DESCRIPTION OF REQUIREMENTS: The Bureau of Land Management, Butte Field Office is seeking the furnishing, delivery, and installation of a courtesy floating boat dock. The courtesy dock shall be designed for removal from the water in the winter. The prefabricated courtesy dock system shall consist of two, 20-foot-long by 6-foot-3-inch-wide sections. One section shall attach to a 6-foot-3-inch-wide concrete abutment utilizing the existing hinge system that allows for vertical movement. The hinge system will be designed to be taken apart as the dock will need to be easily detached from the abutment each year. The contractor shall provide instructions/drawings on how to connect the hinge system to current concrete abutment. The courtesy dock system shall be designed utilizing a galvanized steel frame. Delivery will be to the Devil’s Elbow Recreation Site near Helena, MT in Lewis and Clark County.

INFORMATION TO PROSPECTIVE OFFERORS

The Bureau of Land Management (BLM), Montana/Dakotas State Office, has a need for the furnishing, delivery, and installation of a courtesy floating boat dock. The courtesy dock shall be designed for removal from the water in the winter. The prefabricated courtesy dock system shall consist of two, 20-foot-long by 6-foot-3-inch-wide sections. One section shall attach to a 6-foot-3-inch-wide concrete abutment utilizing the existing hinge system that allows for vertical movement. (i) This is a combined Synopsis/Solicitation for commercial items prepared in accordance with the format in FAR Subpart

12.6 and 13.5 Simplified Acquisition Procedures, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested, and a written solicitation will not be issued.

Firm, fixed-price quotes are requested under Request for Quotation (RFQ) Solicitation number 140L3625Q0092.

(ii) Solicitation Number 140L3625Q0092 is being issued as a Request for Quote (RFQ). This solicitation will utilize the policies contained in FAR Part 12, Acquisition of Commercial Items in conjunction with the policies and procedures for solicitation evaluation and award prescribed in FAR Part 13, Simplified Acquisition Procedures, as appropriate for this acquisition.

(iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2025-05 effective 7 August 2025.

(iv) This solicitation is being issued as a competitive small business set-aside. The North American Industry Classification System (NAICS) code associated with this solicitation is 332999, All Other Miscellaneous Fabricated Metal Product Manufacturing, with a size standard of 750 employees.

(v) See the attached Statement of Work (SOW) for detailed requirements.

(vi) The supplies and services to be acquired through this combined synopsis/solicitation are for Devil’s Elbow Recreation Site in accordance with the SOW and corresponding attachments.

(vii) Delivery location is detailed in the attached SOW for the requirement, Delivery must be made between 23 March 2026 and 15 April 2026.

(viii) FAR Provision 52.212-1, Instructions to Offerors – Commercial, applies to this acquisition. Potential offerors shall read and comply with all terms and conditions, see Addendum FAR 52.212-1 – Instructions to Offerors – Commercial Items for additional instructions.

(ix) FAR 52.212-2, Evaluation – Commercial Items, applies to this acquisition, see Provisions for detailed evaluation criteria. The basis of award will be based on one technical factor and price.

(x) Offerors shall ensure that their Representations and Certifications are up to date in the System for Award Management (SAM) which can be accessed through https://www.sam.gov. Offerors shall ensure that this acquisition’s NAICS Code of 332999 is listed in FAR 52.212-3, Offeror Representations and Certifications – Commercial Items.

TECHNICAL

(a) The contractor shall provide detailed information the clearly state that it meets all the items described in Attachment 1 – SOW and provide the plan and profile drawings of docking system. Also, the offeror needs to provide manufacturer’s descriptive data.

(b) The contractor shall complete Section 11 (Schedule) of the SF18 with the total price. Additionally, the offeror will also complete Attachment 4 – Price Schedule.

52.212-2 Evaluation - Commercial Products and Commercial Services NOV 2021

PRICE AND TECHNICAL

(a) Basis for Contract Award - Award will be made to the responsible firm whose quote is most advantageous to the Government, price and other factors considered. Other factors for this solicitation include technical capability of the quoter.

The following factors shall be used to evaluate offers:

PRICE AND TECHNICAL

A. Price Evaluation. Initially, offers will be ranked according to price. An offeror’s proposed price will be determined by the total price detailed in Section 11 of the SF18.

Starting from the lowest priced quote, the Government will start by evaluating the technical capability of the item offered to meet the

Government’s need. If the lowest priced offer is judged to be technically capable, then that offer represents the best value for the government and the evaluation process stops at this point. Award shall be made to that offeror without further consideration of any other quote.

If the lowest priced offeror is judged not technically capable to meet the Government’s need, the next lowest priced offeror will be evaluated, and the process will continue (in order by price) until an offeror is evaluated to be technically capable or until all offerors are evaluated.

If no offeror is deemed technically capable. An award may or may not be made, depending on the offeror that represents the best value to the Government.

B. Technical Capability. Technical capability will be evaluated by how well the proposed product meet the Government’s need. The Government’s need is detailed in Attachment 1 – SOW.

The offeror’s quote shall receive one of the following ratings:

Rating Description Acceptable The technical capability offered meets the Government’s need.

Unacceptable The technical capability offered does not meet the Government’s need or the offeror did not provide sufficient data to evaluate.

PRICING

(a) The Government will evaluate offers for award purposes by using the proposed price.

(b) Reasonableness. Techniques and procedures described under FAR 13.106(a), Price Analysis, will be the primary means of assessing quote reasonableness. The evaluation techniques described under FAR 13.106(a)(2), as determined appropriate, may also be performed in further determining the reasonableness of the quote. For a price to be reasonable, it must represent a price to the Government that a prudent person would pay in the conduct of competitive business. Normally, price reasonableness is established through competitive quotations described in FAR 13.106(a)(1). For additional information, see FAR 31.201-3, Determining Reasonableness.

(c) Affordability: An affordability assessment will consider if the proposed price is within the Government’s funding profile.

Unaffordable quotes will not be considered for award.

SECTION 2 – CLAUSES

Special Flotation Warranty (Pontoons):

The Contractor shall, in addition to any standard commercial warranty, provide a Special Flotation Warranty covering the dock’s pontoons as follows: The Contractor shall replace any pontoon that cracks or deteriorates from normal use for a period of two (2) years following the date of final acceptance. Damage caused by collision of the pontoons with submerged objects, boat propellers, or floating debris is excluded from this warranty. Replacement of any warranted pontoon shall be completed within 30 calendar days of written notice by the Contracting Officer. Replacement shall be at no additional cost to the Government and shall include all necessary parts, labor, and transportation. Replacement does not reduce the remaining two-year coverage; the replacement pontoon shall be warranted for the remaining warranty term or ninety (90) days, whichever is greater.

Payment requests must be submitted electronically through the U. S. Department of the Treasury’s Invoice Processing Platform System (IPP). “Payment request” means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions – Commercial Items included in commercial item contracts. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

3. Billing period specified with beginning and ending dates. The beginning date must not be later than the completion date or within any previous billing dates.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 – 5 business days of the contract award date. If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

DIAR 1452.201-70 Authorities and Delegations – (Sep 2011)

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer’s Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor’s performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

1. Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

2. Waive or agree to modification of the delivery schedule;

3. Make any final decision on any contract matter subject to the Disputes Clause;

4. Terminate, for any reason, the Contractor’s right to proceed;

5. Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR’s appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph I prior to receipt of the Contracting Officer’s response issued under paragraph I of this clause.

I the Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor’s risk.

(d)Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records- Negotiation.

(1)The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2)The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3)As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) (1)Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause- (i)52.203-13, Contractor Code of Business Ethics and Conduct (Nov 2021) (41 U.S.C. 3509).
