INFORMATION TO PROSPECTIVE OFFERORS

The Bureau of Land Management (BLM) in California has recently completed construction of a new fire station building within the existing interagency fire station facility in Doyle, CA. The BLM is looking for a fencing contractor to replace portions of the existing damaged or inadequate chain-link perimeter fencing/gate around the facility site. The new chain-link perimeter fencing shall fix the deficiencies of the existing fencing and provide enhanced security for the facility.

This is a Combined Synopsis/Solicitation for commercial items prepared in accordance with the format in FAR Subpart

12 - Acquisition of Commercial Products and Commercial Services, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; as overhauled and supplemented with additional information included in this notice. Firm, fixed-price quotes are requested under Request for Quotation (RFQ)

Solicitation number 140L1226Q0036.

This document incorporates provisions and clauses which are in effect through Federal Acquisition Regulations 2026-01.

This solicitation is set-aside for small business under North American Industry Classification System (NAICS) code

238990 for All Other Specialty Trade Contractors. The Small Business Annual Receipts for the preceding three (3) fiscal years does not exceed $15.0 Million.

This RFQ encompasses both Revolutionary FAR Overhaul (RFO, FAR Overhaul - FAR Part Deviation Guidance |

Acquisition.GOV) and Federal Acquisition Regulations (FAR, FAR | Acquisition.GOV). The purpose of the RFO is to amend the FAR to ensure that it contains only provisions that are required by statute or that are otherwise necessary to support simplicity and usability, strengthen the efficacy of the procurement system, or protect economic or national security interests (E.O. 14275).

DOI-AAAP-0028 Electronic Invoicing and Payment Requirements - Invoice Processing Platform (IPP) (February 2021)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform

System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor

1452.201-70 Authorities and Delegations - (Sep 2011)

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

1. Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

2. Waive or agree to modification of the delivery schedule;

3. Make any final decision on any contract matter subject to the Disputes Clause;

4. Terminate, for any reason, the Contractor's right to proceed;

5. Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of

9 | P a g e the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any

Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

RFO 52.222-90 Addressing DEI Discrimination by Federal Contractors (APR 2026) (DEVIATION APR 2026)

(a) Definitions. As used in this clause

Program participation means membership or participation in, or access or admission to: training, mentoring, or leadership development programs; educational opportunities; clubs; associations; or similar opportunities that are sponsored or established by the contractor or subcontractor.

Racially discriminatory diversity, equity, and inclusion (DEI) activities means disparate treatment based on race or ethnicity in the recruitment, employment (e.g., hiring, promotions), contracting (e.g., vendor agreements), program participation, or allocation or deployment of an entity's resources.

(b) In connection with the performance of work under this contract, the Contractor agrees as follows:

(1) The Contractor will not engage in any racially discriminatory DEI activities;

(2) The Contractor will furnish all information and reports, including providing access to books, records, and accounts, as required by the Contracting Officer, for purposes of ascertaining compliance with this clause;

(3) In the event of the Contractor's or a subcontractor's noncompliance with this clause, this contract may be canceled, terminated, or suspended in whole or in part, and the Contractor or subcontractor may be declared ineligible for further Government contracts;

(4) The Contractor will report any subcontractor's known or reasonably knowable conduct that may violate this clause to the

Contracting Officer and take any appropriate remedial actions directed by the Contracting Officer; and

(5) The Contractor will inform the Contracting Officer if a subcontractor sues the Contractor and the suit puts at issue, in any way, the validity of this clause.

(a) The Contractor, at the Contractor’s expense, agrees to maintain, during the continuance of this contract, vehicular liability and general public liability insurance with limits of liability for-

SECTION 4 - PROVISIONS

PROVISIONS INCORPORATED BY FULL TEXT

RFO 52.212-1 Instructions to Offerors—Commercial Products and Commercial Services. (MAR 2026)

(a) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. As a minimum, offers shall include—

(1) The solicitation number;

(2) The name, address, telephone number of the Offeror;

(3) The Offeror’s Unique Entity Identifier (UEI) and, if applicable, Electronic Funds Transfer (EFT) indicator;

(4) Information necessary to evaluate the factors contained in the provision at 52.212-2 or as described in the solicitation;

(5) Responses to provisions that require Offeror completion of information, representations, and certifications (other than those collected via the System for Award Management (SAM)); and

(6) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and any solicitation amendments.

Offerors must submit an acceptable Bid Guarantee (SF 24 Bid Bond or acceptable alternative per FAR 52.228-1) in the amount of 20% of the total proposed price along with their offer by the solicitation closing date and time specified in Block

13a of the SF 1442. Quotes received without a valid bid guarantee will be determined non-responsive and excluded from evaluation.

(b) Period for acceptance of offers. The Offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(c) Late submissions, modifications, revisions, and withdrawals of offers.

(1) Offerors are responsible for submitting offers and any modifications or revisions to the Government office designated in the solicitation by the time specified in the solicitation.

(2) Any offer, modification, or revision received after the time specified for receipt of offers is “late” and will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition. However, a late modification of an otherwise successful offer that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.

(3) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the

Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(4) Offerors may withdraw their offers by written notice to the Government received at any time before award.

(d) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with Offerors. Therefore, the Offeror’s initial offer should contain the Offeror’s best terms. However, the Government reserves the right to conduct discussions, if necessary. The Government may reject any or all offers if such action is in the public interest, accept other than the lowest offer, and waive informalities and minor irregularities in offers received.

(e) Debriefings. If a postaward debriefing is given to requesting Offerors, the Government will disclose the following information, if applicable:

(1) The agency’s evaluation of the significant weak or deficient factors in the debriefed Offeror’s offer.

(2) The overall evaluated cost or price and technical rating of the successful Offeror and the debriefed Offeror and past performance information on the debriefed Offeror.

(3) The overall ranking of all Offerors when any ranking was developed by the agency during source selection.

(4) A summary of the rationale for award.

(5) For acquisitions of commercial products, the make and model of the product to be delivered by the successful Offeror.

(6) Reasonable responses to relevant questions posed by the debriefed Offeror as to whether the agency followed source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities.

RFO 52.212-2 Evaluation - Commercial Products and Commercial Services (MAR 2026)

(a) Evaluation Process & Factors

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, evaluation will be based on lowest price technically acceptable

(LPTA) services in accordance with all the requirements and specifications.

To streamline the evaluation process in accordance with FAR 12.203 and RFO principles, the Government will utilize a Sequential

Evaluation Procedure:

[Phase 1: Price & Initial Screening] ➔ [Phase 2: Bid Bond & Pass/Fail Technical Criteria] ➔ [Award Determination]

PHASE 1: PRICE & RESPONSIVENESS SCREENING

1. Price Ranking & Mathematical Accuracy:

o All submitted Quote/Pricing Schedules will be ranked by overall proposed price from lowest to highest.

o Quotes will be assessed for mathematical accuracy, completeness across all Schedule line items, and overall price reasonableness in accordance with FAR 12.203.

2. Sequential Order:

o The Government will evaluate Phase 2 (Technical Acceptability and Bid Bond) beginning only with the lowest-priced quote.

o If the lowest-priced quote is determined to be technically acceptable and compliant, evaluation will cease, and award will be made to that offeror without evaluating remaining, higher-priced quotes.

o If the lowest-priced quote is found technically unacceptable or non-responsive, the Government will proceed sequentially to evaluate the next lowest-priced quote until an acceptable offer is determined.

PHASE 2: TECHNICAL ACCEPTABILITY (PASS / FAIL)

The Government will evaluate the offeror’s technical submittals on a Pass/Fail (Acceptable / Unacceptable) basis. To be determined technically acceptable, the offeror must submit a Work Plan and Schedule satisfying all of the following criteria:

1. Licensing & Qualifications:

o Active California contractor's license appropriate for commercial chain-link fence construction.

2. Work Plan & Technical Execution Strategy:

o Demolition & Off-Site Disposal: A clear approach for removing and properly disposing of ~1,377 feet of damaged/inadequate chain-link fencing and concrete footings off-site.

o Fence & Gate Installation: Execution plan for installing replacement 6 ft galvanized steel chain-link fencing, 3-strand outward-angled barbed wire, manual rolling gate (east perimeter), and concrete footings matching the height, material, and configuration of adjacent existing perimeter fencing to remain.

o Vegetation Management: A plan for trimming or removing designated trees along the north perimeter fence line to eliminate interference and trespass risks without causing unapproved ground disturbance.

3. Operational Continuity & Site Safety:

o Demonstrated capability to execute work during regular business hours (7:00 AM – 6:00 PM, Mon–Fri) without disrupting active wildland fire operations or concurrent building/gate security system installation work.

o Approach for maintaining site security and public safety (barricades, signage per MUTCD, securing work zones daily).

4. Schedule Realism:

o A project schedule demonstrating ability to initiate a virtual scoping meeting and submit a schedule within 14 calendar days of award, begin work within 30 days of NTP/schedule approval, and complete all work within the mandatory 90-calendar-day Period of Performance.

5. Required Management Plans (Commitment):

o Written commitment or draft outlines demonstrating capability to provide an acceptable Contractor Quality Control

(CQC) Plan, Site Safety Plan, and environmental compliance plans (SPCC / SWPPP) prior to the preconstruction meeting.

MANDATORY RESPONSIBILITY & SUBMISSION CHECKS

• Bid Guarantee: Submission of an acceptable Bid Guarantee (SF 24 Bid Bond or acceptable alternative) equal to 20% of the total proposed price (Section 4, RFO 52.212-1 and FAR 52.228-1). Quotes received without a valid bid guarantee will be rejected as non-responsive.

• SAM Registration: Active, verified registration in SAM.gov with no active exclusions.

(b) Procedures and Communications

In accordance with FAR 12.203, the Contracting Officer reserves the right to communicate with any, all, or none of the offerors regarding technical or pricing details. The Contracting Officer may request revised quotations or clarifications from a single offeror being evaluated in sequence without being required to hold formal discussions, establish a competitive range, or seek revisions from other offerors.

(c) Late Submissions

Per FAR 12.203(c)(1), the Contracting Officer reserves the right to exercise good business judgment in deciding whether or not to accept a quotation or modification received after the exact closing date and time specified in this solicitation.

(d) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(e) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.228-1 BID GUARANTEE (September 1996)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier’s check, irrevocable letter of credit, or, under

Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds --

(1) To unsuccessful bidders as soon as practicable after the opening of bids; and

(2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.

(c) The amount of the bid guarantee shall be 20% of the bid price or $3 million, whichever is less

d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.)

FAR 52.216-1 Type of Contract (APR 1984)

The Government contemplates award of a Firm Fixed Price contract resulting from this solicitation.
