Section H - Special Contract Requirements

TO ORDERING PROCEDURES

1. Fair Opportunity. IAW 16.505(b)(2)(i), the contracting officer shall give every awardee a fair opportunity to be considered for a task order exceeding the micro-purchase threshold unless one of the following statutory exceptions applies:

(A) The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays;

(B) Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized;

(C) The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order;

(D) It is necessary to place an order to satisfy a minimum guarantee;

(E) For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source;

(F) In accordance with section 1331 of Public Law 111-240 ( 15 U.S.C. 644(r)), contracting officers may, at their discretion, set aside orders for any of the small business concerns identified in 19.000(a)(3); or

(G) The order satisfies one of the exceptions permitting the use of other than full and open competition listed in

6.302 ( 10 U.S.C. 2304 c(b)(5)).

IAW FAR 16.505(b)(1)(iii), each order exceeding the simplified acquisition threshold (SAT) shall be placed on a competitive basis in accordance with paragraph FAR 16.505(b)(1)(iii)(B), unless one of the statutory exceptions above applies.

2. Issuance of Task Orders.

a. Task Orders will be issued in writing or orally only by the Mission and Installation Contracting Command (MICC) Environmental Division at Joint Base San Antonio Fort Sam Houston, Texas.

b. The type of competition is a Contracting Officer decision, not subject to FAR 52.212-4 (d) Disputes.

c. Specific performance assignments will be made by the Government by issuance of TOs wherein the work to be performed will be described in terms of scope, services required and schedule milestones. The procedure for establishing task orders will be as follows:

d. When the Government has a requirement for work above the micro-purchase threshold, the Contracting Officer shall give every awardee a fair opportunity to be considered for a task order unless the Contracting Officer implements an exception under FAR 16.505(b)(2)(i). The Contracting Officer has sole discretion to set aside a requirement for small business concerns under the FAR 16.505(b)(2)(i)(F) exception or not to set aside the requirement for small business concerns. If the requirement exceeds SAT, a Request for Task Order Proposal (RTOP) will be sent out to the appropriate business suite. The RTOP will provide each IDIQ awardee with the Performance Work Statement (PWS) describing the requirements and objectives of the tasks and all other applicable documents (ie., performance requirement summary, deliverable schedule, wage rates, site background information, reference materials, government furnished information, etc.). The RTOP will also include a price schedule containing the Contract Line-Item Number (CLIN) structure. Additionally, the RTOP will provide the source selection evaluation method and all evaluation factors, establish a date for questions & answers, site visit (if applicable) and the RTOP’s closing date; and any other pertinent information required to provide a fair opportunity for the competition of the TO requirement.

e. The contractor shall furnish a TO proposal to the Contracting Officer within the timeframe specified in the RTOP.

The RTOP’s response should demonstrate an understanding of the PWS tasks required through a comprehensive discussion of the contractor’s technical capability, to include but not limited to technical approach, proposed staffing, level of effort, and project schedule. The response shall also include a completed pricing schedule/CLIN Structure. Each TO requirement will be priced on a Firm-Fixed-Price (FFP) basis.

3. Award of Task Orders.

a. Task Order proposal evaluation procedures will be conducted IAW FAR Part 16.505 and supplements thereto.

Award will be made to a single offeror who is deemed responsible in accordance with FAR 9.104, whose proposal conforms to the RTOP requirements, and whose proposal, and other considerations specified in the RTOP, represents the best value to the Government.

b. Applicable wage determinations will be identified within the RTOP for task orders that are subject to the Service Contract Labor Standards (SCLS). The contractor shall comply with SCLS and related clauses when task orders are covered by the SCLS.

4. Mission and Installation Contracting Command Ombudsman:

a. The following individual has been appointed as Ombudsman for this Multiple Award Indefinite Delivery/Indefinite Quantity (MAIDIQ) contract issued by this organization:

Christine Barge Mission Installation Contracting Command 2219 Infantry Post Rd Fort Sam Houston, TX 78234-1361 Telephone: (210) 466-2408 E-mail Address: christine.b.barge.civ@mail.mil

b. The ombudsman has the authority to review contractor complaints that they have not been afforded fair opportunity to be considered for award of a particular task order or delivery order under a multiple award contract.

c. A contractor who receives an award under a multiple award contract may contact the ombudsman with a complaint concerning the award of a particular task order or delivery order placed under the multiple award contract.

i. The contractor is encouraged to try to resolve the issue with the Contracting Officer prior to contacting the ombudsman. However, contractor complaints to the ombudsman must be made within 5 workdays of the award under complaint. E-mail complaints are acceptable; however contractors are encouraged to identify in the subject line of the e-mail "Ombudsman Complaint" to ensure appropriate attention.

ii. The ombudsman's authority is limited to issues pertaining to the awarding of task orders and delivery orders under multiple award contracts. Contractor complaints directed to the ombudsman shall be confined to these issues. All other complaints will be outside the authority of the ombudsman and will be returned to the contractor without action.

d. Upon review of the facts, the ombudsman will determine whether or not the contractor was afforded a fair opportunity to be considered consistent with the procedures in the contract and either:

i. Deny the contractor's complaint; or,

ii. Require that the Contracting Officer take corrective action regarding the complaint.

e. If the Contracting Officer does not agree with the decision of the ombudsman, the matter shall be referred to the Mission Installation Contracting Command Principal Assistant Responsible for Contracting for final decision.

f. These ombudsman procedures are not subject to FAR 52.212-4 Contract Terms and Conditions-- Commercial Items, Paragraph (d) Disputes.
