Submit only the electronic files, specifically authorized elsewhere in this section. Do not submit excess information, to include audio-visual materials, electronic media, etc. Do not include links to information on websites in lieu of explicitly incorporating the information into the proposal. Except where another size is specifically authorized for a specific submission, use only 8 1/2” x 11” page layouts. Use at least 1 inch margins, which may include headers and footers. Do not justify the right margin. Ensure that all text and graphics are clearly legible. Do not use a font size smaller than 10, unusual font styles such as script, or condensed fonts. For submissions with page limitations, the pages will be counted as follows: One side of the paper is one page; information on both the back and front of one sheet of paper will be counted as two pages.

Where authorized, a foldout sheet will count as one page. Pages furnished for organizational purposes only, such as a “Table of Contents” or divider tabs, are excluded from page limitations.

Proposal Binding.

The preferred method for assembling proposals is via unprotected PDF formats, divided by volume.

Conditioning of Offer.

Do not include exceptions to the terms and conditions of the solicitation in either the technical or price proposal volumes. Inclusion of any standard company terms and conditions that conflict with the terms and conditions of the solicitation may result in a determination that the offer is unacceptable and thus ineligible for award. Resolve questions about the terms and conditions or technical requirements of the solicitation prior to submission of the https://safe.apps.mil/ mailto:Vernon.simpkins@usace.army.mil offer. Notwithstanding the above, the offeror must clearly describe in the proposal cover sheet submitted with the price volume any exceptions, within the offer, to the contractual and/or technical terms and conditions of the solicitation.

Restrictions on Offeror-Provided Information.

“Confidential” projects cannot be submitted to demonstrate capability unless all of the information required for evaluation as specified herein can nonetheless be provided to the Government as part of the offeror’s technical proposal. Offerors that include in their proposals information that they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, must clearly mark the information in accordance with FAR 52.215-1, “Instructions to Offeror – Competitive Acquisition”, paragraph (e), “Restriction on disclosure and use of data”. Files shall not contain classified data.

REQUIREMENT FOR SEPARATE PRICE AND TECHNICAL PROPOSAL VOLUMES.

Each offeror must submit both a “price proposal” volume and a “technical proposal” volume. The price proposal includes the signed offer and the offeror’s proposed prices. The technical proposal includes all required information relating to the “non-price” evaluation factors. The two volumes must be submitted as separate, physically distinct volumes. Both volumes must be received at the location shown at the bottom of Attachment 4 – Task Order Acknowledgment. The information in the two volumes is evaluated separately and independently. Therefore, all information intended by the offeror to be evaluated as part of the price proposal must be submitted as part of the price proposal. All information intended by the offeror to be evaluated as part of the technical proposal must be submitted as part of the technical proposal. Do not merely cross-reference similar material between the technical and price proposals. Information in the price proposal will not be considered in the technical evaluation, and vice versa. NO PRICE INFORMATION SHOULD BE INCLUDED IN THE TECHNICAL PROPOSAL.

Marking of Proposal Volumes.

Mark each volume as either the “Price Proposal” or the “Technical Proposal”. Additionally, mark the first page of each volume with the project title and location, solicitation number, and the name and address of the offeror.

Tabbing of Proposal Volumes.

Offers are to be formatted and tabbed in accordance with the instructions that follow for each proposal volume.

The technical evaluation will: Consider the lowest-price offeror first; USACE will evaluate the lowest-price offeror.

If said offeror is deemed to be technically acceptable, then no other offeror(s) will be evaluated. If deemed unacceptable, the next lowest-price offeror will be evaluated for acceptability. This process will continue until an acceptable offeror is found; however, any offeror priced higher than the first offeror found acceptable will not be evaluated. The Government intends to evaluate proposals and award a task order without discussion with offerors, except clarifications, using the ratings and descriptions outlined below in Table A-1. To be considered technically acceptable, an offeror’s proposal must be rated “acceptable” under all technical factors.

Technical Acceptable/Unacceptable Ratings. An “acceptable” rating will be assigned to a proposal that has satisfied all of the requirements of the technical evaluation factors set forth in the solicitation. C) Past Performance

The past performance evaluation is an assessment of the offeror’s ability to maintain a no-less-than “acceptable” level of past performance required in this solicitation. This assessment is based on the offeror’s record of recent and relevant past performance information that pertain to the products and/or services outlined in the solicitation requirements.

1. The Offeror shall submit past performance information on the projects submitted in Factor A) Experience.

The Offeror shall provide completed performance evaluations for the submitted projects that demonstrate the Offeror’s performance on recent and relevant projects of similar scope, magnitude and complexity. It will be considered relevant if it is similar in size, scope, and complexity to this project and recent if commenced within the last seven (7) years.

2. If a formal performance evaluation is not available, then the Past Performance Questionnaire (PPQ) included in the solicitation is provided for the offeror or its team members to submit to the client for each project described above in 4.2.1.1. Ensure correct phone numbers and email addresses are provided for the client point of contact. Completed PPQ’s should be submitted with your proposal. If the offeror is unable to obtain a completed PPQ from a client for a project (s) before proposal closing date, the offeror shall complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. Completed questionnaires may also be submitted by the preparer directly to the Government’s point of contact, Vernon Simpkins at Vernon.Simpkins@usace.army.mil prior to proposal closing date.

3. In addition to the above, the Government may review information obtained from any other sources in evaluating each offeror’s past performance. Sources may include, but are not limited to, past performance information retrieved through the using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), Contractor Performance Assessment Reporting System (CPARS), and any other known sources not provided by the offeror.

4. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

5. Start the information for each example project on a new page. There is not a page limitation for this submission.

NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.” In conducting the past performance evaluation, each Offeror shall be assigned one of the ratings in accordance with the table below.

Table A-1. Technical Acceptable/Unacceptable Ratings

Rating Description

Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

D) Evaluation of Offers:

Non-pricing Evaluation

1. Potential offerors are hereby informed that the Government intends to make a contract award without discussions except when the Government determines that it is in its best interest to hold discussions.

Therefore, failure by an offeror to provide mandatory information may constitute a deficiency and make the offeror involved ineligible for a contract award. A decision to hold discussions requires written justification by the Contracting Officer. Failure to correct a deficiency or deficiencies will result in the offeror’s being ineligible for the contract award.

2. The Technical Evaluation Team (TET) is to assign an acceptable or unacceptable rating to an offeror’s overall non-pricing submission. The non-pricing evaluators will indicate whether the proposal is technically acceptable or unacceptable. The TET shall fully describe the basis for the adjective rating assigned. The TET Chairperson will provide the SSA with a written report that clearly and fully addresses why a proposal is acceptable or unacceptable.

a) The TET members shall not have access to the price proposals.

b) All technical evaluation ratings provided to the SSA are advisory in nature and subject to review and concurrence by the SSA. In the case of non- concurrence, the SSA may revise the findings of the TET or return the TET’s findings to the TET for further consideration.

3. Small Business Participation Evaluation Criteria a . All Offerors (both large and small businesses) will be evaluated on the proposed participation of

U.S. small businesses in the performance of acquisition (as small business prime Offerors or small business subcontractors) relative to the objectives and goals established herein. Goals for this procurement are to be proposed by the Offeror as a percentage of the total contract amount. Failing to meet the overall subcontracting goal will limit the Offeror from receiving higher than an "Acceptable" rating.

b. Separate from Small Business Participation Plan, other than U.S. Small Business Offerors must also submit a subcontracting plan at the time of proposal meeting the requirements of FAR 52.219-9 and DFARS 252.219-7003 (or DFARS 252.219-7004 if the Offeror has a comprehensive subcontracting plan). Other than U.S. Small Businesses must submit acceptable subcontracting plans to be eligible for award. Subcontracting Plans shall reflect and be consistent with the commitments offered in the Small Business Participation Plan.

Price Evaluation:

1. Offerors are advised that only firm-fixed-price (FFP) proposals will be considered. Other kinds of offers or offers that are conditional in nature are not to be considered for a contract award unless corrected by means of discussions or some other authorized means.

2. Price proposals will be reviewed and analyzed for completeness and reasonableness.

Reasonableness evaluations include, but are not limited to, a review of offerors’ price proposals for unbalanced pricing and comparison with the Independent Government Estimate (IGE) and the proposed prices submitted by the other offerors. The successful offeror’s price proposal must be rated complete and reasonable by the PET and that determination sustained by the SSA.

3. The PET will provide the SSA with a written report that clearly and fully describes the results of the price evaluations. The SSA may sustain or overrule the findings of the PET.

E) Basis for Award—LPTA. The contract resulting from this solicitation will be awarded to the responsive and responsible offeror submitting the lowest reasonable price that has an overall acceptable rating concerning non-pricing evaluation factors. The overall goal is a successful project. A successful project is a project that results in quality work performed in a timely and safe manner at a reasonable overall price to the Government.
