This acquisition is conducted under the authority of the Multiple Award Schedule Program (see FAR 8.401)

1. Identification of the agency and the contracting activity:

The requesting activity is Treasury Inspector General for Tax Administration (TIGTA), Office of Investigations, Technical and Firearms Support Division and the contracting activity is Bureau of the Fiscal Service.

2.a Nature and/or description of the action being approved:

The purpose of this limited-sources justification is to obtain approval to award a firm-fixed-price (FFP) delivery order with Government Marketing and Procurement (GMP) LLC under GSA contract number GS-07F-0530W for the purchase of the items described in section 3.a below. It is anticipated that this action will have a period of performance of one (1) twelve-month base year and four (4) twelve-month option years with an expected Total Contract Value of $421,461.00. Requisition TGT-OI-TFS-24-0017 was submitted in the amount of $150,911.00 to fund the base year. This acquisition will not be competed as this is a limited source requirement and Government Marketing and Procurement (GMP) LLC is the sole small business authorized reseller of the software.

The proposed acquisition is to acquire FleetCommander software as follows:

Agile Access Control is the developer.

1. Is the only known source for the off-the-shelf supplies and services that directly meet the needs of the Department of the Treasury and TIGTA. While other vendors may be able to develop desired services in the future, the risk and schedule delays associated with customized work is not desired.

2. Has a unique product that addresses the specific needs of the fleet.

3. Has key personnel that have analyzed specific challenges of the Department of the

Treasury and TIGTA fleet management and identified ways in which off-the-shelf capabilities can overcome the Department of the Treasury’s and TIGTA’s challenges.

4. Can implement these services in the desired time frame.

These capabilities are described below.

Only Known Source

Agile Access Control, Inc. is the developer of the FleetCommander fleet management software solution. Agile has a reseller, Government Marketing and Procurement (GMP) LLC, that is a SDVOSB on GSA schedule # GS-07F-187GA. This requirement will be a limited source being solicited directly to GMP with the JOFOC being posted to the Government Point of Entry (GPE) 14 days after award. The software product and accompanying hardware operates in a web-based (Internet or Intranet) environment. From the onset of the company in 2000, this company has focused on fleet optimization – specifically specializing in the area of assigned fleet and short-term fleet management. This is their core competency. After a detailed review of industry solutions via the Internet and trade journals revealed that Agile is the only company to offer all of the following functions in a single integrated fleet management package:

Unique Product that Addresses Specific Needs

FleetCommander efficiently enables TIGTA to:

Reduce or eliminate paper-based forms and processes Determine correct number of vehicles to accomplish mission Determine correct composition of vehicles to accomplish mission Provide accurate projections of future vehicle usage Provide accurate reports of past vehicle usage Automate the scheduling and tracking of vehicle inspections Track vehicle damages to the offending individual and charge back to the offending organization or individual Gain insight into availability of vehicles among different sites Automate collection of vehicle odometer readings on a timely basis and support home-to-work reporting Automate maintenance tracking, maintenance reporting and cost reporting Provide pertinent reports in a timely manner Automate processes to minimize human error Increase end user satisfaction Produce accurate billing data on a timely basis.

☐ FAR 8.405-6(a)(1)(i)(A) – An urgent and compelling need exists, and following the procedures would result in unacceptable delays.

☒ FAR 8.405-6(a)(1)(i)(B) – Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

☐ FAR 8.405-6(a)(1)(i)(C) – In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order or BPA provided that the original order or BPA was placed in accordance with FSS procedures in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.

4.b Supporting Rationale: Agile is the manufacturer of the Fleet Commander solution and they only have 1 reseller of this solution GMP, which is on GSA schedule.

5. A determination by the ordering activity Contracting Officer that the order or BPA represents the best value consistent with FAR 8.404(d):

The Contracting Officer has determined that the GSA award GS-07F-187GA represents the best value consistent with FAR 8.404(d) and lowest overall cost alternative (considering price, special features, administrative costs) to meet the Government’s needs based on the proposal received from GMP.

6. A description of the market research conducted among schedule holders and the results or a statement why market research was not conducted:

Market research was conducted by the Contracting Officer and Program Office in December of 2023. The results of the market research supported the Government’s determination to obtain these services under a limited source basis. Refer to the SF 1010 Market Research Summary Report for specific details.
