Evaluation Factors for Award
Miscellaneous text in this section has been modified to:
ADDENDUM TO FAR 52.212-2 EVALUATION--COMMERCIAL ITEMS (NOV2021)
Paragraph (a) is hereby replaced with the following:
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and non-price factors considered. The following factor(s) shall be used to evaluate offers in order of priority:
(1) Past Experience
(2) Price
Past experience will be evaluated on a basis of being important than price. An assessment will be made to determine the best-value significantly more to the Government using a pre-determined, weighted scoring system assigning an Adjectival Rating accordingly (Table 1. Past Experience Assessment Rating Method). The trade-off between past experience and price could result in awarding to other than the lowest offeror. However, price could become the determining factor if two or more quotes are determined to be essentially equal otherwise., Award may be made without discussions with offerors (except communications conducted for the purpose of minor clarification). Therefore, each initial offer should contain the offeror's best terms from a past experience and price standpoint. However, the Government reserves the right to conduct discussions if it is later determined by the contracting officer to be necessary.
Factor 1. Past Experience
Past Experience will be used to determine the degree of acceptability of the offeror to perform the requirement of this procurement.
In the case of offerors for which there is no information on past experience, the offeror may not be evaluated favorably or unfavorably on the factor of past experience. In this case, the offeror's past experience is unknown and assigned a rating of "neutral." Although an offeror with no recent and/or relevant past experience may not be rated favorably or unfavorably, the Government reserves the right to determine that a "Good" rating is worth more than a "Neutral" past experience rating in a best value tradeoff.
Note: A rating of at least "Neutral" must be received on the assessment to be considered for award.
Table 1. Past Experience Assessment Rating Method
Adj ecti val Rati ng
Description
Outs tand ing
Past experience proves successful completion of three or more projects related to fire suppression and inspections within the last three years and no unfavorable information for either the offeror or its partner companies, joint ventures, and/or subsidiaries.
Goo d
Past experience proves successful completion of three or more projects related to fire suppression and inspections within the last three years and one instance of unfavorable information for either the offeror or its partner companies, joint ventures, and/or subsidiaries with a provided explanation of satisfactory corrective action taken.
Neu tral
No past experience or unfavorable information for either the offeror or its partner company(s), joint ventures, and/or subsidiaries.
Una ccep tabl e
Offeror has more than one instance of unfavorable information for either the offeror or its partner company(s), joint ventures, and/or subsidiaries. Or offeror has at least one instance of unfavorable information in which no corrective action was taken or failed to provide explanation of corrective action taken.
Factor 2. Price.
Price Analysis will be conducted. Quotes will be evaluated for price fairness and reasonableness. The proposed price will be evaluated using the total evaluated price (TEP) on the bottom-line price for the entire effort, inclusive of all option years. A price is reasonable if, in its nature and amount, it does not exceed that which would be incurred by a prudent person in the conduct of competitive business. The Government may use various price analysis techniques and procedures to ensure a fair and reasonable price. Some of those techniques are, but not limited to, comparison of proposed prices received in response to the solicitation and/or comparison of proposed prices with the Independent Government Estimate. Price must be determined fair and reasonable. No additional information from the offeror will be required if the price is based on adequate price competition. In the event adequate price competition does not exist, the contracting officer will obtain information from the offeror to the extent required to determine the reasonableness of the offered prices.
As part of the price evaluation, the Government will evaluate the Option to Extend Services under FAR Clause 52.217-8 by adding one-half of the offerors final option period prices to the offeror's total price. Thus, the offeror's total price for the purpose of evaluation will include the base period and all option periods. Offerors are required only to price the base and option periods. Offerors shall not submit a price for the potential extension of services period.
(b) Award will be made to the responsible offeror whose quote conforms to the instructions and is deemed the best value to the Government. Award may be made without discussions with offerors (except communications conducted for the purpose of minor clarification). Therefore, each initial offer should contain the offeror's best terms from a past experience and price standpoint. However, the Government reserves the right to conduct discussions if it is later determined by the contracting officer to be necessary.
(c) Options. If applicable, the Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
