(D) Have □, have not □, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds the threshold at 9.104-5(a)(2) for which the liability remains unsatisfied. Federal taxes are considered delinquent if both of the following criteria apply:
(1) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if a pending administrative or judicial challenge remains. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the Government will consider the certification in connection with a determination of the Offeror's responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.
(d) This provision does not require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a). The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.
(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If the Government later determines that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.

SECTION F - INSTRUCTIONS, CONDITIONS, AND NOTICE TO QUOTERS
EVALUATION (IHS SUPPLEMENTAL GUIDANCE)
(Supplementing FAR 52.212-2 and FAR 12.203)
Evaluation will be conducted in accordance with FAR Part 12 and FAR 52.212-2 using a comparative, best-value tradeoff evaluation.
Quotes shall be organized into three (3) volumes, plus required forms, as follows:
Volume 1 – Technical Qualifications Include the following:
• Quoter Name
• UEI Number
• Point of Contact (name, phone, email)
• A description demonstrating the quoter’s capability to perform all requirements in the Performance Work
Statement (PWS)
• Copies of current licenses, certifications, and other credentials necessary to perform the required services
Evaluation Elements:
In evaluating Technical Qualifications, the Government will consider, at a minimum, the following:
• Technical Approach
• Ability to perform all deliverables and tasks outlined in the Performance Work Statement (PWS)
• Demonstrated experience with asbestos abatement, door and frame removal and installation, accessibility hardware installation, and refinishing work to meet historic preservation requirements.
The Government will assess strengths, weaknesses, and any risks associated with the quotation and determine the level of confidence in successful performance.
Volume 2 – Past Performance Past Performance will be evaluated based on the recency and relevance of prior contracts of similar scope and complexity.
• Recency: Contracts performed within the last 5 years
• Relevance: Similar scope and complexity in healthcare construction and facility renovation https://www.hhs.gov/policies/hhsar/subpart352.html
Project Title Building 22 Exterior Door Replacement - ASU
Provide up to five (5) recent and relevant contracts or jobs of similar scope. Include:
• Customer/organization
• Location
• Dates of performance
• Description of work
• Contract value (if available)

• Past performance information already known to the Government
Volume 3 – Price Price will be evaluated for reasonableness, completeness, and balance using the unit prices submitted in the Pricing Table.
For evaluation purposes:
• The evaluated price will include the total price for the base period and all option periods.
• The Government may evaluate pricing for unbalanced pricing, including materially unbalanced unit prices or option period pricing.
• Prices shall be valid for at least 90 calendar days from the date of the quote submission.
The Government may consider whether the quoter’s pricing is consistent with the proposed technical approach and whether pricing presents a risk to successful performance.
The Government may reject any quotation with pricing that is incomplete, unbalanced, or inconsistent with the quotation’s technical approach.
Additional Required Documents
• Signed SF-1449 (first page only is acceptable).
• Signed IHS Buy Indian Act Indian Economic Enterprise Representation Form (IEE Form).
• Signed and acknowledged amendments, if any.
Award Decision Award will be made to the responsible quoter whose quotation conforming to the solicitation is determined to be most advantageous to the Government, price and other factors considered.
Technical Capability and Past Performance, when combined, are more important than Price. However, as quotations become more equal under the non-price factors, Price may become the determining factor for award.
The Government will perform a comparative evaluation of quotations and may select a higher-priced quotation if it is determined that the additional technical merit and/or past performance value warrants the additional cost.
The Government intends to award without discussions but reserves the right to conduct communications if determined to be in the Government’s best interest. The Government may conduct clarifications as necessary.
