Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at https://www.dol.gov/agencies/whd/government-contracts.
Note: Executive Order 13658 generally applies to contracts subject to the Davis-Bacon Act that were awarded on or between January 1, 2015 and January 29, 2022, and that have not been renewed or extended on or after January 30, 2022. Executive Order 13658 does not apply to contracts subject only to the Davis-Bacon Related Acts regardless of when they were awarded. If a contract is subject to Executive Order 13658, the contractor must pay all covered workers at least $13.65 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract from May 11, 2026, through December 31, 2026. The applicable Executive Order minimum wage rate will be adjusted annually.
Additional information on contractor requirements and worker protections under Executive Order 13658 is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (iii)).
The body of each wage determination lists the classifications and wage rates that have been found to be prevailing for the type(s) of construction and geographic area covered by the wage determination. The classifications are listed in alphabetical order under rate identifiers indicating whether the particular rate is a union rate (current union negotiated rate), a survey rate, a weighted union average rate, a state adopted rate, or a supplemental classification rate.
Union Rate Identifiers
A four-letter identifier beginning with characters other than SU , UAVG , SA , or SC denotes that a union rate was prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2024. PLUM is an identifier of the union whose collectively bargained rate prevailed in the survey for this classification, which in this example would be Plumbers.
0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. The date, 07/01/2024 in the example, is the effective date of the most current negotiated rate.
Union prevailing wage rates are updated to reflect all changes over time that are reported to WHD in the rates in the collective bargaining agreement (CBA) governing the classification.
Union Average Rate Identifiers
The UAVG identifier indicates that no single rate prevailed for those classifications, but that 100% of the data reported for the classifications reflected union rates. EXAMPLE:
UAVG-OH-0010 01/01/2024. UAVG indicates that the rate is a weighted union average rate. OH indicates the State of Ohio.
The next number, 0010 in the example, is an internal number used in producing the wage determination. The date, 01/01/2024 in the example, indicates the date the wage determination was updated to reflect the most current union average rate.
A UAVG rate will be updated once a year, usually in January, to reflect a weighted average of the current rates in the collective bargaining agreements on which the rate is based.
Survey Rate Identifiers
The SU identifier indicates that either a single non-union rate prevailed (as defined in 29 CFR 1.2) for this classification in the survey or that the rate was derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As a weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SUFL2022-007 6/27/2024. SU indicates the rate is a single non-union prevailing rate or a weighted average of survey data for that classification. FL indicates the State of Florida. 2022 is the year of the survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. The date, 6/27/2024 in the example, indicates the survey completion date for the classifications and rates under that identifier.
SU wage rates typically remain in effect until a new survey is conducted. However, the Wage and Hour Division (WHD) has the discretion to update such rates under 29 CFR 1.6(c)(1).
State Adopted Rate Identifiers
The SA identifier indicates that the classifications and prevailing wage rates set by a state (or local) government were adopted under 29 C.F.R 1.3(g)-(h). Example: SAME2023-007 01/03/2024. SA reflects that the rates are state adopted. ME refers to the State of Maine. 2023 is the year during which the state completed the survey on which the listed classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination.
The date, 01/03/2024 in the example, reflects the date on which the classifications and rates under the SA identifier took effect under state law in the state from which the rates were adopted.

Any exemption claimed and self-certified on the IRS Form W-14 is subject to audit by the IRS. Any disputes regarding the imposition and collection of the 26 U.S.C. 5000C tax are adjudicated by the IRS as the 26 U.S.C. 5000C tax is a tax matter, not a contract issue. (g) A taxpayer may, for a fee, seek advice from the IRS as to the proper tax treatment of a transaction. This is called a private letter ruling. Also, the IRS may publish a revenue ruling, which is an official interpretation by the IRS of the Internal Revenue Code, related statutes, tax treaties, and regulations. A revenue ruling is the conclusion of the IRS on how the law is applied to a specific set of facts. (a) Evaluation Factors for Award
The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Prerequisite Gate: Mandatory Site Visit Attendance (Pass/Fail)
Factor 1: Technical Capability (Pass/Fail Gate)
Factor 2: Past Performance (Pass/Fail Gate)
Factor 3: Price
Relative Importance of Factors: Technical Capability and Past Performance, when combined, are . Because both factors are more important than price evaluated on an basis, they serve as mandatory performance gates.Acceptable/Unacceptable
Operation of Gates and Combined Importance:
First, an offeror must have successfully attended the mandatory site visit on . Any proposal submitted by a vendor who did not attend the site 27 August visit will be rejected without further review.
Second, the offeror must receive a rating of "Acceptable" in both Technical Capability and Past Performance. An outstandingly low price cannot compensate for, nor be traded off against, an "Unacceptable" rating in either non-price factor.
Award will be made to the responsible, eligible offeror who attended the mandatory site visit, meets the minimum "Acceptable" standard for both non-price factors, and offers the lowest evaluated reasonable price.
(b) Evaluation Methodology and Ratings
FACTOR 1: TECHNICAL CAPABILITY (Acceptable / Unacceptable)
The Technical Capability factor evaluates the offeror's capability to successfully perform the services in accordance with the SOW. This factor consists of three (3) subfactors, all of which must be determined "Acceptable" to receive an overall Technical Capability rating of "Acceptable."
Subfactor A: Compliance with SOW Objectives #1 to #6. Evaluates the technical approach to verify the vendor has a viable, standard commercial method to clean cracks, apply hot crack filler to approximately 8,000 linear feet, apply a high-quality coal tar emulsion seal coat to approximately 130,000 square feet, stripe approximately 430 stalls, replace/reposition concrete parking blocks, install 9 handicap signs, and black out 3 motorcycle spots.
Subfactor B: Construction Phasing Plan and Schedule. Evaluates the draft Construction Phasing Plan to verify that the proposed schedule fits within the 120-day Period of Performance, maintains emergency access, and guarantees that at least fifty percent (50%) of the parking capacity remains fully operational at all times.
Subfactor C: Security and Access Logistics. Evaluates the proposal to ensure the offeror has demonstrated a complete understanding of, and commitment to, the MCB Camp Lejeune base access regulations (NCIC vetting) and MARSOC escort requirements.
Technical Capability Ratings:
Rating Definition
Accepta ble
The proposal meets the minimum requirements of the solicitation, demonstrates a clear understanding of the SOW, and presents a low-risk approach to successful performance.
Unaccep table
The proposal fails to meet the minimum requirements of the solicitation, fails to demonstrate a clear understanding of the SOW, or presents an unacceptably high risk to successful performance.
3.
1.
2.
3.
FACTOR 2: PAST PERFORMANCE (Acceptable / Unacceptable)
To ensure the Government selects a highly skilled and reliable contractor while keeping the evaluation straightforward and fair for an under-SAT requirement, Past Performance is evaluated on a binary basis using simple, objective metrics. CPARS records are not required.Acceptable/Unacceptable
Recency: Completed within the past three (3) years from the solicitation release date.
Relevancy: Defined as asphalt maintenance, seal coating, crack filling, and pavement striping projects of a similar nature (exceeding 50,000 square feet) executed on commercial, public, or military installations.
To receive an rating, the offeror's past performance record must meet the following objective, multi-point standard. If any of the following standards are Acceptable not met, the offeror shall be rated (unless a Neutral rating applies):Unacceptable
Successful Completion of similar Scope: The offeror must submit at least two (2) recent and relevant references proving successful performance on projects of similar scope (greater than 50,000 square feet).
Quality and Timeliness: Direct telephone/email reference checks conducted by the Government must confirm that the contractor's performance was satisfactory, and that the client would hire the contractor again.
No Active Performance Risks: The offeror must have documented terminations for default, active unresolved performance disputes, or zero (0) assessment of liquidated damages on any contract within the past three (3) years.
Past Performance Ratings:
Ratin g
Definition
Acce ptabl e
Based on the offeror's performance record, the Government has a high, reasonable expectation that the offeror will successfully perform the required effort. This rating is given to vendors who meet all past performance objective standards listed above, or who possess a neutral rating.
Unac cept able
Based on the offeror's performance record, the Government does not have a reasonable expectation that the offeror will successfully perform the required effort. This rating is given to vendors who fail to meet one or more of the objective past performance standards listed above.
Note on Neutral Ratings: An offeror without a record of relevant past performance, or for whom information on past performance is not available, will not be evaluated favorably or unfavorably on past performance and, as a result, will receive an "Acceptable" (Neutral) rating.
FACTOR 3: PRICE
The Government will evaluate the proposed prices for mathematical accuracy and completeness. Proposed price breakdowns will be analyzed to determine price reasonableness.
Price reasonableness will be established by comparing proposed prices against:
Competitive quotes received in response to this solicitation.
The Independent Government Cost Estimate (IGCE).
Historical contract awards for similar asphalt maintenance services.
Unbalanced or unrealistically low pricing may be grounds for eliminating a proposal from consideration if the Government determines that the low price represents an unacceptable risk to performance or indicates a lack of technical understanding.
(c) Basis for Award
The Government intends to award a single, Firm-Fixed-Price contract to the responsible offeror who submits a proposal that is conforming to the solicitation, attended the mandatory site visit, achieves a rating of in Factor 1 (Technical Capability) and Factor 2 (Past Performance), and offers the lowest "Acceptable" evaluated reasonable price.
