52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

The Government will award a Blanket Purchase Agreement resulting from this solicitation to the responsible Offeror whose offer, conforming to the solicitation, represents the best value to the Government, price and non-price factors considered.

NIST anticipates a single award to the Offeror who provides the Government with the best value, based upon an assessment of proposals against technical evaluation factors and price. In making the best value determination, price and non-price factors, when combined, shall be approximately equal in importance to price.

Technical Evaluation Factors

The proposal will be evaluated against the following technical evaluation factors:

TECHNICAL CAPABILITY 25 POINTS

PRODUCT QUALITY 25 POINTS

TRACKING SYSTEM 25 POINTS

PAST PERFORMANCE 25 POINTS

TECHNICAL CAPABILITY

Documentation shall be evaluated to determine that Offerors:

*Successfully meet or exceed all task requirements;

*Supply all required products and equipment;

*Perform all required maintenance;

*Perform cylinder upgrades;

*Supply all required cylinder sizes;

*Manufacture, provide testing for and deliver all in-house gases and a wide range of specialty gases; and

*Provide customer service support.

Documentation submitted shall be evaluated for compliance with the statement of work and overall feasibility.

In determining best value, preference shall be given to offerors who can provide Grades 5 and 6 gases as in-house gases.

PRODUCT QUALITY

Documentation shall be evaluated to determine that the manufacturing process for in-house and specialty gases minimizes cross-contamination and will meet specifications. Specifically, does the Contractor remove the contents of a cylinder or fill on top when the fill process is executed, and how does the offeror ensure that the final product will meet all statement of work requirements.

Supporting documentation shall be evaluated for consistency with the quality control procedures provided by the Contractor.

TRACKING SYSTEM

Documentation shall be evaluated to determine whether the proposed tracking system meets all required specifications and is a system that has been in use for at least two years. The Contractor’s processes and procedures on security and maintenance shall be evaluated for feasibility and compliance with the statement of work.

PAST PERFORMANCE

Evaluation of Past Performance shall be based on the references provided and/or the offeror’s recent and relevant procurement history with NIST, it’s affiliates, and/or other relevant references. Performance evaluation shall determine the overall quality of the services and end products provided by the Contractor.

Offerors with no relevant past performance shall not be rated favorably or unfavorably.

Price Evaluation

Proposed prices will be evaluated but not scored.

Evaluation of prices proposed for products and services in Attachment IV will determine whether the proposed prices are realistic, complete, and reasonable in relation to the solicitation requirements. Proposed prices must be entirely compatible with the technical proposal.

Proposed prices for specialty gases will be evaluated for realism and reasonableness and to further determine the offeror’s understanding with respect to manufacture and delivery of specialty gases.
