About this file

This document is a set of Supplementary Conditions for a federal construction contract.

The "Brand Name or Equal" clause permits offerors to propose products equivalent to the brand name specified in the solicitation, provided they meet the salient physical, functional, or performance characteristics defined in the solicitation documents. Offerors proposing equal products must clearly identify the item by brand name and make/model number, include descriptive literature with illustrations or drawings, and describe any modifications planned to conform to requirements. The Contracting Officer will evaluate equal products based on information furnished by the offeror or reasonably available to the Contracting Officer and is not responsible for locating additional information. Unless explicitly indicated as an "equal" product, the offeror must provide the brand name product referenced in the solicitation.

The contract specifies that the Contractor must commence work within 10 calendar days after receiving the notice to proceed, prosecute the work diligently, and complete all work ready for use within 924 calendar days, including final cleanup. The Contracting Officer will specify the completion timeline as either a number of days or a calendar date. Under the Physical Data clause, site investigation data is provided for informational purposes only, and the Contractor is responsible for independent verification of weather conditions, transportation facilities, and historical data. Additionally, the document includes CMMC (Cybersecurity Maturity Model Certification) policy requirements stating that contractors must achieve and maintain the required CMMC status level at award for all information systems processing, storing, or transmitting FCI or CUI, with CMMC levels 2 and 3 permitted to be conditional for up to 180 days and CMMC level 1 requiring final certification status for award.
