SPECIALIST AND CONTRACTING OFFICER ISSUING THE SOLICITATION ABOUT

ANY ASPECT OF THIS REQUIREMENT PRIOR TO CONTRACT AWARD.

6. ACCURACY IN PROPOSALS

Proposals must set forth full, accurate, and complete information as required by this RFP, (including attachments).

7. DETERMINATION OF RESPONSIBILITY

A Determination of Responsibility will be conducted for the apparent awardee prior to award of the project. The apparent awardee must be determined as "responsible" by the Contracting Officer. See FAR 9.104-1 for the minimum standards to be determined responsible. The required information for proposal submission, along with other information obtained from Government systems, such as, but not limited to the OSHA and EPA online inspection history databases, as well as any other information the Contracting Officer has determined to be valid, will be used to make the Determination of Responsibility. Note: Any information received by the Government that would be cause for a negative Determination of Responsibility may make the offeror ineligible for award.

The contracting officer may obtain information regarding the responsibility of the prospective awardee, including requesting pre-award surveys, when necessary, promptly after receipt of offers in accordance with FAR 9.105-1—Obtaining Information.

The prospective offeror shall be prepared to provide documentation to support this determination within two business days following the request.

8. VETS 4212

Title 38, USC Section 4212(d), codified at 41 CFR Section 61-300, requires that federal contractors report, at least annually, the number and category of veterans who are within their workforce. Submission of the VETS-4212 reporting information can be done electronically at: https://www.dol.gov/agencies/vets/programs/vets4212. Award cannot be made unless the awardee has filed their VETS-4212 report. Therefore, all offerors are encouraged to file every year. The Contracting Officer may request a copy of the email confirmation of receipt notification, prior to awarding the project.

9. SYSTEM FOR AWARD MANAGEMENT (SAM)

Federal Acquisition Regulations require that federal contractors be registered in the System for Award Management (SAM) database (https://sam.gov) and enter all mandatory information into the system. Offerors are required to be registered in SAM at the time an offer is submitted to comply with the annual representations and certifications requirements (see FAR 4.1102).

10. REVIEW REQUIRED REGISTRATION WITH CONTRACTOR PERFORMANCE

ASSESSMENT REPORTING SYSTEM (CPARS)

As prescribed in Federal Acquisition Regulation (FAR) Part 42.1502(e), the Department of Veterans Affairs (VA) evaluates contractor past performance on all construction contracts that exceed $750,000 and shares those evaluations with other Federal Government contract specialists and procurement officials. The FAR requires that the contractor be provided an opportunity to comment on past performance evaluations prior to each report closing. To fulfill this requirement, VA uses an online database, CPARS, which is maintained by the Naval Seal Logistics Center in Portsmouth, Virginia.

CPARS is available to all Federal agencies and is the system used to collect and retrieve performance assessment reports used in source selection determinations.

CPARS also includes access to the federal awardee performance and integrity information system (FAPIIS). FAPIIS is a web-enabled application accessed via CPARS for contractor responsibility determination information.

Each contractor whose contract award is estimated to exceed $750,000 is required to register with CPARS database (https://cpars.gov). Help registering can be obtained by contacting Customer Support Desk @ DSN: 684-1690 or COMM: 207- 438-1690.

Registration should occur no later than thirty days after contract award and must be kept current should there be any change to the contractor’s registered representative.

For contracts with a period of one year or less, the contracting officer will perform a single evaluation when the contract is complete. For contracts exceeding one year, the contracting officer will evaluate the contractor’s performance annually. Interim reports will be filed each year until the last year of the contract, when the final report will be completed. The report shall be assigned in CPARS to the contractor’s designated representative for comment. The contractor representative will have sixty days to submit any comments and re-assign the report to the VA contracting officer.

Failure to have a current registration in the CPARS database, or to re-assign the report to the VA contracting officer within those sixty days, will result in the Government’s evaluation being placed on file in the database with a statement that the contractor failed to respond.

11. BACKGROUND INVESTIGATIONS AND SPECIAL AGREEMENT CHECKS

All contractor employees are subject to the same level of investigation as VA employees who have access to VA Sensitive Information. The level of background investigation is commensurate with the level of access needed to perform all work as identified in the solicitation documents. This requirement is applicable to all subcontractor personnel requiring the same access. As per VA Directive 0710, costs of background investigations will be borne by the contractor. Please be advised that the awardee will need to coordinate with the VA Medical Center concerning badging requirements.

12. HHS/OIG EXCLUSIONS

To ensure that the individuals providing services under the contract have not engaged in fraud or abuse regarding Sections 1128 and 1128A of the Social Security Act regarding federal health care programs, the contractor is required to check the Exclusions Database – U.S. Department of Health and Human Services (HHS), Office of Inspector General (OIG), List of Excluded Individuals/Entities on the website (https://exclusions.oig.hhs.gov) for each person providing services under this contract.

Further, the Contractor is required to certify in its proposal that all persons listed in the contractor’s proposal have been compared against the OIG list and are NOT listed.

During the performance of this contract the contractor is prohibited from using any individual or business listed on the List of Excluded Individuals/Entities.

https://cpars.gov/

14. REFERENCES TO VA ENGINEER, RESIDENT ENGINEER, OR PROJECT

MANAGER

Any reference contained within the solicitation/contract specifications and/or drawings to the “VA Engineer,” “Resident Engineer,” or “Project Manager” or their abbreviations shall be replaced with “Contracting Officer’s Representative (COR).”

15. PRE-CONSTRUCTION CONFERENCE

Before any work is started, a Pre-Construction Conference between the Contractor, Contracting Officer, and Project Engineer will be arranged through the Contracting Officer.

Such matters as work commencement, sequence of work, estimated time for accomplishment, subcontractor information, and the overall responsibilities of the Contractor, Contracting Officer, and Project Engineer in the fulfillment of all aspects of the contract will be discussed.

PROPOSAL PREPARATION INSTRUCTIONS

For a proposal to be considered, offerors must strictly comply with all instructions outlined in this solicitation. Failure to furnish proposals that comply with the instructions, at the predetermined due date for submission, may result in elimination from consideration for award. Furthermore, all solicitation amendments (if any) must be acknowledged in accordance with FAR Clause 52.215-1--Instructions to Offerors.

The submission of the signed Standard Form (SF) 1442, Block 17, and Block 19 (Acknowledgment of Amendments) will constitute the offeror’s acceptance of the terms and conditions of the RFP, including attachments and any issued amendments.

The offeror shall be held responsible for the validity of all information supplied in his/her proposal, including information provided by potential subcontractors. Should subsequent investigation disclose that the fact and conditions were not as stated, the proposal may be rejected and receive no further consideration.

1. PROPOSAL SUBMISSION INSTRUCTIONS

Proposals must be submitted electronically via email and received no later than the time specified on the SF 1442, Page 1, Item 13A (subject to amendment of the date/time).

In no case shall statements such as “we comply with the requirements of the contract” or its equivalent be acceptable to meet the requirements of this request for proposal. A proposal that merely reiterates or promises to accomplish the requirements of the RFP without providing supporting rationale, will be considered unacceptable. It is the offeror’s responsibility to insure the completeness of the proposal.

All commitments made in the proposal may become a part of the resultant contract. The data submitted with each proposal should be complete and concise. Excessive reliance on promotional brochures is discouraged.

Offerors may, at the discretion of the Government, be asked to provide information for clarification purposes regarding their proposals. Requests for such clarification information do not constitute discussions.

3. BASIS FOR AWARD

This RFP is being issued in accordance with FAR Part 15. It is the Government’s intent to award one (1) firm-fixed price contract resulting from this solicitation to the responsible offeror whose offer, conforming to the solicitation, is fair and reasonable, within the Government’s funding limitations, and has been determined to be the most advantageous to the Government utilizing the Tradeoff (FAR 15.101-1) method of evaluation, non-price, price, and other factors considered. The proposals must conform to the solicitation requirements and judged to represent the Best Value to the Government.

Proposals will be subject to an initial review for determination of basic proposal preparation compliance and adequacy prior to providing the proposals to the board.

Non-compliance with the RFP requirements may be grounds to eliminate the proposal from further evaluation beyond the initial review.

The Government intends to evaluate proposals and award this requirement without discussions. However, the Government reserves the right to contact offerors and/or conduct discussions if determined necessary. Offerors should not assume that they will have an opportunity to revise their proposals after submission. If discussions are determined to be necessary, they shall be conducted in accordance with FAR 15.306.

The Contracting Officer may seek proposal clarification, if minor or clerical errors need to be resolved.

4. PROPOSAL EVALUATION CRITERIA

The term “technical,” as used herein, refers to non-price factors. The non-price technical evaluation factors for this acquisition are Technical Factor 1-4 with Price being Factor 5.

All non-priced factors are of equal importance to each other and, when all non-price factors are combined, are approximately equal to price.

TECHNICAL FACTOR 1 – TECHNICAL APPROACH

Proposal Requirements:

This factor will be used to assess an offeror’s understanding of the scope of work required for the project along with the appropriate plans that will ensure meeting or exceeding all project requirements in accordance with the statement of work, specifications, and drawings. The technical approach section shall include language that validates the offeror’s knowledge of this type of project and should not be written in general terms. NOTE: Vague, general narratives that include the restatement of the Statement of Work will be rated less favorably.

• Project approach: Submit a narrative describing the techniques, capabilities, capacity, and methods for this project to include coordination efforts between the trades and subcontractors and the timeline and phasing.

• Project schedule: Submit a preliminary (CPM) Critical Path Method schedule for Item 0001, base bid item, for all work required to satisfy the requirements of this project. The CPM schedule must be practicable, showing the order in which the Contractor proposes to perform the work, and the dates on which the Contractor contemplates starting and completing the several salient features of the work (acquiring materials and equipment, mobilization, demolition, installation, commissioning, etc.).

Assume a 9-20-2025 NTP date for the purposes of creating the schedule (may be different than actual). The schedule shall be in the form of a progress chart (Gantt chart) of a suitable scale to indicate appropriately the percentage of work scheduled for completion by any given point during the period. Most importantly, indicate the length of downtime required for any utilities affecting the operation of other parts of the facility on the schedule. The schedule shall show key milestone dates and switchover and start-up of equipment. The schedule is not included in the page limit.

The proposed “draft” project schedule shall not exceed the project duration stated on the solicitation (550 calendar days) and include divisions of work required to successfully complete the project:

o Identify the tasks required to execute the project, being as detailed as possible using a work breakdown structure to break down the tasks into manageable elements in the logical order of execution.

o Identify the time for each task.

o Clearly identify the Critical Path Method (CPM).

o Identify the material lead time that affects the CPM.

o Set start and finish times.

o Calculate the slack.

o Determine intermediate phases and total project duration.

• Risks: Submit a narrative on risk mitigation strategies and how risk will be managed for thorough and timely execution of the project. Provide proposed plan that minimizes the impact of construction on day-to-day hospital activities. Describe actions to be taken by the offeror if completion of work is anticipated to fall behind schedule. It is critical to the VA mission that services remain intact with minimal disruption.

Evaluation approach:

The Government will evaluate the extent to which the submitted information meets the Factor requirements and demonstrates their understanding of the project. The government will evaluate the offeror’s approach, schedule, and potential risks which demonstrates an understanding of this project.

a. Technical Factor 2 – Offeror Experience

Proposal Requirements:

This factor will be used to assess an offeror’s experience in performing construction work related specifically to water structures (tower). The offeror shall discuss recent and relevant construction projects that show construction experience with water structures (tower).

The offeror shall provide a minimum of three (3) and a maximum of five (5) recent and relevant projects of which the offeror was the prime contractor or a subcontractor with significant work on the project. If the offeror was the subcontractor on any of these projects, information must be provided to show the amount of work the offeror completed on that project.

For purposes of this evaluation criteria, relevant contracts are contracts that are similar in scope and magnitude to this project. Similar scope would include tasks that involve construction work of water structures, demolition, and underground water pipes.

Similar in magnitude is defined as construction projects of at least 5 million dollars or greater.

Recent is defined as projects that are more than 50% complete or have been completed within the last seven (7) years of the proposal due date. Only relevant and recent projects will be evaluated.

Evaluation approach:

The Government will evaluate the submitted information on the extent to which the offeror has demonstrated experience in performing recent construction projects that are similar in magnitude and scope to the current requirement. The Government will evaluate the submitted information to ensure the offeror has the experience to complete the project requirements.

b. Technical Factor 3 – Project Management

Proposal requirements:

The offeror will be evaluated based on their ability to implement construction phasing, Infection Control, Quality Control, Commissioning, and damage avoidance to facility.

Contractor shall provide all information as described below:

1. Plan to implement the phasing as indicated in the contract documents.

2. Plan for Infection Control (IC) and determination of infection control risk assessment for work outside the project area.

3. Plan for Quality Control (QC) monitoring procedures, including subcontractors.

4. Plan for implementing commissioning throughout the project and a description of the process.

5. Description of the precautions the contractor will take to avoid damage to the facility (include how pre-existing conditions will be documented) and the proposed remediation that will take place if any damage is done to existing elements.

Evaluation approach:

The government will evaluate the information provided by the offeror on the extent to which the management of the project will meet the requirements as indicated by the above information including construction phasing, Infection Control, Quality Control, Commissioning, and damage avoidance to facility.

c. Factor 4 – Past Performance

Proposal requirements:

Past performance will be evaluated to assess the risk associated with the offerors likelihood of success at performing the solicitations requirements as indicated by the offerors record of past performance under other contracts. Offerors are requested to provide the latest evaluation that is available from CPARS or if an evaluation is not available in CPARS, then the offeror shall provide a past performance questionnaire (PPQ) for all contracts for relevant projects submitted for factor 2. The offeror shall ensure that the instructions for the PPQ's as shown on the PPQ attachment are followed and adhered to.

The government will consider references from either inside or outside the federal government, so long as the performance is recent and relevant as previously defined.

The government may also consider past performance information from sources other than those provided by the offerors.

If the offeror believes that a request for a PPQ to be submitted by a client/COR will go unanswered before proposal closing date, the offeror shall complete and submit with the proposal the first page of the PPQ which provides contract and client/COR information for the respective project. The government may make attempts to contact the client/COR noted for the projects to obtain the PPQ information. Although the government may make attempts, it is not responsible for ensuring the completion of the PPQ information and the government will evaluate past performance even if complete information is not provided. Offeror should follow up with clients/CORs to ensure timely submittal of PPQs.

Evaluation approach:

Past performance will be evaluated on the quality of the offeror’s past performance with respect to the projects provided and any other information gathered by VA. The currency and relevance of the information, source of the information, context of the data and general trends in the contractor performance shall be considered.

In the case of an offeror without a record of recent or relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror will not be evaluated favorably or unfavorably on past performance and will be given a neutral rating.

Past performance evaluations may also be conducted using information obtained from CPARS other than what was submitted. Other sources may include but are not limited to inquiries of owner representatives, federal awardee performance, integrity information systems (FAPIIS), and any other known sources not provided by the offeror.

d. Factor 5 – Price

Proposal requirements:

Offeror shall submit a completed price schedule, a divisional breakdown sheet, and a draft schedule of values (SOV) including the phases using the draft project schedule previously submitted for Factor 1. The divisional breakdown sheet and SOV will be used to evaluate price for completeness.

Evaluation approach:

The government will evaluate price for completeness and reasonableness using the methods as described in FAR 15.404-1.

Price completeness: Price proposals will be evaluated to determine if the proposal contains costs to perform all tasks as required by the statement of work, specifications, and drawings.

Price reasonableness: Reasonableness will be established using any necessary price analysis techniques in FAR 15.404-1, including but not limited to comparison to historical prices, comparison to independent government cost estimate, and price competition obtained by the other offerors proposals submitted in response to this RFP, along with any other pricing tools/resources deemed necessary. A reasonable price represents an amount that a prudent person would pay in a competitive business environment.

The government reserves the right to cancel the solicitation in its entirety. Award cannot be made if the offerors price proposal exceeds available funding.
