DIGNITY CLAUSE
Respect for Headstones and Markers in National Cemeteries, Handling of Markers and Headstones
1. Every action by contractor personnel at a national cemetery must be performed with the special care, reverence, dignity, and respect that acknowledges the cemetery as the final resting place that commemorates the service and sacrifice that service members, Veterans and their families made for our Nation. Critically important is the awareness required of the Contractor employees of the remains buried in the grounds where the work is performed. The utmost care must be given to these remains and the headstones and flat grave markers that mark those gravesites and memorialize the service of individuals.
a. Contractors cannot walk, stand, lean, sit or jump on headstones or markers. Nor can they drive over them.
b. No tools, equipment or other items will be placed or leaned on headstones or markers.
c. Use care not to scratch or damage markers in any manner.
d. Contractor shall be responsible for replacing damaged headstones and markers and for restoring turf damaged during performance of this work.
e. Additionally, should any activity result in the exposure and/or damage to any remains, container for remains (e.g., casket or urn), or outer burial container, the contractor must contact the COR, Director/Assistant Director, or Contracting Officer (CO) for guidance.
2. Any doubts as to proper procedures shall be brought to the attention of the COR, Director/Assistant Director, or CO for guidance or resolution. While the COR and/or Cemetery
Director may give guidance regarding the dignity clause, compliance, and performance, only the
CO can authorize changes to the contract terms and conditions.
3. The contractor is required to discuss the guidance with employees and/or subcontractors and have each employee sign a statement of compliance and deliver the signed statement to the
COR before work may begin.

PERFORMANCE WORK STATEMENT
Grounds Maintenance – Bakersfield National Cemetery
Document Number: 36C78624R50297 PROCESSED Page 29 of 176
1. GENERAL INFORMATION:
Description of Service: This requirement is a non-personal services contract in which the contractor shall provide all personnel, materials, equipment, and maintenance necessary to ensure that grounds maintenance and improvement services are performed at Bakersfield National Cemetery (BNC) located in Arvin, California. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such service providers shall be accountable solely to the Contractor who, in turn, is responsible to the Government.
1.1 Background: The Department of Veterans Affairs, National Cemetery Administration, honors
Veterans with a final resting place and lasting memorials that commemorate their service to our nation. There are approximately 155 National Cemeteries in 41 states that receive visitors, hold ceremonies and conduct committal services on an ongoing basis. Because of the special significance and attention our National Cemeteries receive from the public, strict adherence to specifications is essential.
Set in a beautiful, natural landscape, Bakersfield National Cemetery in the White Wolf area of the Tehachapi Mountains is nestled in oak savanna, amidst wide-open stretches, mountain vistas and rolling grazing land where both cattle and camels once roamed. Dating to the days of the land grants when California was still part of Mexico, the land has hosted vaqueros and cowboys, as well as the short-lived U.S. Army Camel Corps that was based in nearby Fort Tejon from 1857 to 1863.
The cemetery land was originally part of a Mexican grant that dates to November 24, 1843, when Mexican Governor Manuel Micheltorena gave the land to the original owners, Jose
Antonio Aguirre and Ignacio del Valle. They called the property Rancho El Tejon.
In the 1850s and 1860s, General Edward Fitzgerald Beale, hero of the Battle of San Pasqual and former superintendent of Indian affairs and surveyor-general of California, purchased Rancho El
Tejón and three other land grants and assembled them into what he called the Rancho El Tejón, now known simply as Tejon Ranch. Rancho El Tejón was the largest of the four land grants. The
White Wolf area, where the cemetery is located, was historically used for grazing and that practice continues today. It was so named because of the packs of white wolves that roamed the area. The vaqueros reported seeing them as late as 1875.
Through the National Cemetery Expansion Act of 2003, Congress authorized the addition of six new national cemeteries, including one in the Bakersfield area. The Tejon Ranch Company, which owns the largest contiguous tract of private property in California—between Los Angeles and Bakersfield—quickly offered to donate land for use as a cemetery. It offered a choice of several locations in the White Wolf area and the National Cemetery Administration chose the
500-acre site located just south of Highway 58 and west of Highway 223. The cemetery is surrounded by the 422-square-mile Tejon Ranch.
Document Number: 36C78624R50297 PROCESSED Page 30 of 176
The final transfer of land took place in 2008. The first interment of cremated remains occurred on July 1, 2009, and the first casketed interment the following day.
