About this file

This document is an Addendum (Addendum 01) to a Request for Qualifications (RFQ2024-01) issued by the North Meridian Irrigation District (NMID) for a Construction Manager/General Contractor (CM/GC) project involving the Ridenbaugh Canal Diversion Headworks Modernization Project located near 3960 S. Eckert Road in Boise, Idaho. The RFQ seeks a qualified CM/GC to perform preconstruction, procurement, construction, and related construction management services, with the selected contractor able to bid on work packages for the project.

The addendum specifically addresses a question from Advancia Remediation Services, LLC regarding the CM/GC role and bidding process, clarifying that construction work packages will be subject to competitive bidding in accordance with Idaho Code section 54-4511. The bidding process requires soliciting competitive bids from at least three qualified contractors or suppliers, with bids to be opened publicly. The construction manager/general contractor and its subsidiaries may bid to perform work, provided they hold a valid license and customarily self-perform or supply the specified construction work, materials, or equipment, with the public entity retaining the right to limit the amount of work performed under the contract.

Advancia Remediation Services, LLC

When it says CM/GC – Can we provide CM services up front and then proceed to bid/GC the construction portion of the project (Possible conflict) or if we do the CM portion are we blocked from building it?

Are we better to wait for the RFP for construction next summer as the General Contractor CM/GC services are not separable. As stated in section II.A of the RFQ: “The selected CM/GC will perform, coordinate and manage Project preconstruction, procurement, construction, and related construction management services on behalf of NMID.”

As stated in section II.A.2. of the RFQ: “The CM/GC may bid on Work Packages for the Project.”

All construction work packages will be subject to competitive bidding in accordance with Idaho Code section 54-4511, which provides:

(5) For each portion of the work, competitive bids shall be solicited from not less than three (3) contractors or suppliers deemed to be qualified by the construction manager/general contractor.

All bids shall be opened publicly in the presence of a representative of the public entity for whom the project is undertaken and once opened, bids shall be subject to the public record requirements outlined in title 74, Idaho Code.

(6) All construction work, materials and equipment shall be awarded to the lowest responsive qualified bidder. For good cause, the public entity may approve the award of bids based upon fewer than three (3) bids.

(7) The construction manager/general contractor, or its subsidiaries and affiliated companies, may bid to perform construction work or to supply materials or equipment only if it holds a valid license pursuant to section 54-1902, Idaho Code, and for which it customarily self-performs or supplies such construction work, materials or equipment; provided, the public entity may limit the amount of work the construction manager/general contractor, including its subsidiaries and affiliated companies, may perform under the contract. Bids from the construction manager/general contractor and its subsidiaries or affiliated companies must be opened at the opening of any other bids.
