SECTION C—DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
C.1 STATEMENT OF WORK
This work consists of developing a Sno Park along highway 20 near the Silver Star Creek Gate where the highway closes annually for the winter. Work includes, but is not limited to, widening the shoulder to accommodate parking, furnishing and installing a concrete vault toilet, furnishing and installing several traffic control and information signs, construction of two detention ponds, furnishing and installing concrete barriers, and removal of slash and excess material to an approved disposal site. Contractor shall be responsible for providing all labor, tools, material, and equipment necessary to perform all work in strict accordance with the specifications and drawings. Payment for contract work will be made only for and under those pay items included in the Schedule of Items. All other work and materials will be considered as incidental to and included in the payment for the items shown.
C.2 LOCATION OF WORK
The project area is located on the Methow Ranger District of the Okanogan-Wenatchee National Forest. From the Methow Valley Ranger Station in Winthrop, WA, the project area is 22.4 miles west on highway 20. The construction area will take place primarily on the east-bound (south) shoulder, approximately 1100’ in length east from the Silver Star Gate and 25-50’ depth from the fog line. Some signs will be installed on the north side of highway 20 less than half a mile east of the project site.

The spoil and slash disposal site is located adjacent to a gravel pit approximately 0.9 miles up Cedar Creek, FSR 5310200. The 200 spur road is 4.5 miles East on Hwy 20 from the project site.

C.3 DESCRIPTION OF WORK
The project work consists of creating and following a detailed traffic control plan for working on the shoulder of highway 20, installing erosion control material as needed to prevent sediment from entering the streams within or adjacent to the work area, survey and staking for the length of the project area, clearing and grubbing with the removal of several hazard trees, excavation and shoulder widening construction, ditch construction, creating two detention ponds, furnishing and installing several concrete jersey style barriers, furnishing and installing a single, concrete vault toilet, furnishing and installing several information and regulatory signs and placement and compaction of both base course and surface course aggregate. Excess excavated material and clearing slash will be either chipped on site or hauled approximately 5.5 miles to a designated spoil location where the contractor will stockpile or deck the slash depending on size.
C.4 PROJECT CONTROL
It is anticipated that this task order will be awarded on or around June 15, 2020. Onsite work can begin as soon as weather permits (typically around June 1), but must be completed no later than November 1, 2020. Contractor must begin work within ten (10) calendar days from the Notice to Proceed (NTP). A contract time of sixty (60) calendar days is allowed for this task order.

Contractor is responsible for protecting workers from injury (refer to FAR 52.236-13, Accident Prevention, for full text).
The Contractor shall confine all operations (including storage of materials) on Government premises to areas authorized or approved by the Contracting Officer. The Government is not responsible for loss of or damage to materials or supplies stored on-site during performance of this task order.
C.5 TERMINOLOGY
The term “Engineer,” when used in the contract documents, shall refer to the Contracting Officer’s Representative (COR) and the term “Owner,” when used in the contract documents, shall refer to the Federal Government (USDA Forest Service).
C.6 EXISTING CONDITIONS
Contractor shall verify all existing quantities and conditions before proceeding with the work. All quantities must be verified and/or determined in the field. Protect all improvements including existing roadway from damage during construction. Elevation at project sites is around 3,400 feet.
C.7 TRAFFIC CONTROL & MAINTENANCE
Contractor may close highway 20 only for hazard tree felling and removal. Closures shall be no more than 20 consecutive minutes followed by no less than 10 minutes of opening to public traffic. Contractor responsible to notify WSDOT and the engineer at least one week in advance of any closures. Closure must be addressed in the Traffic control Plan and must provide certified flaggers. For work items other than hazard tree removal, the contractor will not be allowed to close any lanes on highway 20 and will only be permitted to close the shoulder. Contractor to develop and implement a detailed traffic control plan that meets WSDOT requirements and include closure dates for highway 20 in their final schedule. Contractor will be required to submit a copy of insurance showing WSDOT as one of the insured parties. Traffic control plan to also account for hauling material to approved disposal site on Forest Road 5310200. Contractor will not be allowed to close Road 5310200 during construction but shall include plans for accommodating public traffic both on highway 20 and Forest Road 5310200. Contractor shall be required to post signage to warn public of the delays during construction both along highway 20 and Forest Road 5310200. No work will be allowed during holidays or weekends.
C.8 ATTACHMENTS TO STATEMENT OF WORK/SPECIFICATIONS
U.S. Department of Transportation, “Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects: FP-14 U.S. Customary Units,” hereafter referred to as FP-14, are included by reference. The requirements contained in Section 101 through 158 are hereby made a part of this solicitation and any resultant contract. Special Project Specifications (SPS) that amend FP-14 can be found in this contract.
WSDOT Standard Specifications for Road, Bridge and Municipal Construction are hereby made a part of this solicitation and any resultant contract.
The attachments to the Statement of Work/Specifications listed in Sections F, G and J are hereby made part of this solicitation and any resultant contract.

C.9 LANDSCAPE PRESERVATION
All heavy equipment shall be cleaned and thoroughly inspected prior to mobilization to the work site.
Once on site all equipment shall be inspected daily and all visible oil, grease, and hydraulic fluid will be removed. Needed repairs will be implemented immediately before resuming work.
All machinery shall be refueled outside of riparian reserve areas or within 150 feet of the Silver Star Creek and Early Winters Creek. If refueling does occur within riparian reserve areas, spill control measures shall be installed around the machinery prior to refueling operations.
Unless otherwise agreed, to prevent the introduction of seeds of noxious weeds onto National Forest land, Contractor shall ensure all equipment moved onto National Forest land is free of soil, seeds, vegetative matter or other debris that could contain or hold seeds. Contractor shall employ whatever cleaning methods necessary to insure compliance with this provision, and shall notify the Forest Service prior to moving each piece of equipment onto National Forest land. Upon request of Forest Service, arrangements will be made for Forest Service to inspect each piece of equipment prior to being moved onto National Forest land.
C.10 BIOBASED PRODUCTS
In the performance of this task order, the Contractor shall make maximum use of biobased products as stated in clause FAR 52.223-2, Affirmative Procurement of Biobased Products Under Service and Construction Contracts. Sample biobased products that may apply to this project are:

F.2 FAR 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK
(APR 1984)
The Contractor shall be required to (a) commence work under this contract within ten (10) calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than November 1, 2020. The time stated for completion shall include final cleanup of the premises.

SECTION G--CONTRACT ADMINISTRATION DATA
G.1 FAR 52.236-26 PRECONSTRUCTION CONFERENCE (FEB 1995)
If the Contracting Officer decides to conduct a preconstruction conference, the successful offeror will be notified and will be required to attend. The Contracting Officer’s notification will include specific details regarding the date, time, and location of the conference, any need for attendance by subcontractors, and information regarding the items to be discussed.
G.2 DESIGNATION OF CONTRACTING OFFICER’S REPRESENTATIVE
The Contracting Officer will designate a Contracting Officer's Representative (COR) at the time of contract award.
The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.
The Contracting Officer should be informed as soon as possible of any actions or inactions by the Contractor or the Government which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual task assignments which were issued by the COR provided they do not affect the delivery schedule or performance period stated in the contract).
On all matters that pertain to the contract terms the Contractor must communicate with the Contracting Officer.
Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.
The COR is delegated full authority under this contract except for the following actions which are reserved for the Contracting Officer:
1. Approve Change Orders and Modifications
2. Take Action to terminate the contract for default or Government convenience
3. Make contract adjustments under the Different Site Conditions clause
4. Grant extensions of contract time.
5. Approve assignment of claims.
6. Make final decisions under the Disputes clause
7. Make final acceptance under the contract.
8. Make final decisions under the Suspension of Work clause.
9. Make equitable adjustments.
10. Authorize change in amount of Payment Retention.
11. Approve subcontractors.
12. Approve payment with deductions or final payment.

G.3 NOTIFICATION OF SUBCONTRACTING
The Contractor shall promptly notify the Contracting Officer upon entering into any subcontract arrangement.
The subcontractor shall have the experience and be equipped for such work. The Contractor and subcontractor shall fill out the SF 1413, Statement and Acknowledgement and submit to the Contracting Officer. Other written notification shall include as a minimum:
A. The name, address and telephone number of the subcontractor.
B. The date upon which the subcontract was entered into and its duration.
C. A detailed description of the work being subcontracted including a listing of contract items, units, etc., as appropriate.
D. Documentation of the subcontractor's representative authority.
E. A copy of the Statement of Acknowledgement form (SF-1413) must be provided to the Contracting Officer prior to any subcontractor work beginning.
Subcontracting any portion of the task order shall not relieve the Prime Contractor of any responsibility under this task order. Any subcontract agreement shall contain all terms and conditions of the prime task order.
G.4 INVOICE PROCESSING PLATFORM (IPP)
All invoices are to be submitted via the electronic Invoice Processing Platform (IPP) at www.ipp.gov.
Contractors shall submit all invoices electronically via IPP. Paper copies of invoices will not be accepted. The Contractor must also attach a detailed invoice in IPP.

SECTION H--SPECIAL CONTRACT REQUIREMENTS
H.1 FAR 52.236-9 PROTECTION OF EXISTING VEGETATION, STRUCTURES, EQUIPMENT,
UTILITIES, AND IMPROVEMENTS (APR 1984)
(a) The Contractor shall preserve and protect all structures, equipment, and vegetation (such as trees, shrubs, and grass) on or adjacent to the work sites, which are not to be removed and which do not unreasonably interfere with the work required under this contract. The Contractor shall only remove trees when specifically authorized to do so, and shall avoid damaging vegetation that will remain in place. If any limbs or branches of trees are broken during contract performance, or by the careless operation of equipment, or by workman, the Contractor shall trim those limbs or branches with a clean cut and paint the cut with a tree-pruning compound as directed by Contracting Officer.
(b) The Contractor shall protect from damage all existing improvements and utilities (1) at or near the work site and (2) on adjacent property of a third party, the location of which are made know to or should be known by the Contractor. The Contractor shall repair any damage to those facilities, including those that are the property of a third party, resulting from failure to comply with the requirements of this contract or failure to exercise reasonable care in performing the work. If the Contractor fails or refuses to repair the damage promptly, the Contracting Officer may have the necessary work performed and charge the cost to the Contractor.

(1) To unsuccessful bidders as soon as practicable after the opening of bids, and (2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.
(c) The amount of the bid guarantee shall be 20 percent of the bid price or $50,000.00 whichever is less.
(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.
In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.
I.2 PERFORMANCE AND PAYMENT BONDS-CONSTRUCTION (OCT 2010) (Applicable for task orders awarded $150,000.00 or over)
(a) Definitions. As used in this clause- Original contract price means the award price of the contract; or, for requirements contracts, the price payable for the estimated total quantity; or, for indefinite-quantity contracts, the price payable for the specified minimum quantity. Original contract price does not include the price of any options, except those options exercised at the time of contract award.
(b) Amount of required bonds. Unless the resulting contract price is $150,000 or less, the successful offeror shall furnish performance and payment bonds to the Contracting Officer as follows:
(1) Performance bonds (Standard Form 25). The penal amount of performance bonds at the time of contract award shall be 100 percent of the original contract price.
(2) Payment Bonds (Standard Form 25A). The penal amount of payment bonds at the time of contract award shall be 100 percent of the original contract price.
(3) Additional bond protection.
(i) The Government may require additional performance and payment bond protection if the contract price is increased. The increase in protection generally will equal 100 percent of the increase in contract price.

(ii) The Government may secure the additional protection by directing the Contractor to increase the penal amount of the existing bond or to obtain an additional bond.
(c) Furnishing executed bonds. The Contractor shall furnish all executed bonds, including any necessary reinsurance agreements, to the Contracting Officer, within the time period specified in the Bid Guarantee provision of the solicitation, or otherwise specified by the Contracting Officer, but in any event, before starting work.
(d) Surety or other security for bonds. The bonds shall be in the form of firm commitment, supported by corporate sureties whose names appear on the list contained in Treasury Department Circular 570, individual sureties, or by other acceptable security such as postal money order, certified check, cashier's check, irrevocable letter of credit, or, in accordance with Treasury Department regulations, certain bonds or notes of the United States. Treasury Circular 570 is published in the Federal Register or may be obtained from the:
U.S. Department of the Treasury, Financial Management, Service Surety Bond Branch, 3700 East West Highway, Room 6 F01, Hyattsville, MD 20782.

(e) Notice of subcontractor waiver of protection (40 U.S.C. 3133(c)). Any waiver of the right to sue on the payment bond is void unless it is in writing, signed by the person whose right is waived, and executed after such person has first furnished labor or material for use in the performance of the contract.
I.3 FAR 52.223-2 AFFIRMATIVE PROCUREMENT OF BIOBASED PRODUCTS UNDER SERVICE
AND CONSTRUCTION CONTRACTS (SEPT 2013)
(a) In the performance of this contract, the contractor shall make maximum use of biobased products that are United States Department of Agriculture (USDA)-designated items unless—
(1) The product cannot be acquired—
(i) Competitively within a time frame providing for compliance with the contract performance schedule;
(ii) Meeting contract performance requirements; or
(iii) At a reasonable price.
(2) The product is to be used in an application covered by a USDA categorical exemption (see 7 CFR 3201.3(e)). For example, all USDA-designated items are exempt from the preferred procurement requirement for the following:
(i) Spacecraft system and launch support equipment.
(ii) Military equipment, i.e., a product or system designed or procured for combat or combat-related missions.
(b) Information about this requirement and these products is available at http://www.biopreferred.gov.
(c) In the performance of this contract, the Contractor shall—
(1) Report to http://www/sam.gov, with a copy to the Contracting Officer, on the product types and dollar value of any USDA-designated biobased products purchased by the Contractor during the previous Government fiscal year, between October 1 and September 30;

(2) Submit this report no later than—
(i) October 31 of each year during contract performance; and
(ii) At the end of contract performance.
