About this file

This is a Small Business Reserve Affidavit form from the Maryland Department of Transportation's Task Order Request for Proposal (TORFP). The document outlines the legal requirements and qualifications for businesses participating in procurements designated as Small Business Reserve or Small Business Preference under Maryland State Finance and Procurement Article §14-501(c).

The affidavit requires bidders to certify their status as a qualified small business in Maryland and commits them to notify the Procurement Officer within 30 days if they no longer meet the qualifications during the contract term. The document warns that providing false information may result in serious consequences, including contract termination, suspension and debarment, criminal prosecution for procurement fraud, and rejection of bids from non-qualifying businesses. The form requires the bidder's Small Business Qualification Number, date of most recent qualification, and signature of an authorized representative under penalty of perjury.

2. A determination that a contract entered into is void or voidable under § 11-204 of the

State Finance and Procurement Article of the Annotated Code of Maryland;

3. Suspension and debarment under Title 16 of the State Finance and Procurement Article;

4. Criminal prosecution for procurement fraud (§ 11-205.1 of the State Finance and

Procurement Article), perjury, or other crimes; and
