About this file

This document contains two federal contracting requirements sections: Safety and Environmental Record standards and Limitations on Subcontracting monitoring procedures for a VA solicitation.

The Safety and Environmental Record section establishes mandatory qualification criteria for all bidders and offerors. Contractors must certify they have no more than three serious OSHA violations, or one repeat violation, or one willful OSHA or EPA violation within the past three years. All bidders must submit their current Experience Modification Rate (EMR) equal to or less than 1.0, obtained from their insurance carrier on company letterhead. Self-insured contractors or those unable to obtain EMR ratings from their insurance company must obtain ratings from the National Council on Compensation Insurance, Inc. (NCCI) using form ERM-6, or from state-run worker's compensation insurance rating bureaus for CA, DE, MI, NJ, ND, OH, PA, WA, WY, and PR. The government will conduct a Determination of Responsibility for the apparent awardee prior to award, using submitted information along with OSHA and EPA online inspection databases. Failure to affirm compliance or submit required documentation results in a "Non-Responsibility" determination and ineligibility for award. This requirement applies to all subcontracting tiers, with prime contractors responsible for verifying subcontractor responsibility.

The Limitations on Subcontracting section addresses compliance monitoring for contracts resulting from this VA Acquisition Regulation (VAAR) 852.219-10 Total Service-Disabled Veteran-Owned Small Business Set-Aside solicitation. The Contracting Officer may engage support contractors to assess the prime contractor's compliance with subcontracting limitations and work performance percentage requirements. Support contractors must sign Information Protection and Non-Disclosure agreements and, if performing advisory services under FAR 2.101, must execute additional proprietary information protection agreements per FAR 9.505-4. The contractor is required to provide full cooperation and access to all records necessary for compliance assessment.
