CLAUSES INCORPORATED BY FULL TEXT

52.204-21 BASIC SAFEGUARDING OF COVERED CONTRACTOR INFORMATION SYSTEMS (NOV 2021)

(a) Definitions. As used in this clause--

Covered contractor information system means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.

Federal contract information means information, not intended for public release, that is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government, but not including information provided by the Government to the public (such as on public websites) or simple transactional information, such as necessary to process payments.

Information means any communication or representation of knowledge such as facts, data, or opinions, in any medium or form, including textual, numerical, graphic, cartographic, narrative, or audiovisual (Committee on National Security Systems Instruction (CNSSI) 4009).

Information system means a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information (44 U.S.C. 3502).

Safeguarding means measures or controls that are prescribed to protect information systems.

(b) Safeguarding requirements and procedures.

(1) The Contractor shall apply the following basic safeguarding requirements and procedures to protect covered contractor information systems. Requirements and procedures for basic safeguarding of covered contractor information systems shall include, at a minimum, the following security controls:

(i) Limit information system access to authorized users, processes acting on behalf of authorized users, or devices (including other information systems).

(ii) Limit information system access to the types of transactions and functions that authorized users are permitted to execute.

(iii) Verify and control/limit connections to and use of external information systems.

(iv) Control information posted or processed on publicly accessible information systems.

(v) Identify information system users, processes acting on behalf of users, or devices.

(vi) Authenticate (or verify) the identities of those users, processes, or devices, as a prerequisite to allowing access to organizational information systems.

(vii) Sanitize or destroy information system media containing Federal Contract Information before disposal or release for reuse.

(viii) Limit physical access to organizational information systems, equipment, and the respective operating environments to authorized individuals.

(ix) Escort visitors and monitor visitor activity; maintain audit logs of physical access; and control and manage physical access devices.

(x) Monitor, control, and protect organizational communications (i.e., information transmitted or received by organizational information systems) at the external boundaries and key internal boundaries of the information systems.

(xi) Implement subnetworks for publicly accessible system components that are physically or logically separated from internal networks.

(xii) Identify, report, and correct information and information system flaws in a timely manner.

(xiii) Provide protection from malicious code at appropriate locations within organizational information systems.

(xiv) Update malicious code protection mechanisms when new releases are available.

(xv) Perform periodic scans of the information system and real-time scans of files from external sources as files are downloaded, opened, or executed.

(2) Other requirements. This clause does not relieve the Contractor of any other specific safeguarding requirements specified by Federal agencies and departments relating to covered contractor information systems generally or other Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order 13556.

(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial products or commercial services, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.

(End of clause)

If the prime quoter or intended subcontractor/partner submits a past performance example in which it served as a subcontractor, the prime/sub/partner shall detail clearly the work that it performed and the magnitude (dollar value) of that subcontracted work only. A Past Performance example that does not differentiate between the overall contract effort and the subcontractor effort may not be evaluated.

Failure of quoters to provide the required information and level of specificity may result in the contract reference not being evaluated.

With respect to joint ventures, the procuring activity will consider work done individually by each member of the joint venture as well as any work done by the joint venture itself previously. Joint venture references must meet the temporal requirements described in FAR 52.212-1 Addendum (within five years and a year of completed performance). Additionally, if a joint venture member submits a past performance reference, the joint venture member shall detail clearly the work that it performed in that effort and the magnitude (dollar value) of that work. A reference that does not differentiate between the overall contract effort and the joint venture member’s effort for that reference may not be evaluated. The quoter shall complete a “Past Performance Information Form” for each reference submitted. The form is an attachment to the solicitation.

In addition to the information requested above, quoters shall contact their past performance references and request that each reference complete the Past Performance Report Form attached to the solicitation and email the completed survey form directly to Justin Hall at justin.d.hall12.civ@us.navy.mil and Benjamin Fisher at Benjamin.d.fisher8.civ@us.navy.mil by the DUE DATE OF THIS SOLICITATION. 52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

The Government intends to award a Firm-Fixed-Price (FFP) Purchase Order as a result of this solicitation in accordance with FAR Part 12, FAR Subpart 13.5, and FAR 19.502-2. Award will be made to that vendor whose quote is considered most advantageous to the Government under the selection criteria set forth in this solicitation.

The Government intends to evaluate quotes and award a Purchase Order based on initial quotes. Therefore, the Vendor’s initial quote should contain the Vendor’s best terms from a non-price and price standpoint. However, the Government may contact any or all vendors with questions concerning their responses as permitted under FAR Part 12, FAR Subpart 13.5, and FAR 19.502-2.

The Government reserves the right to award an FFP Purchase Order without exchanges; or award a FFP Purchase Order after exchanges, whichever is in the best interest of the Government. Vendors are hereby instructed that, regardless of any language that may be used in this solicitation, the Government is NOT conducting this procurement under FAR Part 15. This procurement is being conducted under FAR Part 12, FAR Subpart 13.5, and

FAR 19.502-2.

The Government will conduct a Past Performance / Price Tradeoff source selection process in accordance with the evaluation criteria as set below. The evaluation of quotes will consider the Non-Price submission to be significantly more important than the Price submission.

The quotes will be evaluated for price reasonableness in accordance with FAR 13.106.

Although price is the least important evaluation factor, it has the potential to become more significant during the evaluation process. The degree of importance of price will increase with the degree of equality of the quote in relation to the other factors on which selection is to be based. The importance of price will also increase when a quoted price is so significantly high as to diminish the value to the Government that might be gained under the other aspects of the quote. If, at any stage of the evaluation, all Vendors are determined to have submitted equal, or virtually equal, non-price submissions, price could become the factor in determining which Vendor shall receive the award.

All quotes will be reviewed for timeliness. If the quote is received after the closing date and does not meet the criteria for “late submissions” in the solicitation, the quote will not be opened. Timely quotes will be reviewed for compliance to the solicitation. If the quote is not compliant to the solicitation, it will not be evaluated and the Vendor will be notified that the quote is non-responsive.

FACTOR I: FACILITY CLEARANCE

Factor I will receive a rating of Acceptable/Unacceptable based on its submission of the verification of its Top Secret Facilities Clearance Level meeting the requirements as detailed in FAR 52.212-1. This will be evaluated on an Acceptable/Unacceptable basis utilizing the “Technical Acceptable/Unacceptable” rating Table below. Offerors receiving an “Acceptable” rating will move on to Factor II for evaluation. Offerors receiving an “Unacceptable” rating will be considered un-awardable and will not be further evaluated for award consideration.

FACTOR II: TECHNICAL

Factor II will receive a rating of Acceptable/Unacceptable based on its submission of a current Lenel Certification that demonstrates vendor’s personnel are authorized Lenel technicians in accordance with the PWS. This will be evaluated on an Acceptable/Unacceptable basis utilizing the “Technical Acceptable/Unacceptable” rating Table below. Offerors receiving an “Acceptable” rating will move on to Factor III evaluation. Offerors receiving an “Unacceptable” rating will be considered un-awardable and will not be further evaluated for award consideration.

FACTOR III: PAST PERFORMANCE

The past performance evaluation factor assesses the degree of confidence the Government has in a vendor’s ability to meet the purchase order’s requirements based on the quality of a demonstrated record of recent and relevant performance. There are three aspects to the past performance evaluation: recency, relevancy, and quality. These are combined to establish a single performance confidence assessment rating for each offeror.

Past Performance Recency: Recency is the first aspect of the past performance evaluation and is the time period during which past performance references are considered relevant. Recency is critical to establishing the relevancy of past performance information. For purposes of this solicitation, recent past performance is performance that has taken place within five (5) years as of the issuance date of this solicitation. Performance outside of this stated period will not be considered for evaluation purposes.

Past Performance Relevancy: Regarding relevancy, each past performance reference under each vendor’s Past Performance submission will be evaluated to determine its scope and magnitude relative to the instant requirement.

The following definitions will apply to this evaluation:

● Scope: Experience in the areas described in the PWS.

● Magnitude: The similarity of the dollar value of actually performed work that exists between the PWS and the vendor’s referenced contracts during the stated five-year period established by the solicitation.

The references provided will be evaluated in the aggregate in order to allow vendors who may not have the entire scope and magnitude of the requirement under one individual contract to still be considered relevant if past performance with the full scope and magnitude of the requirement can be demonstrated within the allotted number of references as described above.

Past Performance Quality: The third aspect of the past performance evaluation is to establish the overall quality of the vendor’s past performance. The Government will review all past performance information collected and determine the quality of the vendors’s performance, including general trends and usefulness of the information, and will incorporate this into the performance confidence assessment.

Past Performance Confidence Assessment: The overall assigned rating for past performance will be the Past Performance Confidence Assessment rating, defined in the table below. The assignment of this rating will be based on the overall quality of the recent and relevant past performance and will also consider the source of the information, the context of the data, and general trends in the vendor’s performance. The quality of performance under a past performance reference that that has no relevance to the instant requirement will not be considered in the overall assessment of past performance confidence. Evaluation will focus only on work already performed. Work yet-to-be performed and work not reflecting one year of completed performance by the solicitation closing date will not be considered.

In the case of vendors for which there is no information on past contract performance or where past contract performance information is not available, the vendor may not be evaluated favorably or unfavorably on the past performance factor. In this case, the vendor’s past performance is unknown and assigned a performance confidence rating of “Neutral Confidence.” Although a vendor that lacks recent, relevant past performance may not be rated favorably or unfavorably with regard to past performance, the…
