SECTION C—DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C.1 STATEMENT OF WORK

This project consists of the restoration of road base and surfacing material on approximately 600’ of Forest Service road 4200000. A rolling dip shall be constructed during the placement and shaping of road base and surfacing material.

Contractor shall be responsible for providing all labor, tools, material, and equipment necessary to perform all work in strict accordance with the specifications and drawings. Payment for contract work will be made only for and under those pay items included in the Schedule of Items. All other work and materials will be considered as incidental to and included in the payment for the items shown.

C.2 LOCATION OF WORK

This project is located in North Central Washington State, on the Okanogan-Wenatchee National Forests, Tonasket Ranger District. Directions to the site from Okanogan, WA: Travel 19 miles from Okanogan via Okanogan Co. Rd. #9229, Conconully Hwy., to the town of Conconully. From Conconully, travel SW 3.1 miles via County Rd. 2017. At the junction of Forest Service roads 3700000 and 4200000, turn left onto FS road 4200000 and continue for 0.8 miles to the project site.

C.3 DESCRIPTION OF WORK

During spring flooding in 2018, a culvert (Cedar Creek) inlet plugged, allowing water to run down the 4200000 road. Road base material and surfacing aggregate were lost and require replacement. Subsequent emergency repairs were made, re-establishing a drivable road surface. This project will repair the road to the original template. The work required under this contract is to restore the road cross section by reestablishing ditchlines, backslopes, and importing lost base and surface material. A dip shall be constructed during the base and surface material placement. The elevation of the work site is approximately 2680’.

The government shall stake the location of the rolling dip. The government will also stake beginning and ending points for base and aggregate placement, and required base material depth.

For assigned activities, the Contractor shall present a schedule of completion including anticipated hours per day, days per week and dates.

C.4 PROJECT CONTROL

It is anticipated that this contract will be awarded on or around July 1, 2020. Work shall begin within ten (10) calendar days of award. All work shall be completed within thirty (30) calendar days after a Notice To Proceed is issued.

Contractor shall submit a proposed work plan, prior to beginning construction, for approval by the Contracting Officer.

Contractor is responsible for protecting workers from injury. Refer to FAR 52.236-13, Accident Prevention, for full text.

The Contractor shall confine all operations (including storage of materials) on Government premises to areas authorized or approved by the Contracting Officer. The Government is not responsible for loss of or damage to materials or supplies stored on-site during performance of this contract.

C.5 TERMINOLOGY

The term “Engineer,” when used in the contract documents, shall refer to the Contracting Officer’s Representative (COR). The term “Owner,” when used in the contract documents, shall refer to the Federal Government (USDA Forest Service).

C.6 EXISTING CONDITIONS

Contractor shall verify all existing dimensions and conditions before proceeding with the work. All dimensions must be verified and/or determined in the field. Protect all improvements including existing culverts, signs and roadway from damage during construction. The elevation of the work site is approximately 2680’.

C.7 TRAFFIC CONTROL & MAINTENANCE

The project road is currently open to traffic. The project road shall be left in an open state outside of construction operational periods. Contractor may close the project road for up to 30 minutes during the performance of work, and provide certified flaggers as needed to provide for safety within the construction area.

The contractor shall include delay closure dates in the Traffic Control Plan, as well as the contractor’s plan for accommodating public traffic. Contractor shall be required to post signage to warn public of the delays during construction. No work will be allowed during holidays or weekends. Loads over legal limits require a Forest Service Overload Permit in addition to state or local overload permits prior to crossing any bridges.

C.8 ATTACHMENTS TO STATEMENT OF WORK/SPECIFICATIONS

U.S. Department of Transportation, “Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects: FP-14 U.S. Customary Units,” hereafter refered to as FP-14, are included by reference. The requirements contained in Section 101 through 158 are hereby made a part of this solicitation and any resultant contract. Special Project Specifications (SPS) that amend FP-14 can be found in this contract.

The attachments to the Statement of Work/Specifications listed in Sections F, G and J are hereby made part of this solicitation and any resultant contract.

C.9 LANDSCAPE PRESERVATION

All heavy equipment shall be cleaned and inspected by the COR prior to mobilization to the work site.

Once on site all equipment shall be inspected daily and all visible oil, grease, and hydraulic fluid will be removed. Needed repairs will be implemented immediately before resuming work.

All machinery shall be refueled outside of riparian reserve areas. If refueling does occur within a riparian reserve area, spill control measures shall be installed around the machinery prior to refueling operations.

Unless otherwise agreed, to prevent the introduction of seeds of noxious weeds onto National Forest land, Contractor shall ensure all equipment moved onto National Forest land is free of soil, seeds, vegatative matter or other debris that could contain or hold seeds. Contractor shall employ whatever cleaning methods necessary to ensure compliance with this provision, and shall notify the Forest Service prior to moving each piece of equipment onto National Forest land. Upon request by the Forest Service, arrangements will be made for Forest Service personnel to inspect each piece of equipment prior to being moved onto National Forest land.

F.2 FAR 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK

(APR 1984)

The Contractor shall be required to (a) commence work under this contract within ten (10) calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and

(c) complete the entire work ready for use not later than thirty (30) calendar days after issuance of the notice to proceed. The time stated for completion shall include final cleanup of the premises.

SECTION G—CONTRACT ADMINISTRATION DATA

G.1 FAR 52.236-26 PRECONSTRUCTION CONFERENCE (FEB 1995)

If the Contracting Officer decides to conduct a preconstruction conference, the successful offeror will be notified and will be required to attend. The Contracting Officer’s notification will include specific details regarding the date, time, and location of the conference, any need for attendance by subcontractors, and information regarding the items to be discussed.

G.2 DESIGNATION OF CONTRACTING OFFICER’S REPRESENTATIVE

The Contracting Officer will designate a Contracting Officer's Representative (COR) at the time of contract award.

The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.

The Contracting Officer should be informed as soon as possible of any actions or inactions by the Contractor or the Government which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual task assignments which were issued by the COR provided they do not affect the delivery schedule or performance period stated in the contract).

On all matters that pertain to the contract terms the Contractor must communicate with the Contracting Officer.

Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.

The COR is delegated full authority under this contract except for the following actions which are reserved for the Contracting Officer:

1. Approve Change Orders and Modifications

2. Take Action to terminate the contract for default or Government convenience

3. Make contract adjustments under the Different Site Conditions clause

4. Grant extensions of contract time.

5. Approve assignment of claims.

6. Make final decisions under the Disputes clause

8. Make final decisions under the Suspension of Work clause.

9. Make equitable adjustments.

10. Authorize change in amount of Payment Retention.

11. Approve subcontractors.

G.3 NOTIFICATION OF SUBCONTRACTING

The Contractor shall promptly notify the Contracting Officer upon entering into any subcontract arrangement.

The subcontractor shall have the experience and be equipped for such work. The Contractor and subcontractor shall fill out the SF 1413, Statement and Acknowledgement and submit to the Contracting Officer. Other written notification shall include as a minimum:

A. The name, address and telephone number of the subcontractor.

B. The date upon which the subcontract was entered into and its duration.

C. A detailed description of the work being subcontracted including a listing of contract items, units, etc., as appropriate.

D. Documentation of the subcontractor's representative authority.

E. A copy of the Statement of Acknowledgement form (SF-1413) must be provided to the Contracting Officer prior to any subcontractor work beginning.

Subcontracting any portion of the task order shall not relieve the Prime Contractor of any responsibility under this task order. Any subcontract agreement shall contain all terms and conditions of the prime task order.

G.4 INVOICE PROCESSING PLATFORM (IPP)

All invoices are to be submitted via the electronic Invoice Processing Platform (IPP) at www.ipp.gov.

Contractors shall submit all invoices electronically via IPP. Paper copies of invoices will not be accepted. The Contractor must also attach a detailed invoice in IPP.

SECTION H--SPECIAL CONTRACT REQUIREMENTS

H.1 FAR 52.236-9 PROTECTION OF EXISTING VEGETATION, STRUCTURES, EQUIPMENT,

UTILITIES, AND IMPROVEMENTS (APR 1984)

(a) The Contractor shall preserve and protect all structures, equipment, and vegetation (such as trees, shrubs, and grass) on or adjacent to the work sites, which are not to be removed and which do not unreasonably interfere with the work required under this contract. The Contractor shall only remove trees when specifically authorized to do so, and shall avoid damaging vegetation that will remain in place. If any limbs or branches of trees are broken during contract performance, or by the careless operation of equipment, or by workman, the Contractor shall trim those limbs or branches with a clean cut and paint the cut with a tree-pruning compound as directed by Contracting Officer.

(b) The Contractor shall protect from damage all existing improvements and utilities (1) at or near the work site and (2) on adjacent property of a third party, the location of which are made know to or should be known by the Contractor. The Contractor shall repair any damage to those facilities, including those that are the property of a third party, resulting from failure to comply with the requirements of this contract or failure to exercise reasonable care in performing the work. If the Contractor fails or refuses to repair the damage promptly, the Contracting Officer may have the necessary work performed and charge the cost to the Contractor.

PART II—CONTRACT CLAUSES

SECTION I – CONTRACT CLAUSES

I.1 FAR 52.228-13 ALTERNATIVE PAYMENT PROTECTIONS (JUL 2000) (Applicable to

Contracts >$35,000 but < $150,000)

(a) The Contractor shall submit one of the following payment protections:

Payment Bond; OR Irrevocable Letter of Credit.

(b) The amount of the payment protection shall be 100 percent of the contract price.

(c) The submission of the payment protection is required within 15 days of contract award.

(d) The payment protection shall provide protection for the full contract performance period plus a one-year period.

(e) Except for escrow agreements and payment bonds, which provide their own protection procedures, the

Contracting Officer is authorized to access funds under the payment protection when it has been alleged in writing by a supplier of labor or material that a nonpayment has occurred, and to withhold such funds pending resolution by administrative or judicial proceedings or mutual agreement of the parties.

(f) When a tripartite escrow agreement is used, the Contractor shall utilize only suppliers of labor and material that signed the escrow agreement.

I.2 FAR 52.223-2 AFFIRMATIVE PROCUREMENT OF BIOBASED PRODUCTS UNDER

SERVICE AND CONSTRUCTION CONTRACTS (SEPT 2013)

(a) In the performance of this contract, the contractor shall make maximum use of biobased products that are United States Department of Agriculture (USDA)-designated items unless—

(1) The product cannot be acquired—

(i) Competitively within a time frame providing for compliance with the contract performance schedule;

(ii) Meeting contract performance requirements; or

(iii) At a reasonable price.

(2) The product is to be used in an application covered by a USDA categorical exemption (see 7 CFR 3201.3(e)). For example, all USDA-designated items are exempt from the preferred procurement requirement for the following:

(i) Spacecraft system and launch support equipment.

(ii) Military equipment, i.e., a product or system designed or procured for combat or combat-related missions.

(b) Information about this requirement and these products is available at http://www.biopreferred.gov.

(c) In the performance of this contract, the Contractor shall—

Bid Schedule — The Schedule of Items.

Bridge — A structure, including supports, erected over a depression or an obstruction such as water along a road, a trail, or a railway and having a deck for carrying traffic or other loads.

Contractor — The individual or legal entity contracting with the Government for performance of prescribed work. In a timber sale contract, the contractor is the “Purchaser”.

Culvert — Any structure with a bottom, regardless of fill depth, depth of invert burial, or presence of horizontal driving surface, or any bottomless (natural channel) structure with footings that will not have wheel loads in direct contact with the top of the structure.

Drawings — (Public Works Contracts) Design sheets or fabrication, erection, or construction details submitted to the CO by the Contractor according to FAR Clause 52.236‐21 Specifications and Drawings for Construction. Also refers to submissions and submittals.

Notice to Proceed — (Public Works Contracts) Written notice to the Contractor to begin the contract work.

Right‐of‐Way — A general term denoting (1) the privilege to pass over land in some particular line (including easement, lease, permit, or license to occupy, use, or traverse public or private lands), or (2) Real property necessary for the project, including roadway, buffer areas, access, and drainage areas.

All material (e.g., soil, gravel, sand, borrow, aggregate, etc.) transported onto National Forest System land or incorporated into the work shall be weed‐free. The Contracting Officer may request written documentation of methods used to determine the weed‐free status of any and all materials furnished by the contractor.

Contractor‐provided expertise and methods to establish weed‐free status must be appropriate for the weeds of concern in the local area.

A Forest Service weed specialist will inspect proposed sources to determine weed‐free status. Provide the

Contracting Officer written notification of proposed material sources 7 days prior to use. Written approval of the specific source will be provided to the contractor by the CO. If weed species are present in the proposed source, appropriate mitigation measures may allow conditional use of the source as required by the Contracting

Officer.

106.01 Conformity with Contract Requirements.

Follow the requirements of FAR Clause 52.246‐12 Inspection of Construction.

References to standard test methods of AASHTO, ASTM, GSA, and other recognized standard authorities refer to the methods in effect on the date of solicitation for bids.

Perform all work to the lines, grades, cross‐sections, dimensions, and processes or material requirements shown on the plans or specified in the contract.

Incorporate manufactured materials into the work according to the manufacturer’s recommendations or to these specifications, whichever is more strict.

Plan dimensions and contract specification values are the values to be strived for and complied with as the design values from which any deviations are allowed. Perform work and provide material that is uniform in character and reasonably close to the prescribed value or within the specified tolerance range. The purpose of a tolerance range is to accommodate occasional minor variations from the median zone that are unavoidable for practical reasons.

When standard manufactured items are specified (such as fence, wire, plates, rolled shapes, pipe conduits, etc., that are identified by gauge, unit mass, section dimensions, etc.), the identification will be considered to be nominal masses or dimensions. Unless specific contract tolerances are noted, established manufacturing tolerances will be accepted.

The Government may inspect, sample, or test all work at any time before final acceptance of the project. When the Government tests work, copies of test reports are furnished to the Contractor upon request. Government

Government, the Contractor’s results may be used by the Government to evaluate work for acceptance. Do not rely on the availability of Government test results for process control.

Acceptable work conforming to the contract will be paid for at the contract unit bid price. Four methods of determining conformity and accepting work are described in Subsections 106.02 to 106.05 inclusive. The primary method of acceptance is specified in each Section of work. However, work may be rejected at any time it is found by any of the methods not to comply with the contract.

Remove, repair, or replace work that does not conform to the contract, or to prevailing industry standards where no specific contract requirements are noted. Removing, repairing, or replacing work; providing temporary traffic control; and any other related work to accomplish conformity will be at no cost to the Government.

(a) Disputing Government test results. If the accuracy of Government test results is disputed, promptly inform the CO. If the dispute is unresolved after reasonable steps are taken to resolve the dispute, further evaluation may be obtained by written request. Include a narrative describing the dispute and a proposed resolution protocol that addresses the following:

1. Sampling method;

2. Number of samples;

3. Sample transport;

4. Test procedures;

5. Testing laboratories;

6. Reporting;

7. Estimated time and costs; and

8. Validation process.

If the evaluation requires additional sampling or testing be performed, mutually agree with the Government on witnessing procedures and on sampling and testing by a third party laboratory. Use a third party laboratory accredited by the AASHTO accreditation program. Provide proof of the laboratory’s accreditation for the test procedures to be used. Do not use the same laboratory that produced the disputed Government test results or that produced the test results used as a basis for the dispute.

The CO will review the proposed resolution protocol and may modify it before final approval and execution.

The Government will use the approved resolution protocol test results to determine the validity of the disputed testing. If the Government test results are validated, the Contractor will be responsible for all costs associated with developing and performing the resolution protocol. If the Government test results are not validated, the

Government will be responsible for all costs associated with developing and performing the resolution protocol.

If the validity of the Government test results cannot be determined, the Contractor and Government will equally share all costs associated with developing and carrying out the resolution protocol.

(b) Alternatives to removing and replacing non‐conforming work. As an alternative to removal and replacement, the Contractor may submit a written request to:

1. Have the work accepted at a reduced price; or

2. Be given permission to perform corrective measures to bring the work into conformity.

109.01 Measurement of Work.

Take measurements as described in Subsection 109.02 unless otherwise modified by the Measurement

Subsection of the section controlling the work being performed. Table 109‐1 indicates the accuracy required for quantities of the various pay units used in the Schedule of Items. Use this guide to determine the decimal placement in the final payment.

Contract quantities will be adjusted only when there are errors in the original design of 15% or more.

(c) Project weighing system.

For aggregates weighed for payment, adjust scale weights of material to deduct the daily average moisture content in excess of 2 percentage points over optimum moisture as determined by AASHTO T 99 or the designated compaction method. If moisture determination is necessary, determine the daily average moisture content in accordance with AASHTO T 255, from not less than three representative samples of aggregate taken at random intervals each day that aggregate is being weighed.

Manual scales may be used if approved in writing by the CO and if the method of weighing meets all other contract requirements.

Description

151.01 This work consists of moving personnel, equipment, material, and incidentals to the project and performing all work necessary before beginning work at the project site; obtaining of permits, insurance, and bonds. This work also includes washing and treating construction equipment and vehicles necessary for equipment transport to remove seeds, plants, and plant fragments before the equipment is used on Forest Service lands, according to the requirements within.

Wash the sides, tops, and undercarriages of all construction equipment. Remove all seeds, plants, plant fragments, dirt, and debris from the construction equipment. Only equipment inspected by the Forest Service will be allowed to operate within the project area. All subsequent move‐ins of equipment to the project area will be treated in the same manner as the initial move‐in. This requirement does not apply to cars, pickup trucks, and other vehicles that regularly travel between the construction site and areas off the National Forest.

Equipment will be considered free of soil, seed, and other such debris when a visual inspection does not disclose such material. Disassembly of equipment, components or the need for specialized inspection tools is not required.

Notify the CO in writing at least 72 hours before moving any construction equipment onto the national forest.

Notification will include an agreed upon location where the equipment will be available for inspection by the Forest Service. Inspection will be required after every cleaning.
