About this file

This document is Addendum 03 for Request for Qualifications (RFQ2024-01) issued by the Nampa & Meridian Irrigation District (NMID) for a Construction Manager/General Contractor (CM/GC) for the Ridenbaugh Canal Diversion Headworks Modernization Project located near Boise, Idaho. The Statement of Qualifications (SOQ) is due by 3:00 p.m. on November 6th, 2024, with a mandatory site visit previously held on October 16th. The project involves preconstruction, procurement, and construction management services, with potential interviews scheduled for November 18-20, 2024. All construction work packages will be subject to competitive bidding in accordance with Idaho Code, requiring bids from at least three qualified contractors.

The addendum clarifies several key points about the RFQ, including that project experience can include older projects but will be evaluated based on an 8-year timeline, and that financial statements should be handled confidentially. The CM/GC will be responsible for managing project phases and may bid on work packages, with the owner reserving the right to limit the amount of work the CM/GC can self-perform. The preconstruction services will involve attending various meetings, and the CM/GC must incorporate these labor hours into their Not-to-Exceed (NTE) fee estimate. Importantly, submitting comments on the draft contract will not impact proposal evaluations, as the document is primarily provided to help bidders understand owner expectations.

Relevant experience is limited to projects completed within the past 8 years; would you consider allowing projects completed within the past 10 years?
The SOQ does not place a timeline on the projects that can be used to describe the company’s experience or the experience of the staff. Please note any relevant project experience of key staff even if they were not employed at the time of work.

I.A.1 and 2 do place an 8 Year limitation for evaluation purposes. The result, if you have project experience that is older than 8 years it can be included in the proposal but for evaluation purposes I.A.1 and 2 there is an 8-year limitation as we want to ensure the project experience is relevant and current.

Are the “confidential” financial statements to be included on the USB?
No “confidential” financial statements should be handled consistent with III.A.4. “The CMGC must separately seal any financial information the CM/GC deems confidential and must …”

Section IV Item I. Evaluation Criteria (page 14) does not follow Section IV. SOQ Format items A-H (pages 10-13). Where do you want the items that are listed and scored in the evaluation, but are not included in Sections A-H? Such as Evaluation Criteria C. The Ability to self-perform work? Or Evaluation Criteria E. Proposers Project Approach?
All evaluation criteria should be included in the SOQ Format where it best fits. Evaluation Criteria C – Ability to Self Perform should be covered in Section IV.F. Proposed CM/GC’s Staff. Evaluation Criteria E. Proposers Project Approach should be fully addressed in Section IV.G. Statement of Approach.

When it says CM/GC – Can we provide CM services up front and then proceed to bid/GC the construction portion of the project (Possible conflict) or if we do the CM portion are we blocked from building it?

Are we better to wait for the RFP for construction next summer as the General Contractor CM/GC services are not separable. As stated in section II.A of the RFQ: “The selected CM/GC will perform, coordinate and manage Project preconstruction, procurement, construction, and related construction management services on behalf of NMID.”

As stated in section II.A.2. of the RFQ: “The CM/GC may bid on Work Packages for the Project.”

All construction work packages will be subject to competitive bidding in accordance with Idaho Code section 54-4511, which provides:

(5) For each portion of the work, competitive bids shall be solicited from not less than three (3) contractors or suppliers deemed to be qualified by the construction manager/general contractor.

All bids shall be opened publicly in the presence of a representative of the public entity for whom the project is undertaken and once opened, bids shall be subject to the public record requirements outlined in title 74, Idaho Code.

(6) All construction work, materials and equipment shall be awarded to the lowest responsive qualified bidder. For good cause, the public entity may approve the award of bids based upon fewer than three (3) bids.

(7) The construction manager/general contractor, or its subsidiaries and affiliated companies, may bid to perform construction work or to supply materials or equipment only if it holds a valid license pursuant to section 54-1902, Idaho Code, and for which it customarily self-performs or supplies such construction work, materials or equipment; provided, the public entity may limit the amount of work the construction manager/general contractor, including its subsidiaries and affiliated companies, may perform under the contract. Bids from the construction manager/general contractor and its subsidiaries or affiliated companies must be opened at the opening of any other bids.

To clarify the CM/GC’s preconstruction services scope as defined in the draft Agreement Exhibit G, which meetings will the CM/GC plan on attending during the preconstruction phase?
Please see the attached for a description of preconstruction meetings and who is expected to attend from the CM/GC. Please incorporate this scope of work and labor hours into the CM/GC Preconstruction NTE fee estimate in the RFQ proposal package.
