STATEMENT OF WORK
Statement of Work
Project Title: Upgrade Existing OR Suite for Fire Compliance Project Number: 546-22-143
1. PROJECT OVERVIEW
This is a construction project for the upgrade to the existing Operating Room (OR) Suite which shall be required to adhere to the fire code compliance at the Department of Veterans Affairs Medical Center in Miami, Florida. The contractor shall perform all work in accordance with the designed specifications and drawings provided.
The construction of the project entails demolition and preparation of the area, new structural and architectural adherence, installation of doors and hardware, active fire protection, plumbing, heating-ventilation-and-air conditioning (HVAC), electrical, fire alarm devices, and finishes.
Design Specifications and drawings have been prepared by an Architect & Engineering (A&E) firm to deliver the requested upgrade for project 546-22-143, Upgrade Existing OR Suite for Fire Compliance.
2. STATEMENT OF WORK (SOW)
The Contractor shall provide all labor, materials, equipment, and supervision necessary to renovate the Preventative Maintenance (PM) Shop and replace the existing aluminum canopy at the Department of Veterans Affairs Medical Center in Miami, Florida. All work shall be performed in accordance with the designed specifications and drawings provided.
General Requirements
The contractor shall:
1. Follow all designed specifications and drawings for this project.
2. Comply with all applicable local, state, and federal codes and regulations.
3. Implement and maintain appropriate Infection Control Risk Assessment (ICRA) measures throughout the project.
4. Coordinate all work with VA staff to minimize disruption to ongoing hospital operations.
5. Secure the area before the commencement of work according to the Medical Center Infection Control and Construction Policy Requirements.
6. Provide a cost-loaded schedule to COR after the issuance of the Notice to Proceed (NTP) and before the commencement of work.
Specific Work Items
Demolition and Preparation:
• Remove existing gypsum board, acoustical ceiling tiles, and electrical components as specified.
• Prepare surfaces for new installations.
Structural and Architectural:
• Install new metal stud framing for interior walls.
• Install 5/8" Type X gypsum board on new and existing framing.
• Install acoustic insulation in walls and above ceilings.
• Install new acoustical ceiling tiles and hard lid ceilings as specified.
Doors and Hardware:
• Install new hollow metal door frames and doors, including all specified hardware.
• Install door hold-open devices connected to the fire alarm system.
Fire Protection:
• Relocate existing sprinkler heads to accommodate the new layout.
• Seal all penetrations in new smoke partition walls.
Plumbing:
• Seal existing plumbing penetrations in new smoke partition walls.
HVAC:
• Modify existing ductwork as required for the new layout.
• Install new ductwork insulation.
• Install new smoke dampers as specified.
• Seal all HVAC penetrations in new smoke partition walls.
Electrical:
• Install new lighting fixtures, including LED recessed lights and exit signs.
• Install new receptacles and surface-mounted electrical boxes.
• Provide all necessary conduit and wiring for new electrical components.
• Make minimal adjustments to existing panelboards as required.
Communications:
• Install new voice/data outlets.
• Provide and install all necessary conduit and Cat 6A cabling for communication systems.
Fire Alarm:
• Install new fire alarm devices, including smoke detectors, duct smoke detectors, and speaker strobes.
• Connect door hold-open devices to the fire alarm system.
• Provide all necessary wiring and connections to integrate new devices with the existing fire alarm system.
Finishes:
• Paint all new and disturbed wall surfaces.
• Repair and refinish any adjacent surfaces damaged during construction.
Project Close-out
• Perform all required testing and commissioning of installed systems.
• Provide all necessary documentation, including as-built drawings and operation manuals.
• Clean and prepare the area for VA use.
The contractor shall coordinate closely with the VA project manager COR and adhere to all VA policies and procedures throughout the duration of the project. All work must be completed in accordance with the project schedule and to the satisfaction of the VA.
3. SPECIAL REQUIREMENTS
• VA Police will issue identification badges to contractors, employees, and subcontractors which shall always be worn when on VA Property.
• The Contractor shall provide a list of all personnel who will participate in the project. Personnel shall be subjected to a background investigation before commencement. After the background check has been completed identification badges will be issued.
• The Contractor shall keep the area cleaned daily and haul away all construction debris. All materials and construction debris must be in a covered cart when entering and exiting the building.
4. QUALIFICATION / CERTIFICATION
• The Contractor shall be a State of Florida Certified General Contractor.
• The Electrical Subcontractor shall be a State of Florida Certified Electrical Contractor.
• The contractor and all contractor employees must have taken the Occupational Safety and Health
Administration (OSHA) Certified 30/10-hour construction safety course and show documented proof. The contractor shall designate a “competent person” in accordance with 29 CFR 1926. 32(f) which states, “One who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous or dangerous to employees and who has the authorization to take prompt corrective measures to eliminate them”. The contractor shall instruct each of his employees in the recognition and avoidance of unsafe conditions and the regulations applicable to this work environment to control or eliminate any hazards or other exposure to illness or injury.
Additionally, the contractor shall comply with the following requirements:
• Develop a plan detailing project-specific fire-safety measures.
• Maintain site and building access free and unobstructed to facility emergency services.
• Separate temporary facilities from existing buildings and new construction by appropriate distances.
• All temporary construction partitions must meet fire safety requirements.
• Temporary heating and electrical installations must comply with OSHA 1926, National Fire Protection
Association (NFPA) 241, and NFPA 70.
• Means of egress shall not be blocked. Egress routes for construction workers must be maintained free and unobstructed.
• Contractor-furnished fire extinguishers must be provided and maintained in construction areas and temporary storage areas.
• Flammable and combustible liquids must be stored, disposed, and used in accordance with OSHA 1926, NFPA
241, and NFPA 30.
• Existing fire protection must not be impaired. Provide fire watch for impairments more than four (4) hours in 24 hours.
• Prevent accidental smoke detector operation.
• Perform Hot Work in accordance with NFPA 241 and NFPA 51B.
• Maintain all construction permits visible and updated as required by the MVAMC Safety Office and Infection
Control Department.
• Prohibit smoking in and adjacent to construction areas.
• Dispose of waste and debris from buildings daily.
• Follow all additional requirements as specified in the MVAMC Construction Policy.
5. EQUIPMENT
• All Equipment, tools, etc., shall be maintained while on the project and shall be adequate, in quality and capacity for proper execution of work.
• Under no circumstances tools or equipment shall be left unattended.
6. SCHEDULING AND HOURS OF WORK
• All work in areas involved shall be scheduled with the COR. Work shall be scheduled for proper execution to completion of this contract.
• Hours of Work: The contractor will perform work from 7:00 am – 3:30 pm Monday through Friday. No work shall be performed during U.S. Federal Holidays. Normal duty hours are 7:00 am – 3:30 pm Monday through Friday except for U.S. Federal Holidays.
• All shutdowns involving temporary impairment of utilities shall be requested in writing to the COR three (3) weeks in advance. Shutdowns shall be considered as an activity in the contractor schedule.
• The following list addresses the kind of shutdowns or service interruptions that shall require advanced notice:
o Electrical Systems shutdown including Normal or Emergency Power.
o Fire Suppression Systems: Sprinkler shutdowns lasting over four (4) hours require notification and concurrence from the VISN Safety office. Fire Alarm work shall be conducted by Simplex.
o Parking.

14. PERIOD OF PERFORMANCE

• VA Police will issue identification badges to contractors, employees, and subcontractors which shall always be worn when on VA Property.
• The Contractor shall provide a list of all personnel who will participate in the project. Personnel shall be subjected to a background investigation before commencement. After the background check has been completed identification badges will be issued.
• The Contractor shall keep the area cleaned daily and haul away all construction debris. All materials and construction debris must be in a covered cart when entering and exiting the building.
15. QUALIFICATION / CERTIFICATION
• The Contractor shall be a State of Florida Certified General Contractor.
• The Electrical Subcontractor shall be a State of Florida Certified Electrical Contractor.
• The contractor and all contractor employees must have taken the Occupational Safety and Health
Administration (OSHA) Certified 30/10-hour construction safety course and show documented proof. The contractor shall designate a “competent person” in accordance with 29 CFR 1926. 32(f) which states, “One who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous or dangerous to employees and who has the authorization to take prompt corrective measures to eliminate them”. The contractor shall instruct each of his employees in the recognition and avoidance of unsafe conditions and the regulations applicable to this work environment to control or eliminate any hazards or other exposure to illness or injury.
Additionally, the contractor shall comply with the following requirements:
• Develop a plan detailing project-specific fire-safety measures.
• Maintain site and building access free and unobstructed to facility emergency services.
• Separate temporary facilities from existing buildings and new construction by appropriate distances.
• All temporary construction partitions must meet fire safety requirements.
• Temporary heating and electrical installations must comply with OSHA 1926, National Fire Protection
Association (NFPA) 241, and NFPA 70.
• Means of egress shall not be blocked. Egress routes for construction workers must be maintained free and unobstructed.
• Contractor-furnished fire extinguishers must be provided and maintained in construction areas and temporary storage areas.
• Flammable and combustible liquids must be stored, disposed, and used in accordance with OSHA 1926, NFPA 241, and NFPA 30.
• Existing fire protection must not be impaired. Provide fire watch for impairments more than four (4) hours in 24 hours.
• Prevent accidental smoke detector operation.
• Perform Hot Work in accordance with NFPA 241 and NFPA 51B.
• Maintain all construction permits visible and updated as required by the MVAMC Safety Office and Infection
Control Department.
• Prohibit smoking in and adjacent to construction areas.
• Dispose of waste and debris from buildings daily.
• Follow all additional requirements as specified in the MVAMC Construction Policy.
16. EQUIPMENT
• All Equipment, tools, etc., shall be maintained while on the project and shall be adequate, in quality and capacity for proper execution of work.
• Under no circumstances tools or equipment shall be left unattended.
17. SCHEDULING AND HOURS OF WORK
• All work in areas involved shall be scheduled with the COR. Work shall be scheduled for proper execution to completion of this contract.
• Hours of Work: The contractor will perform work from 7:00 am – 3:30 pm Monday through Friday. No work shall be performed during U.S. Federal Holidays. Normal duty hours are 7:00 am – 3:30 pm Monday through Friday except for U.S. Federal Holidays.
• All shutdowns involving temporary impairment of utilities shall be requested in writing to the COR three (3) weeks in advance. Shutdowns shall be considered as an activity in the contractor schedule.
• The following list addresses the kind of shutdowns or service interruptions that shall require advanced notice:
o Electrical Systems shutdown including Normal or Emergency Power.
o Fire Suppression Systems: Sprinkler shutdowns lasting over four (4) hours require notification and concurrence from the VISN Safety office. Fire Alarm work shall be conducted by Simplex.
o Parking.

52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL EMPLOYMENT OPPORTUNITY FOR
CONSTRUCTION (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. (c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction," and (3) its efforts to meet the goals.
The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.
(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. (1) Name, address, and telephone number of the subcontractor;
(2) Employer's identification number of the subcontractor;
(3) Estimated dollar amount of the subcontract;
(4) Estimated starting and completion dates of the subcontract; and

52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS (MAY 2014)
(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers.
(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.

52.228-1 BID GUARANTEE (SEP 1996)
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds—
(1) To unsuccessful bidders as soon as practicable after the opening of bids; and
(2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.
(c) The amount of the bid guarantee shall be percent of the bid price or , whichever is less.
(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.
(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.
52.228-17 INDIVIDUAL SURETY—PLEDGE OF ASSETS (BID GUARANTEE) (FEB 2021)
(a) Offerors shall obtain from each person acting as an individual surety on a bid guarantee—
(1) A pledge of assets that meets the eligibility, valuation, and security requirements described in the Federal Acquisition Regulation (FAR) 28.203–1; and
(2) Standard Form 28, Affidavit of Individual Surety.
