PLATFORM ELECTRONIC INVOICING SYSTEM (FEB 2023)
Beginning October 1, 2023, when NOAA implements the Department of Commerce Business Applications Solution, the Contractor must submit payment requests electronically through the U.S.
Department of the Treasury's Invoice Processing Platform (the IPP) System. The Contractor must use the IPP website to register, access, and submit payment requests. The IPP website address is https://www.ipp.gov.
"Payment request" means any request for contract financing payment or invoice payment to the Contractor. To be considered proper, invoices must be prepared in accordance with, and contain all elements specified in, the contract payment clause (e.g., FAR 52.212-4(g), FAR 52.232-25(a)(3), FAR 52.232-26(a)(2), FAR 52.232-27(a)(2)). All supporting documents required by the Contracting Officer must be included as attachments to payment requests submitted through the IPP.
If the Contractor is unable to comply with the requirement to submit payment requests through the IPP due to a threat to national security; a matter of unusual or compelling urgency; or because the political, financial, or communications infrastructure of a foreign country does not support access to the IPP, the Contractor must request an exception in writing. Contact the Contracting Officer for more information about requesting an exception.

NOAA Acquisition Manual 1330-52.243-70 REQUESTS FOR EQUITABLE ADJUSTMENT (OCT 2017)
(a) The amount of any request for equitable adjustment to contract terms shall accurately reflect the contract adjustment for which the contractor believes the Government is liable. The request shall include only costs for performing the change. All indirect costs included in the request shall be properly allocable to the change in accordance with applicable acquisition regulations.
(b) Any request for equitable adjustment to contract terms that exceeds the simplified acquisition threshold shall bear, at the time of submission, the following certificate executed by an individual authorized to certify the request on behalf of the contractor:
I certify that the request is made in good faith, and that the supporting data are accurate and complete to the best of my knowledge and belief.
(Official’s Name)
(Title)
(c) The certification in paragraph (b) of this solicitation and contract language requires full disclosure of all relevant facts, including:
1. Certified cost or pricing data, if required, in accordance with subsection 15.403-4 of the Federal Acquisition Regulation (FAR); and
2. Data other than certified cost or pricing data, in accordance with subsection 15.403-3 of the FAR, including actual cost data and data to support any estimated costs, even if certified cost or pricing data are not required.
(d) The certification requirement in paragraph (b) of this solicitation and contract language does not apply to:
1. Requests for routine contract payments; for example, requests for payment for accepted supplies and services, routine vouchers under a cost-reimbursement type contract, or progress payment invoices; or
2. Final adjustments under an incentive provision of the contract.

NOAA Acquisition Manual 1330-52.270-304 NOAA ACQUISITION AND GRANTS OFFICE OMBUDSMAN
(OCT 2022)
(a) The NOAAAGO Ombudsman is available to organizations to promote responsible and meaningful exchanges of information. Generally, the purpose of these exchanges will be to:
1. Allow contractors to better prepare for and propose on business opportunities.
2. Advise as to technologies and solutions within the marketplace that the Government may not be aware of, or is not fully benefiting.
3. Identify constraints in transparency.
(b) The AGO Ombudsman will objectively, reasonably, and responsibly collaborate with parties and recommend fair, impartial, and constructive solutions to the matters presented to him/her. Further, the
AGO Ombudsman will maintain the reasonable and responsible confidentiality of the source of a concern, when such a request has been formally made by an authorized officer of an organization seeking to do business with, or already doing business with NOAA.
(c) Before consulting with the AGO Ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations with the respective contracting officer for resolution.
However, direct access to the AGO Ombudsman may be sought when an interested party questions the objectivity or equity of a contracting officer’s decision, or when there is a bona fide reason to believe that reasonable, responsible, and objective consideration will not be received from an assigned contracting officer.
(d) There are several constraints to the scope of the AGO Ombudsman’s authority, for instance:
1. Consulting with the AGO Ombudsman does not alter or postpone the timelines of any formal process (e.g., protests, claims, debriefings, employee employer actions, activities involving A76 competition performance decisions, judicial or congressional hearings, or proposal, amendment, modification or deliverable due dates).
2. The AGO Ombudsman cannot participate in the evaluation of proposals, source selection processes, or the adjudication of protests or formal contract disputes.
3. The AGO Ombudsman is not authorized to generate or alter laws, judicial decisions, rules, policies, or formal guidance.
4. The AGO Ombudsman is not authorized to develop or alter opportunity announcements, solicitations, contracts, or their terms or conditions.
5. The AGO Ombudsman cannot overrule the authorized decisions or determinations of the contracting officer.
6. The AGO Ombudsman has no authority to render a decision that binds AGO, NOAA, the Department of Commerce, or the U.S. Government.
7. The AGO Ombudsman is not NOAA’s agent relative to the service of magistrate or judicial process and cannot be used to extend service of process to another party (whether federal, public, or a private entity).
(e) After review and analysis of a filed concern or recommendation, the AGO Ombudsman may refer the interested party to another more suitable Federal official for consideration. Moreover, concerns, disagreements, and/or recommendations that cannot be resolved by the AGO Ombudsman will need to be pursued through more formal venues.
(f) The AGO Ombudsman is not to be contacted to request copies of forms and/or documents under the purview of a contracting officer. Such documents include Requests for Information, solicitations, amendments, contracts, modifications, or conference materials.
(g) Questions regarding items (a) through (f) within this language shall be directed to ago.ombudsman@noaa.gov.

CAR 1352.213-70 Evaluation Utilizing Simplified Acquisition Procedures (APR 2010)
The Government intends to issue one (1) award resulting from this solicitation to the responsible offeror whose quotation represents the best value to the Government, both price and non-price factors considered. In determining which quote provides the best value to the Government, non-price factors are approximately equal to price. The following factors will be used to evaluate quotations:
Factor 1 – Technical Capability
The Government will evaluate each Offeror’s technical capability by evaluating the proposed vessel design and all required technical drawings and submittals to determine if it meets the Government’s specification requirements. The Government will evaluate the design’s overall quality, innovation, and the proposed delivery time of the vessel.
Factor 2 – Past Performance
The Past Performance factor assesses the probability of meeting the solicitation requirements based on an Offeror’s demonstrated record of recent and relevant quality work performance in meeting contract requirements. The Government may obtain past performance information from various sources known or identified by the Government. The Government may consider past performance information from individual references, or in the aggregate. If an offeror does not have a history of recent or relevant past performance, or if past performance information is not available, the offeror will receive a neutral past performance rating.
Factor 3 – Price
Price quotes must generally adhere to the pricing structure established in the Schedule of Items. The offeror’s price quote must be based on the offeror's own technical quote, the Government's performance work statement and other contractual requirements. If the prices to be used are based on a published price list or catalog, the offeror shall so state, and provide a copy of the document with its price quote. If the prices are to be based on established market prices, not otherwise published, or are prices applicable only to the proposed contract, the offeror shall so state. In order to determine that offered prices are fair and reasonable, the Government reserves the right to request that the offeror provide cost breakdowns to support proposed prices.
(End of Provision)
FAR 52.212-1 (ADDENDUM) Instructions to Offerors – Commercial Items (Addendum)
The Government intends to issue an award for a base vessel with several optional items subject to the availability of funding and at the Government’s discretion. Optional items may be included with the initial award or at a later date via modification. Instructions for submitting offers under this solicitation must be followed. Failure to provide all information may result in the offer being considered non-responsive. Offers that are non-responsive may be excluded from further evaluation and rejected without further notification to the offeror.
(a) General Instructions
(1) The offer must be prepared in two parts: A technical quote and a price quote. Each of the parts shall be separate and complete in itself so that evaluation of one may be accomplished independently from evaluation of the other. The technical quote must not contain reference to price; however, adequate information must be contained in the technical quote so that the offeror’s technical approach is sufficiently detailed to provide a clear and concise presentation that addresses all contract requirements and demonstrates a clear understanding of the requirements.
(2) The technical quote should be typed, double-spaced, with one-inch margins, using Times New Roman size 12-font or equivalent, and printed, unreduced in size, on 8½" by 11" paper. The technical quote shall be no more than 60 pages, including all tables and graphics but excluding index/appendices and past performance references. Picture submissions shall not exceed 20 pages.
(3) There is no page limitation for the price quote.
(4) The offeror shall submit both portions of the quotation package electronically via email to the Contracting Officer. Each part shall be clearly marked by title. The acceptance period entered on the quote form by the offeror shall not be less than sixty (60) days, which shall apply if no other period is offered.
(5) The individual signing the quote must have the authority to commit the offeror to all of the provisions of the quote, fully recognizing that the Government has the right, by terms of the Solicitation, to make an award without discussion if it so elects.
(6) The Government will evaluate quotes in accordance with the provisions set forth in this section and with the evaluation criteria stated below.
(7) The Offerors shall identify and explain any exceptions or deviations taken to any part of the solicitation or conditional assumptions made with respect to the technical requirements of the solicitation. Offerors should note that taking exceptions to the Government’s requirements may indicate an unwillingness or inability to perform the contract, and the quote may be evaluated as such.
(b) Technical Quote
Offerors shall submit the following in their technical quote:
(1) Technical capability of the item offered to meet the Government requirement: The quote shall demonstrate the offeror´s organization and plan for successfully providing the Government’s requirement including the drawings and other items specified in Section VII of the Performance Work Statement, “Required Submissions with the Technical Quotation.” The contractor shall indicate the date (number of days after award), whereby the Government must make a go/no-go decision on each of the Optional Item(s) in order to not delay delivery or incur any additional costs.
(2) Past Performance: Offeror shall provide past performance questionnaires (Attachment 2) to references that will provide responses directly to the Contracting Officer. The offeror shall provide a list of references with contact information so that the Contracting Officer is aware of past performance evaluation questionnaires released. Past Performance questionnaires received directly from the offeror will not be considered. References are requested to complete these questionnaires and submit them by email directly to the Contracting Officer. It is requested that all questionnaires be submitted by the closing date of this solicitation in order to ensure the information will be considered. Offerors should inform their references that they should make every attempt to submit the questionnaires to NOAA within the time period stated.
NOTE: If an offeror does not have a history of similar or relevant past performance, or if it is not available, it should be noted as such in the quote.
