About this file
This document is a sample state professional services contract for engineering services related to a precipitation analysis project in Oregon. The State of Oregon, through the Oregon Water Resource Department (OWRD), is seeking engineering services for a two-phase project. Phase 1 will produce a report and propose a plan for Phase 2, which will review Hydro-meteorological Report 57 for extreme precipitation in western Oregon. The key personnel required include a lead meteorology expert on atmospheric rivers and a lead project manager with expertise in western state hydrology. The Phase 1 report will summarize atmospheric river precipitation mechanics, analyze maximum potential precipitation by location, determine the effects of air/ocean temperature changes, and provide an initial review of the existing report.
The contract is a maximum, not-to-exceed allowance-based agreement for Phase 1, with a total contract amount not to exceed a specified dollar value. Payments will be made monthly based on the consultant's detailed invoices and acceptance of the services by the agency. The consultant must comply with all state and federal requirements, including insurance, nondiscrimination, and COVID-19 vaccination policies for workers.

(Architectural, Engineering, Photogrammetric Mapping, Transportation Planning and Land Surveying Services; Related Services)
THIS PROFESSIONAL SERVICES CONTRACT (the “Contract”) is between the State of Oregon, by and through its Department of Administrative Services, Procurement Services Division (“DAS PS”) on behalf of the Oregon Water Resource Department (“OWRD”), (collectively, the “Agency”), and:

(the “Consultant”). The Agency and Consultant are collectively referred to in this Contract as the "Parties" and individually as a “Party”.
This Contract sets forth the terms and conditions applicable to certain services to be performed by the Consultant related to completion of the following services (the “Services”):
The State if Oregon is requiring engineering services for two project phases. Phase 1 is for extreme atmospheric river precipitation analysis report. Phase 2 depends on resulting Phase 1 report and review Hydro-meteorological Report
(“HMR”) 57.
The purpose of Phase 1 project is to develop a current understanding of the extreme precipitation possible in Oregon, and how this would change with specific climate related and measurable factors. This project is critical and urgent for safety of Oregonians, not just below dams, but in any location that could be affected by changes in extreme flooding. The analysis and report will improve our understanding of the mechanics of precipitation in an extreme atmospheric river event. This work is consistent with adaptation and evaluation of climate change, directly supports planning for these effects, and is consistent with the Governor’s Executive Order 20-04.
The purpose of Phase 2 is being developed but will have the Principal Investigators review Hydro-meteorological Report 57 (Probable Maximum Precipitation – Pacific Northwest States) for consistency with current understanding of atmospheric river meteorology, and to determine extreme precipitation for western Oregon locations.
This Contract shall become effective on the date that the Contract is fully executed by the Parties and all required State of Oregon approvals have been obtained (the “Effective Date”). No Services shall be performed prior to the Effective Date. The Contract shall expire, unless otherwise terminated or extended, on (Insert Date). Generally, the Services to be performed by the Consultant consist of the following engineering services (the “Services”):
Agency projects are in two phases. Phase 1 project will produce report and propose a plan for completion of Phase 2 project.
The Services are more specifically described in the EXHIBIT A, Statement of Work.
