SECTION C—DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
C.1 STATEMENT OF WORK
A. The intent of this project is to repair a large fill slope failure on a forest road as shown on the drawings. The work includes, but is not limited to: construction staking, installing and removing traffic control devices, excavation, earthwork geotextiles, construction of a special rock embankment, base, and surface course materials, and seeding & mulching.

C.2 LOCATION OF WORK
Coordinates:

Directions:
o From Granite Falls, WA travel East on the Mtn. Loop Highway for approximately 6 miles.
o Turn left on FSR 41 (Green Mountain Rd) and continue for 6.5 miles to the project site.

C.7 CONTRACT TIMING AND RESTRICTIONS
A. Noise restriction:
a. From April 1st to September 23rd, all activities that generate noise levels above 92 decibels shall occur between 2 hours after sunrise and 2 hours before sunset.
b. Any activities requiring road closure shall be part of a Traffic Control Plan which will be submitted to the CO at least twenty-one (21) calendar days in advance.
c. Contractor is authorized to close the roadway for the duration of the project.

i. A preliminary closure sign shall be posted at least 14 days prior to closing the road. The preliminary closure sign shall meet MUTCD requirements for reflectivity, shall be orange on black, and shall display the dates for the road closure. Submit a sign for review and approval.
ii. The road closure must be identified by a ROAD CLOSED sign (MUTCD R11-2) at the point of closure.
d. No work is allowed on weekends or federal holidays without written request by the
Contractor to the CO for review and approval.
C.8 APPLICABLE PUBLICATIONS AND FORMS
Publications and forms listed can be obtained via the Internet, ordered through the U.S.
Government Printing Office, or through the Mt. Baker-Snoqualmie National Forest. Supplements or amendments to listed publications from any organizational level may be issued throughout the performance period. The contractor shall immediately implement those changes that result in a decrease or no change in cost and notify the contracting officer in writing of such changes. Before implementing any change that will result in an increase in cost, the contractor shall submit to the contracting officer a price proposal within thirty (30) calendar days following receipt of the change by the Contractor.

F.2 FAR 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK
(APR 1984)
The Contractor shall be required to (a) commence work under this contract within ten (10) calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than October 30, 2020.
The time stated for completion shall include final cleanup of the premises.

SECTION G--CONTRACT ADMINISTRATION DATA
G.1 FAR 52.236-26 PRECONSTRUCTION CONFERENCE (FEB 1995)
If the Contracting Officer decides to conduct a preconstruction conference, the successful offeror will be notified and will be required to attend. The Contracting Officer’s notification will include specific details regarding the date, time, and location of the conference, any need for attendance by subcontractors, and information regarding the items to be discussed.
G.2 DESIGNATION OF CONTRACTING OFFICER’S REPRESENTATIVE
The Contracting Officer will designate a Contracting Officer's Representative (COR) at the time of contract award.
The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.
The Contracting Officer should be informed as soon as possible of any actions or inactions by the Contractor or the Government which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual task assignments which were issued by the COR provided they do not affect the delivery schedule or performance period stated in the contract).
On all matters that pertain to the contract terms the Contractor must communicate with the Contracting Officer. Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.
The COR is delegated full authority under this contract except for the following actions which are reserved for the Contracting Officer:
1. Approve Change Orders and Modifications
2. Take Action to terminate the contract for default or Government convenience
3. Make contract adjustments under the Different Site Conditions clause
4. Grant extensions of contract time.
5. Approve assignment of claims.
6. Make final decisions under the Disputes clause
7. Make final acceptance under the contract.
8. Make final decisions under the Suspension of Work clause.
9. Make equitable adjustments.
10. Authorize change in amount of Payment Retention.
11. Approve subcontractors.
12. Approve payment with deductions or final payment.
13. Approve use and possession prior to completion.
14. Enforce the warranty provisions.

G.3 NOTIFICATION OF SUBCONTRACTING
The Contractor shall promptly notify the Contracting Officer upon entering into any subcontract arrangement. The subcontractor shall have the experience and be equipped for such work. The Contractor and subcontractor shall fill out the SF 1413, Statement and Acknowledgement and submit to the Contracting Officer. Other written notification shall include as a minimum:
A. The name, address and telephone number of the subcontractor.
B. The date upon which the subcontract was entered into and its duration.
C. A detailed description of the work being subcontracted including a listing of contract items, units, etc., as appropriate.
D. Documentation of the subcontractor's representative authority.
E. A copy of the Statement of Acknowledgement form (SF-1413) must be provided to the Contracting Officer prior to any subcontractor work beginning.
Subcontracting any portion of the task order shall not relieve the Prime Contractor of any responsibility under this task order. Any subcontract agreement shall contain all terms and conditions of the prime task order.
G.4 INVOICE PROCESSING PLATFORM (IPP)
All invoices are to be submitted via the electronic Invoice Processing Platform (IPP) at www.ipp.gov.
Contractors shall submit all invoices electronically via IPP. Paper copies of invoices will not be accepted. The Contractor must also attach a detailed invoice in IPP.

SECTION H--SPECIAL CONTRACT REQUIREMENTS
H.1 FAR 52.236-4 PHYSICAL DATA (APR 1984)
Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.
A) The indications of physical conditions on the drawings and in the specifications are the result of site investigations by observation and measurements.
B) Weather conditions: Seasonal – Varies by season
a) Rainfall is typically lowest from June through September and picks up to its highest in
November and December.
b) It is not uncommon for this site to be snowed out from late fall through early spring.
C) Transportation facilities:
a) Mountain Loop Highway is a two-lane paved highway from Granite Falls to FSR 41.
b) FSR 41 is a single-lane paved road from MP 0 to 2.0 and a single lane gravel road from
MP 2.0 to project site. The road from MP 3.0 to the project site is rough with large potholes. Repairs to this section of road is subject to funding and may not be completed prior to construction.
c) Contractors are advised to visit the project prior to bidding.

H.2 FAR 52.236-9 PROTECTION OF EXISTING VEGETATION, STRUCTURES,
EQUIPMENT, UTILITIES, AND IMPROVEMENTS (APR 1984)
(a) The Contractor shall preserve and protect all structures, equipment, and vegetation (such as trees, shrubs, and grass) on or adjacent to the work sites, which are not to be removed and which do not unreasonably interfere with the work required under this contract. The Contractor shall only remove trees when specifically authorized to do so, and shall avoid damaging vegetation that will remain in place. If any limbs or branches of trees are broken during contract performance, or by the careless operation of equipment, or by workman, the Contractor shall trim those limbs or branches with a clean cut and paint the cut with a tree-pruning compound as directed by Contracting Officer.
(b) The Contractor shall protect from damage all existing improvements and utilities (1) at or near the work site and (2) on adjacent property of a third party, the location of which are made know to or should be known by the Contractor. The Contractor shall repair any damage to those facilities, including those that are the property of a third party, resulting from failure to comply with the requirements of this contract or failure to exercise reasonable care in performing the work. If the Contractor fails or refuses to repair the damage promptly, the Contracting Officer may have the necessary work performed and charge the cost to the Contractor.

PART II--CONTRACT CLAUSES
SECTION I--CONTRACT CLAUSES
I.1 FAR 52.228-1 BID GUARANTEE (SEP 1996) (Applicable for task order proposals valued at
$150,000.00 or more)
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds –
(1) To unsuccessful bidders as soon as practicable after the opening of bids, and (2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.
(c) The amount of the bid guarantee shall be 20 percent of the bid price or $ NA whichever is less.
(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.
(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.
I.2 FAR 52.228-15 PERFORMANCE AND PAYMENT BONDS – CONSTRUCTION
(OCT 2010) (Applicable for task orders awarded $150,000.00 or over)
(a) Definitions. As used in this clause—
“Original contract price” means the award price of the contract; or, for requirements contracts, the price payable for the estimated total quantity; or, for indefinite-quantity contracts, the price payable for the specified minimum quantity. Original contract price does not include the price of any options, except those options exercised at the time of contract award.
(b) Amount of required bonds. Unless the resulting contract price is $150,000 or less, the successful offeror shall furnish performance and payment bonds to the Contracting Officer as follows:
(1) Performance bonds (Standard Form 25). The penal amount of performance bonds at the time of contract award shall be 100 percent of the original contract price.
(2) Payment Bonds (Standard Form 25A). The penal amount of payment bonds at the time of contract award shall be 100 percent of the original contract price.

(3) Additional bond protection.
(i) The Government may require additional performance and payment bond protection if the contract price is increased. The increase in protection generally will equal 100 percent of the increase in contract price.
(ii) The Government may secure the additional protection by directing the Contractor to increase the penal amount of the existing bond or to obtain an additional bond.
(c) Furnishing executed bonds. The Contractor shall furnish all executed bonds, including any necessary reinsurance agreements, to the Contracting Officer, within the time period specified in the Bid Guarantee provision of the solicitation, or otherwise specified by the Contracting Officer, but in any event, before starting work.
(d) Surety or other security for bonds. The bonds shall be in the form of firm commitment, supported by corporate sureties whose names appear on the list contained in Treasury Department Circular 570, individual sureties, or by other acceptable security such as postal money order, certified check, cashier's check, irrevocable letter of credit, or, in accordance with Treasury Department regulations, certain bonds or notes of the United States. Treasury Circular 570 is published in the Federal Register or may be obtained from the:

(e) Notice of subcontractor waiver of protection (40 U.S.C. 3133(c)). Any waiver of the right to sue on the payment bond is void unless it is in writing, signed by the person whose right is waived, and executed after such person has first furnished labor or material for use in the performance of the contract.
I.3 FAR 52.223-2 AFFIRMATIVE PROCUREMENT OF BIOBASED PRODUCTS UNDER
SERVICE AND CONSTRUCTION CONTRACTS (SEPT 2013)
(a) In the performance of this contract, the contractor shall make maximum use of biobased products that are United States Department of Agriculture (USDA)-designated items unless—
(1) The product cannot be acquired—
(i) Competitively within a time frame providing for compliance with the contract performance schedule;
(ii) Meeting contract performance requirements; or
(iii) At a reasonable price.

(2) The product is to be used in an application covered by a USDA categorical exemption (see 7 CFR 3201.3(e)). For example, all USDA-designated items are exempt from the preferred procurement requirement for the following:
(i) Spacecraft system and launch support equipment.
(ii) Military equipment, i.e., a product or system designed or procured for combat or combat-related missions.
(b) Information about this requirement and these products is available at http://www.biopreferred.gov.
(c) In the performance of this contract, the Contractor shall—
(1) Report to http://www/sam.gov, with a copy to the Contracting Officer, on the product types and dollar value of any USDA-designated biobased products purchased by the Contractor during the previous Government fiscal year, between October 1 and September 30;
(2) Submit this report no later than—
(i) October 31 of each year during contract performance; and
(ii) At the end of contract performance.

Bridge — A structure, including supports, erected over a depression or an obstruction such as water along a road, a trail, or a railway and having a deck for carrying traffic or other loads.
Contractor — The individual or legal entity contracting with the Government for performance of prescribed work. In a timber sale contract, the contractor is the “Purchaser”.
Culvert — Any structure with a bottom, regardless of fill depth, depth of invert burial, or presence of horizontal driving surface, or any bottomless (natural channel) structure with footings that will not have wheel loads in direct contact with the top of the structure.
Drawings — (Public Works Contracts) Design sheets or fabrication, erection, or construction details submitted to the CO by the Contractor according to FAR Clause 52.236‐21 Specifications and Drawings for Construction. Also refers to submissions and submittals.
Notice to Proceed — (Public Works Contracts) Written notice to the Contractor to begin the contract work.
Right‐of‐Way — A general term denoting (1) the privilege to pass over land in some particular line (including easement, lease, permit, or license to occupy, use, or traverse public or private lands), or (2) Real property necessary for the project, including roadway, buffer areas, access, and drainage areas.
Solicitation—(Public Works Contracts) The complete assembly of documents (whether attached or incorporated by reference) furnished to prospective bidders.
Add the following definitions:
Adjustment in Contract Price — “Equitable adjustment,” as used in the Federal Acquisition Regulations, or
“construction cost adjustment,” as used in the Timber Sale Contract, as applicable.
Change — “Change” means “change order” as used in the Federal Acquisition Regulations, or “design change” as used in the Timber Sale Contract.
Forest Service — The United States of America, acting through the Forest Service, U.S. Department of
Agriculture.
Neat Line — A line defining the proposed or specified limits of an excavation or structure.
Pioneer Road — Temporary construction access built along the route of the project.
Purchaser — The individual, partnership, joint venture, or corporation contracting with the Government under the terms of a Timber Sale Contract and acting independently or through agents, employees, or subcontractors.
Protected Streamcourse — A drainage shown on the plans or timber sale area map that requires designated mitigation measures.
Road Order — An order affecting and controlling traffic on roads under Forest Service jurisdiction. Road Orders are issued by a designated Forest Officer under the authorities of 36 CFR, part 260.
Shop Drawings — (Timber and Stewardship Contracts) Referred to as “Drawings” in FP‐14, include drawings, diagrams, layouts, schematics, descriptive literature, illustrations, lists or tables, performance and test data, and similar materials furnished by Purchaser to explain in detail specific portions of the work required by the contract.

Utilization Standards —
