Covered employee means an individual who performs an acquisition function closely associated with inherently governmental functions and is--
(1) An employee of the contractor; or
(2) A subcontractor that is a self-employed individual treated as a covered employee of the contractor because there is no employer to whom such an individual could submit the required disclosures.
Non-public information means any Government or third-party information that--
(1) Is exempt from disclosure under the Freedom of Information Act (5 U.S.C. 552) or otherwise protected from disclosure by statute, Executive order, or regulation; or
(2) Has not been disseminated to the general public and the Government has not yet determined whether the information can or will be made available to the public.
Personal conflict of interest means a situation in which a covered employee has a financial interest, personal activity, or relationship that could impair the employee's ability to act impartially and in the best interest of the Government when performing under the contract. (A de minimis interest that would not ``impair the employee's ability to act impartially and in the best interest of the Government'' is not covered under this definition.)
(1) Among the sources of personal conflicts of interest are--
(i) Financial interests of the covered employee, of close family members, or of other members of the covered employee's household;
(ii) Other employment or financial relationships (including seeking or negotiating for prospective employment or business); and
(iii) Gifts, including travel.
(2) For example, financial interests referred to in paragraph (1) of this definition may arise from--
(i) Compensation, including wages, salaries, commissions, professional fees, or fees for business referrals;
(ii) Consulting relationships (including commercial and professional consulting and service arrangements, scientific and technical advisory board memberships, or serving as an expert witness in litigation);
(iii) Services provided in exchange for honorariums or travel expense reimbursements;
(iv) Research funding or other forms of research support;
(v) Investment in the form of stock or bond ownership or partnership interest (excluding diversified mutual fund investments);
(vi) Real estate investments;
(vii) Patents, copyrights, and other intellectual property interests; or
(viii) Business ownership and investment interests.
(b) Requirements. The Contractor shall--
(1) Have procedures in place to screen covered employees for potential personal conflicts of interest, by--
(i) Obtaining and maintaining from each covered employee, when the employee is initially assigned to the task under the contract, a disclosure of interests that might be affected by the task to which the employee has been assigned, as follows:
(A) Financial interests of the covered employee, of close family members, or of other members of the covered employee's household.
(B) Other employment or financial relationships of the covered employee (including seeking or negotiating for prospective employment or business).
(C) Gifts, including travel; and
(ii) Requiring each covered employee to update the disclosure statement whenever the employee's personal or financial circumstances change in such a way that a new personal conflict of interest might occur because of the task the covered employee is performing.
(2) For each covered employee--
(i) Prevent personal conflicts of interest, including not assigning or allowing a covered employee to perform any task under the contract for which the Contractor has identified a personal conflict of interest for the employee that the Contractor or employee cannot satisfactorily prevent or mitigate in consultation with the contracting agency;
(ii) Prohibit use of non-public information accessed through performance of a Government contract for personal gain; and
(iii) Obtain a signed non-disclosure agreement to prohibit disclosure of non-public information accessed through performance of a Government contract.
(3) Inform covered employees of their obligation--
(i) To disclose and prevent personal conflicts of interest;
(ii) Not to use non-public information accessed through performance of a Government contract for personal gain;
and
(iii) To avoid even the appearance of personal conflicts of interest;
(4) Maintain effective oversight to verify compliance with personal conflict-of-interest safeguards;
(5) Take appropriate disciplinary action in the case of covered employees who fail to comply with policies established pursuant to this clause; and
(6) Report to the Contracting Officer any personal conflict-of-interest violation by a covered employee as soon as it is identified. This report shall include a description of the violation and the proposed actions to be taken by the Contractor in response to the violation. Provide follow-up reports of corrective actions taken, as necessary. Personal conflict-of-interest violations include--
(i) Failure by a covered employee to disclose a personal conflict of interest;
(ii) Use by a covered employee of non-public information accessed through performance of a Government contract for personal gain; and
(iii) Failure of a covered employee to comply with the terms of a non-disclosure agreement.
(c) Mitigation or waiver. (1) In exceptional circumstances, if the Contractor cannot satisfactorily prevent a personal conflict of interest as required by paragraph (b)(2)(i) of this clause, the Contractor may submit a request through the Contracting Officer to the Head of the Contracting Activity for--
(i) Agreement to a plan to mitigate the personal conflict of interest; or
(ii) A waiver of the requirement.
(2) The Contractor shall include in the request any proposed mitigation of the personal conflict of interest.
(3) The Contractor shall--
(i) Comply, and require compliance by the covered employee, with any conditions imposed by the Government as necessary to mitigate the personal conflict of interest; or
(ii) Remove the Contractor employee or subcontractor employee from performance of the contract or terminate the applicable subcontract.
(d) Subcontract flowdown. The Contractor shall include the substance of this clause, including this paragraph (d), in subcontracts--
(1) That exceed $150,000; and
(2) In which subcontractor employees will perform acquisition functions closely associated with inherently governmental functions (i.e., instead of performance only by a self-employed individual).
