USNRC ITISS Disincentive Model Page 1 of 7
Description of Disincentive Model
In order to ensure consistently optimal offeror performance, a disincentive model will be implemented for the entire duration of the Information Technology Infrastructure Services and
Support (ITISS) contract. This document is to be distributed to potential offerors, to provide a detailed description of this disincentive model. The disincentive model provides for an amount
(up to 5% of each monthly invoice) to be withheld from all monthly invoices and refunded quarterly after a review of performance (note that the periodicity of this refund payment may be renegotiated after base year 1 of the contract). Offerors may choose to propose a higher disincentive percentage if they believe that doing so reflects an elevated level of confidence in their ability to meet all SLRs. Performance will be assessed for each subtask. Subtasks are detailed in Section 3 of the ITISS SOW (e.g., blackberry, print and file management).
SLRs for each subtask are detailed in Section A.4 of the ITISS SOW. Performance for a given
ITISS subtask is deemed unacceptable for a given month if the vendor fails to meet the required performance level for any Service Level Requirement (SLR) associated with that subtask. At the end of each month, NRC staff will be responsible for determining the degree to which the vendor meets each SLR per the surveillance methods outlined in Sections A.2 and A.4 of the
ITISS SOW, and vendors may be required to submit documentation and metrics for the use of the NRC staff. At the end of this evaluation period, an NRC manager will confirm that all SLRs have been evaluated for the given month. When this surveillance detects unsatisfactory performance for any SLR, the vendor shall be notified, and the deficiency will be documented.
In this case, the vendor will be given an opportunity to review the NRC’s findings, and potentially contest the findings. If contested, the NRC and vendor will jointly re-evaluate the SLRs, after which the NRC will make a final determination. If it is ultimately determined that unacceptable service has been provided for a given SLR, the amount of the quarterly refund for that subtask will be reduced by the disincentive percentage multiplied by the monthly base fee for the corresponding subtask (e.g., if the base fee for a subtask is $100,000, and the disincentive percentage is 5%, the disincentive penalty would be equal to $5,000 for that subtask, if any SLR for that subtask was not met). For further details regarding this process, refer to Attachment A, which provides the draft form that the NRC will use to determine the amount of the monthly disincentive penalty; and to Attachment B; which provides an example of a filled-out version of this form (note that the data used is for example purposes only). Furthermore, Attachment C provides a sample draft calendar that outlines a tentative schedule for this evaluation process.

Attachment A: Draft Form for Determining Disincentive Amount
This form is to be filled out monthly. The first page of this form serves as a cover page, which indicates which SLRs (if any) were missed for the stated month of performance, and provides the total value of the disincentive amount withheld due to unacceptable offeror performance.
The second page of this form is used to calculate the disincentive amount to be withheld. Each subtask in which a SLR was missed for the month of performance will be calculated on a separate copy of this page.
