Content Requirements
The Government will issue an order on the basis of the best value of proposals meeting or exceeding the acceptability standards for non-cost factors in accordance with FAR 12.203(c)(2).
-Factor 1 – Past Performance -Factor 2 - Price
Factor 1 – Past Performance is more important than Factor 2 - Price.
Offeror's shall identify past or current contracts (including Federal, State, and local Government and/or commercial) for efforts similar to the requirement of this solicitation. The Government may consider this information, as well as information obtained from any other sources, when evaluating the vendor’s past performance.
Offeror's lacking relevant past performance history, or for whom past performance information is either not available or has not been submitted to the Government, will receive a neutral rating for past performance.
A neutral rating will not be evaluated favorably or unfavorably. However, the submission with no relevant past performance history, while rated neutral in past performance, may not represent the most advantageous submission to the Government and thus, may be an unsuccessful submission when compared to the submissions of other Vendors having an satisfactory (or better) past performance.
The Offeror shall limit this information to no more than two (2) contracts performed within the last 3 years, each listed separately.
The Past Performance Questionnaire Form is provided for Offerors to submit the information requested in this document for each Past Performance record submitted.
The Government will use its discretion to determine the sources of past performance information used in the evaluation, and the information may be obtained from references provided by the Offeror, the agency’s knowledge of Offeror performance, other government agencies or commercial entities, or past performance databases, and will be based on responsiveness, quality, and customer services.
Offerors lacking relevant past performance history, or for whom past performance information is either not available or has not been submitted to the Government, will receive a neutral rating for past performance. A good past performance rating provides higher confidence than a neutral or satisfactory rating.
**It is the responsibility of the Offeror to verify CPARS data is correct when the CPARS check box is marked and/or to ensure references intend to respond by utilizing the Past Performance Questionnaire by the closing date of the solicitation.

(End of provision)
2. Update RFO 52.212-1 Evaluation-Commercial Products and Commercial Services. (NOV 2021) (Deviation JAN 2026)
FROM:
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
The Government intends to award a single Firm-Fixed Price Contract as a result of this solicitation, in accordance with FAR 16.505, to the Offeror whose quote represents the best value to the Government, price and other factors considered. The Government intends to evaluate the quotes and award a Contract based on the Offeror’s initial quote; therefore, the Offeror’s initial quote should contain the Offeror's best terms from a Past Performance and Price standpoint. The Government reserves the right to award a Contract without exchanges, or award a Contract after exchanges, whichever is in the best interest of the Government.
The quotes will be evaluated on the criteria listed below:
Volume 1: Non-Price Business Solution Factor 1 - Past Performance Factor 2 - Price
As quotes become more equal under the non-price factors, price as an evaluation factor becomes increasingly more important. The degree of importance of price will increase with the degree of equality of the Quotes in relation to the other factors on which selection is to be based.
Evaluations will be based solely on the materials included in the quotes. Therefore, the Offeror’s initial quote should contain the Offeror’s best terms. After receipt of quotes, the Government will conduct an evaluation. However, during the evaluation process, the Government may, solely at its discretion, communicate with Offerors regarding clarification of quote elements. At any time prior to selection, including upon receipt of quotes, the Government may exclude a quote from further consideration for any material failure to follow instructions, including the omission of required information, or when the Offeror is no longer considered to be among the most highly rated Offerors being considered for award.
The quotes will be evaluated on the criteria listed below:
Factor 1 - Past Performance
The Offeror’s past performance on relevant contracts will be evaluated to determine, as appropriate, successful performance of contract requirements, quality and timeliness of delivery of goods and services, level of communication between the contracting parties, proactive management, and customer satisfaction. The Government will use its discretion to determine the sources of past performance information used in the evaluation, and the information may be obtained from references provided by the Offeror, the agency’s knowledge of contractor performance, other Government agencies or commercial entities, or past performance databases. If a Offeror does not have a history of relevant contract experience, or if past performance information is not available, the Offeror will receive a neutral past performance rating.
Factor 2 - Price
The offeror’s price shall represent its best value in response to the solicitation. The price will be evaluated to determine fair and reasonableness. The total evaluated price of each quote will be determined by totaling the proposed overall price of the Base Contract Line Item Numbers (CLINs). The Government will determine the best value to the Government by assessing the benefits of an offeror's higher confidence rating versus quoted price; this will be accomplished by trade-off analysis, if necessary. The Government will not award at a significantly higher price to only achieve slightly higher quality performance. As the non-price factor (Factor 1 – Past Performance) becomes equal, price becomes increasingly important. The proposed prices/costs will be evaluated but not scored. A price realism analysis will not be conducted.
The price evaluation will determine whether quote prices are fair and reasonable. A price/cost realism analysis will not be performed.
Although price is not the most important factor, it has the potential to become more significant during the evaluation process. The degree of importance of price will increase with the degree of equality of submissions in relation to the other factors on which selection is to be based. The importance of price will also increase when Offeror’s price is so significantly high as to diminish the value to the Government that might be gained under the other aspects of the submission. If, at any stage of the evaluation, all Offeror’s are determined to have submitted equal, or virtually equal, Volume 1: Non-Price Business Solution, price could become the factor in determining which Offeror will receive the award.
In addition, in order to determine that the Offeror’s are responsible the Government, in accordance with FAR 9.104-1(d), will also review Offeror’s records found in the System for Award Management (SAM) and the Federal Awardee Performance and Integrity Information System (FAPIIS) to determine if Offerors have a satisfactory record of integrity and business ethics.
Quotes that demonstrate the ability to provide an earlier delivery date will be considered more favorably.
(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
TO:
3. Except for the changes made herein all other terms, conditions and provisions of the solicitation remain unchanged and in full force and effect.
