Amendment 0001 Responses to Solicitation Questions and Solicitation Amendments
TASK ORDER 0001 QUESTIONS AND RESPONSES
STATEMENT OF WORK QUESTIONS
1. Section Number: SOW Chapter 1. Scope Section & Title: 1.B – Purpose Question: Does CMS intend that the contractor will develop, re-evaluate, and implement 5 outcome/efficiency measures per year or 5 measures over the 5-year period?
Response: Five measures over the 5-year period.
2. Section Number: 1.B Section & Title: Chapter 1. Scope/1.B - Purpose Question: The purpose statement is quite general. Will CMS be providing any more specific information as to which programs/initiatives that the new measures will support, or is the response to propose topics or measurement areas in which the respondent has experience/interest that potentially might apply to a CMS program?
Response: This should be part of your proposal and should be based on priorities identified in the national quality strategy.
3. Section Number: A.1.B Section & Title: Statement of Work (SOW)/Chapter 1. Scope/1.B - Purpose Question: Will CMS provide a list and/or number of existing measures by program that will be maintained and re-evaluated under the proposed task order?
Response: These are de novo measures.
4. Section Number: J.1.a Section & Title: Task Order 0001 SOW Question: If the period of performance of the TO is greater than one year, can some measures be developed over more than one year? If the period of performance is one year, do all proposed measures need to be fully developed in one year?
Response: We acknowledge that a measure cannot be developed end to end (environmental scan) through implementation in a year. It is acceptable to propose and budget for work in the first year only. Please propose (but not budget) later steps in the out years of the entire process. You may use measures that you are proposing for other task orders or for current work as examples of this effort.
5. Section Number: J.1.a Section & Title: Task Order 0001 SOW Question: Does the offeror have to present an approach to work in all chapters of the MIDS (i.e. all stages of the measure development life cycle)? If so, and the period of performance is one year, can the offeror describe an approach to future work for measures proposed for development in year 1 but not actually propose and budget it in detail? That is, propose and budget for the development of 5 measures in the first year and describe in the technical how the offeror would re-evaluate and implement in future years but not include in budget? Alternatively, can the offeror propose later-stage steps, such as implementation, for measure already developed in other contexts in order to cover all chapters within a single year?
Response: We acknowledge that a measure cannot be developed end to end (environmental scan) through implementation in a year. It is acceptable to propose and budget for work in the first year only. Please propose (but not budget) later steps in the out years of the entire process. You may use measures that you are proposing for other task orders or for current work as examples of this effort.
6. Section Number: J.1-A TO 0001 SOW Section & Title: Chapter 1, Scope; 1.B - Purpose Question: The stated purpose is to develop “5 outcome/efficiency measures that cross settings in support of the CMS quality and payment programs/initiatives.” Is CMS requiring that each proposed measure cross multiple settings of care (e.g. hospital and post acute care) and/or be used in multiple programs, or that the 5 measures proposed assess care in one setting each, but in different settings?
Response: Measures can be proposed for a single setting with an eye for being able to use in multiple settings in the future.
7. Section Number: Task Order 0001 (p. 4) - & Umbrella IDIQ (p. 139) Section & Title: Chapter 11 - D. Key Personnel & L. 15, D. Key Personnel Question: It is listed in attachment J.1-A That the Key Personnel requirements include a Project Director and a Clinical Director (a physician). According to the Umbrella IDIQ, "The Key Personnel shall include a Program/Project Manager as well as the Principal Investigator.” Could you please clarify the key personnel that will be used for Task Order 0001? Must this individual be a physician?
Response: It is not mandatory, but typically, the Clinical Director would be a physician.
8. Section Number: J.1-A Section & Title: Outcome Measure Development Statement of Work Question: Section 1.B. states: “The purpose of this MIDS Task Order (TO) is to obtain services for the development, re-evaluation, and implementation of the Centers for Medicare and Medicaid Services (CMS) of 5 outcome/efficiency measures that cross settings in support of the CMS quality and payment programs/initiatives.” Do the 5 outcome/efficiency measures refer to 5 existing measures or does CMS expect 5 novel measures and/or a combination of both?
Response: 5 de novo measures.
9. Section Number: J.1-A D, Outcome Measures Development Statement of Work Section & Title: D. Key Personnel Requirements:
Question: Please confirm that the Clinical Director is a full time position for Task Order 0001. If full-time, can offerors staff this position with multiple key personnel at half-time or less to fulfill the FT Clinical Director hours?
Response: Yes
10. Section Number: J.1-A Development, Reevaluation, and Implementation of Outcome/Efficiency Measures Task Order 0001 SOW Section & Title: Chapter 2. General Requirements (page 2) Section Number: USOW Section C.1 Statement of Work Section & Title: Chapter 2. General Requirements (pages 10-15) Question: Section 2.G. referenced in Task Order 0001 is not in the USOW. Please clarify.
Response: Section 2.G. referenced in Task Order 0001 is not in the USOW. See amendment.
11. Section Number: J.1-A Development, Reevaluation, and Implementation of Outcome/Efficiency Measures Task Order 0001 SOW Section & Title: D. Key Personnel Requirements (page 4) Question: Considering the wide range of expertise required for the clinical director position, is it acceptable to utilize two physicians to fill the single FTE (2080 hours) of the position?
Response: Yes
12. Section Number: Statement of Work, Section D Section & Title: Statement of Work, Section D. Key Personnel Requirements Question: Can the 2080 hours for specified for the Clinician in Key Personnel be split among multiple clinicians?
Response: Yes
13. Section Number: Chapter 11, Part D Section & Title: D. Key Personnel Requirements Question: Can the 2080 hours for the Project Director and the 2080 hours for the Clinical Director be distributed between two project staff for each respective position? For example, the labor hours for the co-clinical directors would be shared and together would sum to 2080 hours.
Response: Yes
14. Section Number: A. Statement of Work Section & Title: 1.B - Purpose Question: Can CMS provide a list of the “5 outcome/efficiency measures” associated with this task order?
Response: These measures would be proposed and developed through this contract. They do not currently exist.
15. Section Number: A. Statement of Work Section & Title: Chapters 2 - 10 Question: Each chapter refers to work/tasks described in other sections that are not included in this SOW. There is a statement just above Chapter 2 that states this SOW “adheres” to tasks in the USOW chapters. If the work/tasks are identical to those listed in the USOW, what is the purpose of having to readdress them again within the same proposal response (Section C)? If there is something unique about this task order from the USOW, can those tasks be clearly identified?
Response: Follow the tasks identified in the Umbrella to propose the development of 5 de novo measures.
16. Section Number: A.1.A Section & Title: Chapter 1 – Scope, 1.A – Background (page 2) Question: The second paragraph specifies that “The measures will also provide Medicare beneficiaries with timely and comparative information on hospital performance for their choice of care.” Does this mean that only outcome and efficiency measures that are applicable to hospitals should be proposed or is CMS open to measures applicable to any and all care settings?
Response: The settings are not specified. It is acceptable to propose the development of hospital measures with an eye towards applying them to other settings.
17. Section Number: D Section & Title: D. Key Personnel Requirements (page 4) Question: CMS s requiring a full time (2080 hours per contract year) Project Director (PD) and a full time Clinical Director (CD) for Task Order 0001. Can the offeror propose a reduced level of effort for these positions, as this seems inefficient given the natural ebb and flow of measure development (i.e., waiting for data to become available before doing further analysis, waiting for feedback from CMS or NQF, or when programmers and analysts are implementing a testing or analysis plan and don’t require full time guidance from the PD and CD).
Response: Yes
18. Section Number: L.11, page 128, MIDS_2013_Umbrella_IDIQ_and_Task_Order_0001_RFP.doc Section & Title: General Proposal Instructions For A Multiple Indefinite Delivery Indefinite Quantity (IDIQ) Contract And Task Orders

Section Number: Task Order 0001 Section B, page 4, J.1-A_Outcome_Measure_Development_Statement_of_Work.docx Section & Title: Period-of-Performance Question: Item a(2) in Section L.11 of the Umbrella SOW states: The period of performance for the Task Order 0001, “Outcome Measure Development,” shall be (12) months from the effective date of contract award. Section B of Task Order 0001 lists a base year and 4 options years, indicating a potential 5-year period of performance. What is the intended period of performance for Task Order 0001?
Response: The period of performance for Task Order 0001 is twelve months with no option years. Please refer to Umbrella IDIQ amendment.
19. Section Number: Section J Section & Title: Section J - List of Attachments Question: In Section J - List of Attachments, Subsection J.1, the RFP states: "J.1 Task Order 0001- “Outcome Measure Development” shall be twelve (12) months from the effective date of Contract award." Under Task Order 0001 “Outcome Measure Development,” should there also be "four (4) twelve (12) month option years" listed to be consistent with Appendix J.1-A Statement of Work, which lists Option Years 1 through 4 for Task Order 0001?
Response: The period of performance for Task Order 0001 is twelve months with no option years. Please refer to Umbrella IDIQ amendment.
SCHEDULE OF DELIVERABLES QUESTIONS
20. Section Number: Deliverable Numbers 6, 7, 8, and 9 Section & Title: Schedule of Deliverables (SOD) for MIDS Umbrella Entitled, “Outcome Measure Development,” 6 Summary Report of Environmental Scan and Empirical Analysis, 7 List of Potential Measures, 8 Measure Information Form, 9 Measure Justification Form Question: The deliverables listed as 7, 8, and 9 are due 2 months following TOA; however, deliverable 6 is due 3 months following TOA. The timing of deliverables 7, 8, and 9 does not follow the usual flow of occurring after an environmental scan is complete. Will CMS please provide some insight as to why these deliverables precede the completion of the environmental scan?
Response: The Summary Report of Environmental Scan and Empirical Analysis may be due later although subsequent drafts would likely be reviewed sooner. We agree that the list of potential measures cannot be developed without the Environmental Scan and Gap Analysis itself being complete. The timing can be finalized at kickoff.
21. Section Number: Deliverable 6 Section & Title: Deliverable 6: Summary Report of Environmental Scan and Empirical Analysis (Information Gathering Report) Question: Should the delivery of the report precede delivery of the list of candidate measures and MIFs? Currently the report is due after the list of measures and MIFs are submitted to CMS (Deliverables 7 and 8).
Response: This can be agreed upon at kickoff.
22. Section Number: Schedule of Deliverables Section & Title: Deliverable 6 Question: Deliverable 6 has a due date of 3 months following TOA. Deliverable 7 is dependent on Deliverable 6 but has a due date of 2 months following TOA. A list of potential measures cannot be developed without a comprehensive Environmental Scan and Gap Analysis. Is the due date for Deliverable 7 accurate?
Response: The Summary Report of Environmental Scan and Empirical Analysis may be due later although subsequent drafts would likely be reviewed sooner. We agree that the list of potential measures cannot be developed without the Environmental Scan and Gap Analysis itself being complete. The timing can be finalized at kickoff.
23. Section Number: Schedule of Deliverables Section & Title: Deliverables 8 and 9 Question: Deliverables 8 and 9 have a due date of 2 months following TOA, but those are measure specifications. Deliverable 16 covers measure specifications also, but has a deliverable date of 2 months prior to end of POP.
Response: The measure specifications are updated at various points in the development process. These requirements will be clarified at kickoff.
24. Section Number: Schedule of Deliverables Section & Title: Deliverables 21 and 22 Question: Deliverables 21 and 22 are evaluations that are usually performed AFTER the measures have been in use and data is available. Are the deliverable dates accurate?
Response: We acknowledge that a measure cannot be developed end to end (environmental scan through implementation in a year. It is acceptable to propose and budget for work in the first year only. Please propose (but not budget) later steps in the out years of the entire process. You may use measures that you are proposing for other task orders or for current work as examples of this effort.
25. Section Number: Schedule of Deliverables Section & Title: Deliverables 26 and 27 Question: Measure development and the process for endorsement typically take up to a year to accomplish. Task Order 0001 has a period of performance of 12 months in the base year. Does CMS envision that deliverables 26 and 27 would be very preliminary testing on draft specifications?
Response: We acknowledge that a measure cannot be developed end to end (environmental scan through implementation in a year. It is acceptable to propose and budget for work in the first year only. Please propose (but not budget) later steps in the out years of the entire process. You may use measures that you are proposing for other task orders or for current work as examples of this effort.
26. Section Number: Deliverable 33 Section & Title: Deliverable 33: Award Fee Self-Assessment Question: This deliverable does not map correctly to the MIDS Umbrella IDIQ or the statement of work for Task Order #0001. Please advise.
Response: Deliverable 33 has been reserved. Please refer to the Umbrella IDIQ amendment.
27. Section Number: J.1-A Outcome Measure Development Statement of Work Section & Title: Deliverable 36 - OMB/PRA Submission Materials Question: Deliverable 36 - OMB/PRA Submission Materials is referenced in Chapter 8 of the USOW, however, on the Outcome Measure Development Schedule of Deliverables it references Chapter 7, please clarify.
Response: Although some PRA work may occur at varying points in the process, the primary work is described in Chapter 7 of the USOW:
Office of Management and Budget (OMB)/Paper Work Reduction Act (PRA) Submissions:
The MIDS Contractor may be directed to provide support and/or prepare forms, data, and information suitable for submission to OMB (Deliverable 36) in accordance with the Paperwork Reduction Act (44 U.S.C. 3501 et seq.).
28. Section Number: Schedule of Deliverables Section & Title: Deliverable 38 Question: Measure development and the process for endorsement typically take up to a year to accomplish. Task Order 0001 has a period of performance of 12 months in the base year. Does CMS expect a dry run of final measure specifications to be held within the base year (or 12 months)?

29. Section Number: Schedule of Deliverables Section & Title: Deliverables 43 and 44 Question: Measures are not typically reported on Hospital Compare the first year they are developed. Does CMS expect the contractor to provide specifications and files for reporting (Deliverables 43 and 44) in the base year?

30. Section Number: Deliverable 45 Section & Title: Deliverable 45: Implementation Algorithm Question: What does IAW MIF dates mean?

31. Section Number: Deliverables 47-49 Section & Title: Deliverables 47-49 Question: These deliverables do not currently map to the MIDS Umbrella IDIQ or the statement of work for Task Order #0001. Can CMS provide more detail?
Response: These deliverables have been reserved. Please refer to Umbrella IDIQ amendment.
BUSINESS PROPOSAL QUESTIONS
32. Section Number: L.12.b Section & Title: Task Order 0001, Proposal Organization, p. 129 Question: Page 129 states that the Volume I Business Proposal must include Schedule B, which contains a matrix for loaded T&M rates. However, Schedule B itself (p. 7) states that “T&M rates will not be established until such time as a T&M Task Order Contract is awarded”. Does CMS want us to submit hourly rates at this time, or should we only do so at a later date, when a T&M Task order is issued?
Response: T&M rates are not being requested at this time.
33. Section Number: Section L Section & Title: Section L.12, Proposal Organization and L.14, Business Proposal Question: The instructions in L.14 show that the Task Order 0001 Cost Proposal should be included after the Contract Forms and Representation and Certifications section and before the Subcontractor section. The instructions in L.12 don’t show the Task Order Cost Proposal until after all the IDIQ list of items (1 - 11). In what order should the Task Order Cost Proposal be included in the Business Proposal organization?
Response: CMS does not have a preference for the order of the information included in the proposal as long as it is present.
34. Section Number: Section L Section & Title: Section L.12.c.2.(E), Proposal Organization, Volume I – Business Proposal Task Order, Business Proposal Narratives, Service Contract Act Question: What detail should be submitted in the Service Contract Act section?
Response: Section L.12.c has been deleted. Please see Section L.14.c for details. Please refer to Umbrella IDIQ amendment.
35. Section Number: L.14.c of the Umbrella IDIQ Solicitation Section & Title: L.14 Business Proposal, c. Task Order 0001 Cost Proposal Question: Should Task Order 0001 be budgeted by task? If the answer is yes, please provide a list of tasks that should be used for Task Order 0001 budgeting purposes.
Response: Task Order 0001 should be budgeted based on the Statement of Work, which is not broken down by tasks.
36. Section Number: L.14.c of the Umbrella IDIQ Solicitation Section & Title: L.14 Business Proposal, c. Task Order 0001 Cost Proposal Question: For budgeting purposes, what should we use as a start date for the Period of Performance for Task Order 0001?
Response: September 30, 2013
CONFLICT OF INTEREST QUESTIONS (On an as needed basis)
37. Section Number: L.11 and L.17 Section & Title: Proposal Organization and Volume III – Conflict of Interest and Compliance Program Proposal Instructions Question: We are providing Volume III Conflict of Interest and Compliance Program in accordance with Sections L.11 and L.17. Section L.12.c.2.(F) requests the Umbrella Contract Section H.2. – Conflict of Interest be included in the TO 0001 response. Are we to submit the completed OCI program as completed in Volume III or include a response to Section H.2. from the RFP that is specific to the Task Order 0001 SOW?
Response: Section L.12.c.2 has been removed. Please refer to Umbrella IDIQ amendment.
38. Section Number: L.12.c.2.(F) Section & Title: Proposal Organization Question: The IDIQ submission, which includes Task Order I, includes Volume III, COI Proposal. Does CMS mean to include conflict of interest information in the Task Order I Business Proposal as listed on page 130?
Response: Section L.12.c.2 has been removed. Please refer to Umbrella IDIQ amendment.
39. Section Number: L.12.c.2.(F) Section & Title: Proposal Organization Question: What information does CMS want offerors to include related to COI information in the Task Order Business Proposal?
Response: Based the on Statement of Work, the Offeror shall include any information pertaining to potential conflicts.
40. Section Number: Section L Section & Title: L.13.a, Proposal Presentation and Delivery, Volumes Question: What are the submit requirements for Volume III – Conflict of Interest and Compliance Program for Task Order 0001? (i.e. number of originals, number of hard copies and number of electronic copies on CD)
Response: Offerors must submit three (3) hard copies and (3) electronic copies on CDs for the Conflict of Interest, Volume III.
41. Section Number: L. 17, TAB A Section & Title: Task Order 0001, Volume III – Conflict of interest and compliance program proposal instructions: TAB A: Organizational Conflict of Interest – Summary List of Contracts, p. 141 Question: Can CMS clarify what is meant by “The Offerors or Contractors must disclose all contracts, both government (local, state and federal) and non-government currently held with CMS, other government health care agencies, or with non-government entities, as a Prime and/or as a Subcontractor, for itself, its parent company, subsidiaries or other affiliated entities?” The terms of some currently-held contracts have language protecting the identity of the member or client from disclosure.
Response: We are primarily interested in healthcare related contracts and relationships/affiliations, both government and non-government/private, whether held with CMS or some other government department/agency (e.g., DOD/Tricare; State Medicaid), or with commercial/private entities (e.g., healthcare providers/suppliers, insurance carriers, TPAs, medical instrument manufactures, pharmaceuticals, and the like). We require all such relationships/contracts/affiliations to be identified and disclosed. We also require the offeror to determine whether these relationship/contracts/affiliations give rise to OCIs and if so provide a mitigation plan for each. If they do not, provide an explanation as to why the relationship/contract/affiliation is not one or more of the three forms of OCI.”
42. Section Number: L. 17, TAB B Section & Title: Task Order 0001, Volume III – Conflict of interest and compliance program proposal instructions: TAB B: Conflict of Interest – Information and Detail, p. 142 Question: Please confirm that only the prime contractor is required to submit an organizational Conflict of Interest Certificate.
Response: All prime and proposed subcontractors must submit OCI Certificates. At this time, CMS may not delegate OCI analysis of subcontractors’ OCIs to lead/prime offerors.
43. Section Number: L. 17, TAB C Section & Title: Task Order 0001, Volume III – Conflict of interest and compliance program proposal instructions: TAB C: Compliance Program Attestation, p. 144 Question: Tab C – Compliance Program Attestation on Page 144 requires the offeror to submit a compliance program attestation in the format specified by CMS. Can CMS provide the specified format?
Response: The specified format is Attachment J.7. See Umbrella IDIQ amendment correcting the mislabeling.
44. Section Number: L.17, TABS A-D Section & Title: Task Order 0001, Volume III - Conflict of Interest Proposal Instructions, TAB A - TAB D, pp. 141-144 Question: Can CMS please confirm if the conflict of interest requirements also apply to the subcontractor?
Response: Yes, the Conflict of Interest requirements apply to the subcontractor.
45. Section Number: L.17 Section & Title: Volume III – Conflict of Interest and Compliance Proposal Instructions Question: For Tab A: Organizational Conflict of Interest – Summary List of Contracts, are we required to disclose all currently held contracts and subcontracts or only those related to the statement of work for Task Order #0001?
Response: All currently held contracts and subcontracts are to be disclosed.
GENERAL QUESTIONS
46. Section Number: L.12 and L.14 Section & Title: Proposal Organization and Business Proposal Question: Section L.14 indicates a different order for the Business Proposal than what is listed in Section L.12, as listed below. Which section should be followed for the Business Proposal?

Response: CMS does not have a preference for the order of the information included in the proposal as long as it is present.
47. Section Number: L.13.a Section & Title: Proposal Presentation and Delivery Question: How many hard copies and electronic copies of Volume III (Conflict of Interest and Compliance Program for IDIQ) are required? (The RFP states the number for the technical and business proposals, but not for Volume III.)
Response: Offerors must submit three (3) hard copies and (3) electronic copies on CDs for the conflict of interest, Volume III.
48. Section Number: L.15.C Section & Title: Task Order 0001 Response Question: May offerors include an appendix with the technical proposal?
Response: Yes
49. Section Number: L.15.C Section & Title: Task Order 0001 Response Question: Will the appendix be excluded from the page limit for the technical proposal?
Response: Yes, the appendix is excluded from the page limit.
50. Section Number: L. 15 B Section & Title: Task Order 0001, Technical Proposal Instructions: Past Performance, p. 138 Question: To whom should we instruct our past performance references to submit their questionnaires? On page 138 of the RPF it says, “…directly to the Contracting Officer…” (who according to page 125 of the RFP would be Brian Hebbel or Kimberly Tatum), but Attachment J.5 instructs references to return questionnaires “Irina Perl…Contract Specialist.”
Response: Please send Past Performance Questionnaires to Irina Perl as stated in Attachment J.5. Please refer to Umbrella IDIQ amendment.
51. Section Number: L.15 Section & Title: C. Task Order 0001 Response, Item 2 Question: Can Offerors assume that CVs for key personnel, essential personnel, support personnel, and subcontractors are excluded from page limitations?
Response: Yes
52. Section Number: L.15 Technical Proposal Instructions Section & Title: C. Task Order 0001 Response Question: Can Offerors assume that the title page, table of contents, and a cross reference matrix provided for ease of review are not counted in the page limitation?
Response: Yes
53. Section Number: L.12, M.2, L.15 C., D., E, F. J.1-A Section & Title: Proposal Organization; M.2 Task Order 0001 Response, Personnel and Essential Staff; M.2 Key Personnel; J.1-A, Section D, Key Personnel Question: Please clarify the organization of Volume II for the Base proposal. L.15.C is titled Task Order 0001 Response. Should sections L.15.D Key Personnel; L.15.E Management Plan and L.15.F SB Utilization be addressed as part of the TO 001 response?
Response: No, section L.15.D, L.15.E, and L.15.F should not be addressed as part of the Task Order 0001 response, they are part of the IDIQ base response.
54. Response: CMS will evaluate the Task Order 0001 technical approach based on responses to the bulleted topics in L.15.C.1 and M.2. Note that the chapters in the Statement of Work are reflected as part of the technical approach in sections L and M.

Section Number: L.15.D Section & Title: Key Personnel & M.2 Key Personnel Please clarify whether positions in L.15.D (Program/Project Manager and Principal Investigator) relate to the Umbrella IDIQ and whether they should be addressed as part of TO 001 in accordance with L.12 proposal organization.
Response: The positions noted in L.15.D refer to the IDIQ. If they are pertinent to Task Order 0001, please propose them accordingly.
56. Section Number: L.15, p. 138 Section & Title: Technical Proposal Instructions Question: Are resumes included in the page limit for the Task Order 0001 response?
Response: Resumes are not included in the page limit.
57. Section Number: M.2 Section & Title: Technical Evaluation, Task Order 0001 Response Question: Will the Task Order 1 technical proposal be evaluated completely independent from the IDIQ technical proposal?
Response: The Task Order 0001 technical proposal response is one of the evaluation factors under the IDIQ base contract.
