Local Construction Program (LCP)
To: All Prospective Offerors:
The U.S. Agency for International Development (USAID) for the West Bank and Gaza Mission is seeking proposals from qualified organizations to provide the services described in Section C of the attached RFP. It is anticipated that a 3-6 holder Indefinite Quantity Contracts (IQCs) will be awarded based on the results of this competition. The overall shared Ceiling Price for this
IQC is $300 Million with a period of performance of five years.
Offerors are responsible for ensuring that they have received the RFP solicitation document from the internet in its entirety. USAID bears no responsibility for data errors resulting from transmission or conversion processes. Further, Offerors should be aware that amendments to solicitations are occasionally issued and will be posted on the same Internet site from which the
RFP solicitation was downloaded. Offerors are therefore advised to regularly check the
FedBizOps website (http://www.fedbizops.gov/) for amendments.
If your organization decides to submit a proposal in response to this solicitation, it must be submitted in accordance with Section L of the RFP. Any proposal not received in the designated office listed below by the closing date and time specified above will be handled in accordance with FAR 15.208.
Proposals, and modifications thereto, shall be submitted in sealed envelopes with the name and address of the Offeror and the RFP number inscribed thereon. Also, if you utilize the services of an independent agent to deliver your proposal, please be certain that he/she understands that the closing date and time are firm. Fax, telegraphic or electronic proposals will not be accepted.
Offerors should carefully review and comply with the instructions contained in the RFP relative to submitting a proposal. Please note the following:
It is a requirement of this RFP that all Offerors be local1 West Bank and Gaza entities that are not owned or controlled by a government entity.
It is a requirement of this RFP that all Offerors be registered with the
Palestinian Contractors Union (PCU). Therefore, all Offerors are required to provide proof of their current registration in the PCU at the time of submitting the proposal or it will not be considered for award.
Offerors must complete in full, RFP Section K - Representations, Certifications and
Acknowledgements of the accompanying Request for Proposals. Though Offerors are now expected to comply with FAR clause 52.204-7, Central Contractor Registration, and complete the annual representations and certifications electronically via the Online
Representations and Certifications Application website at http://orca.bpn.gov and to obtain a number from the Data Universal Numbering System (DUNS) by Dun and
Bradstreet, USAID understands that this may not feasible for local contractors by the due date of the proposal. Therefore, USAID will accept submission of the Representations, Certifications and Acknowledgements in hard copy with the proposal. However, offerors should initiate the CCR registration and DUNS number as soon as practicable and obtain both prior to award being made.
Proposals must be signed by an official who is authorized to bind the organization.
It is required that the Partner Information Form (PIF), Attachment No. 10 to this RFP, be completed and submitted with the RFP. Guidance on the appropriate individuals to include in the PIF can be found in Mission Order 21, Section V.C. Per Mission Order No.
21. A eligible vetting result is required in order to receive an award.
Joint Ventures may respond under this RFP. However, proof of the registered Joint
Venture as a local entity as well its registration and classification in the PCU are required at the time of submittal of the proposal. In the absence of proof of a current registration, the proposal will not be considered for award.
USAID intends to hold a pre-proposal conference. The date and time will be issued via an amendment to the RFP. Written questions should be sent via e-mail to Ms. Hourig DelDelian, Sr.
Contracting Specialist, at hdeldelian@usaid.gov, as indicated above.
1 Per ADS 302 local entity means an individual, a corporation, a nonprofit organization, or another body of persons that--
(1) is legally organized under the laws of; (2) has as its principal place of business or operations in; and (3) either is--
(A) majority owned by individuals who are citizens or lawful permanent residents of; or
(B) managed by a governing body the majority of whom are citizens or lawful permanent residents of; a country receiving assistance from funds appropriated under title III of this Act.
(c) For purposes of this section, `majority owned' and `managed by' include, without limitation, beneficiary interests and the power, either directly or indirectly, whether exercised or exercisable, to control the election, appointment, or tenure of the organization's managers or a majority of the organization's governing body by any means.”

Oral instructions or explanations given before the award of the contract resulting from this solicitation shall not be binding.
All proposals in response to this RFP shall be delivered to the below address, not later than the date and time indicated above.

Issuance of this solicitation does not in any way obligate the U.S. Government to award a contract nor does it commit the U.S. Government to pay for any costs incurred in the preparation and submission of a proposal.
The Government reserves the right to reject any and all offers, if such action is considered to be in the best interest of the Government. Please note that the U.S. Government intends to award this contract without discussions and as such, initial proposals should represent the best possible and most competitive terms available. Award of a contract under this RFP is subject to the availability of funds and other internal USAID approvals.
