NOTICE TO OFFERORS

CONTRACT FORMAT:

Offerors should note that the format of this contract is in accordance with Federal Acquisition Regulations (FAR), promulgated by the General Services Administration (GSA), effective April 1, 1984, including all applicable revisions. Applicable FAR provisions and clauses are incorporated in this contract by reference or full text as indicated in the INDEX before the D-pages in this booklet.

FAR provisions and clauses incorporated by reference can be accessed on the Internet website at https://www.acquisition.gov/. Offerors are encouraged to review the documents thoroughly before submitting a proposal.

PROPOSAL BOOKLET AND OFFER SUBMITTAL:

It is the responsibility of the Offeror to verify that this proposal is complete as listed in the Table of Contents. The Offeror is responsible for submitting all required forms and documents with the offer.

Offerors should use the Checklist for Offer Submission included in this booklet to check that their proposals are complete.

CONSTRUCTION CONTRACTS:

As stated in FAR Clause 52.236-1, the Contractor shall perform on the site, and with its own organization, work equivalent to at least 50%. Additional guidance is given in FAR Subpart

35.005 where the majority of the project work is complex and specialized such as restoration work, bridge painting, and proprietary construction techniques (i.e. proprietary Cintec arch strengthening.)

There are exceptions and they will be reviewed on a case-by-case basis.

HAZARDOUS MATERIALS IDENTIFICATION AND MATERIAL SAFETY DATA:

As required by FAR Clause 52.223-3, Hazardous Materials Identification and Safety Data, the apparent low Offeror must submit prior to award a Material Safety Data Sheet (MSDSs) for all hazardous materials that the Offeror identifies in paragraph (b) of this clause in Section G of this booklet. Failure to submit MSDSs may render the Offeror ineligible for award of contract. The apparent low Offeror should submit their MSDSs within two weeks after bid opening.

ATTENTION LARGE BUSINESSES - UTILIZATION OF SMALL BUSINESS CONCERNS:

All offerors that are large businesses should note their responsibilities in the awarding of subcontracts in accordance with FAR Clause 52.219-8, Utilization of Small Business Concerns. An awardee, if a large business concern, should note its responsibility to establish and conduct a subcontracting plan in accordance with FAR Clause 52.219-9, Alternate II, Small Business Subcontracting Plan. Any offeror registered as a LARGE BUSINESS under the solicitation’s NAICS code is required to submit a subcontracting plan with their proposal in response to this solicitation. If the apparently successful offeror fails to submit a subcontracting plan within the time limit prescribed by the Contracting Officer, the offeror will be ineligible for award. PLEASE NOTE: A blank subcontracting plan is included in this solicitation package as a separate document for your use.

INTERNET BASED DATA BASES - REQUIRED INPUT:

According to FAR Subpart 4.1102 contractors are required to be registered in the System for

According to FAR Subpart 4.1201 contractors are required to complete electronic annual representations and certifications in SAM accessed via https://www.sam.gov/ as a part of required registration.

PAYMENT:

Offerors are advised to review the Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects (FP), subsection 109.05, concerning direct and indirect payment included under a pay item in the bid schedule.

PROGRESS PAYMENTS:

ALL payments will be made via Electronic Funds Transfer (EFT) as such; the payment information in SAM must be accurate in order for contractors' invoices to be considered proper invoices for the purpose of prompt payment under DOT contracts. Contractors must input and maintain (update as necessary) their EFT information in the SAM database. Offerors are advised that under FAR Clause 52.232-5, Payments Under Fixed Price Construction Contracts, upon request, progress payments will include premiums paid by the Contractor to obtain performance and payment bonds as required under this contract. These payments shall not be made in addition to the contract price. As specified in the FP, “Section 151 - MOBILIZATION", payments for performance and payment bond premiums shall be included in mobilization.

WELFARE-TO-WORK INITIATIVE:

The President’s Welfare Reform Bill was initiated to assist welfare recipients and hopefully aid welfare recipients to find gainful employment. In support of this bill, Contractors are encouraged to hire welfare recipients whenever possible and to use welfare recipients in performance of duties on Government contracts.

INCREASING SEAT BELT USE IN THE UNITED STATES:

The President’s Executive Order 13043 dated April 16, 1997, was issued to increase the use of seat belts in the United States. In support of this Order, contractors and subcontractors are encouraged to adopt and enforce on-the-job seat belt policies for their employees when operating company-owned, rented, or personally owned vehicles.

CHECKLIST FOR OFFER SUBMISSION

The following is a checklist of items included in the proposal/bid package that are required to be completed and returned (or filled in on-line) to the address in Block 7 of the Standard Form 1442, Solicitation, Offer, and Award (page 1). This checklist is for informational purposes only and is not required to be filled out by the Offeror. Failure to submit a complete proposal may be cause to reject your proposal.

(EFLHD) Receptionist to be contacted and an EFLHD representative will come to collect the proposal.

Laurel Fork Bridge Replacement

REQUEST FOR PROPOSALS

Project Description: The project consists of the replacement of the Laurel Fork Bridge of the

Blue Ridge Parkway, located at Milepost 248.85. The work includes removal of the existing bridge and construction of a new segmental bridge, drilled shafts, temporary bridges and access roads, mechanically stabilized earth wall, stone masonry, maintenance of traffic and temporary traffic control, and other miscellaneous work. The project is located in Ashe

County, North Carolina.

The cost of the project is expected to exceed $10,000,000.

Scope of Work: The detailed scope of work to be undertaken by the successful Offeror under the contract for this project is outlined in the Request for Proposal (RFP) solicitation documents.

These include the Plans, Special Contract Requirements (J Pages), and supplemental

Government Furnished Information.

Procurement Overview of the Project: In accordance with Federal Acquisition Regulation

(FAR) Subpart 14.5, the Eastern Federal Lands Highway Division (EFLHD) is conducting a

Lowest Price Technically Acceptable Source Selection Process for this project. Under this

Notice, the EFLHD (also referred to as “the Government”) is soliciting all eligible Contractor firms/teams (Offerors) to participate in a two-step RFP process. The two steps will include the submittal of two proposal packages; a Technical Proposal and a Price Proposal. A description of these proposals and their requirements can be found in the RFP’s Proposal Instructions (B

Pages).

During step one, a selection evaluation board will review and evaluate the technical proposals submitted by all interested, responsive Offerors. The selection committee will select qualified

Offerors based on the pass/fail (acceptable/unacceptable) evaluation criteria as stated in the

RFP’s Proposal Instructions - Evaluation of Proposal Documents (B Pages). Offerors should submit technical proposals that are acceptable without additional explanation or information.

The Government may make a final determination regarding a technical proposal’s acceptability solely on the basis of the technical proposal as submitted. The Government may proceed with the second step (lowest price evaluation) without requesting further information from any

Offeror; however, the Government may request additional information from any Offeror with a technical proposal considered reasonable and close to acceptable, and may discuss any technical proposal with any Offeror. Only one technical proposal may be submitted by each Offeror. The step one technical proposal shall not include any prices or pricing information.

During step two, only technical proposals determined to be acceptable, either initially or as a result of discussions, will be considered for award. The price proposals corresponding to the acceptable technical proposals will be opened and ranked according to price and the contract will be awarded to the lowest responsive, responsible Offeror as stated in the RFP’s Proposal

Instructions - Basis of Award (B Pages). Only one price proposal may be submitted by each

Offeror and the price proposal must be based upon the Offeror’s own technical proposal.

As stated in FAR Clause 52.236-1, the Contractor shall perform on the site, and with its own organization, work equivalent to at least 50% of the total amount of work to be performed under the contract.

Contract award is anticipated to be no earlier than January 2022, with Notice to Proceed anticipated to be issued after the receipt of valid Performance and Payment Bonds (see Block

12a of the SF-1412 and FAR Clause 52.228-15). Construction activities are to be completed by

September 30, 2024 as specified in Subsection 108.01 of the Special Contract Requirements (J

Pages).

It is not the intent of EFLHD to receive project specific design or engineering recommendations as part of the step one technical proposal other than what is necessary to support the technical proposal. Offerors should limit their technical proposal to the information required by this

Notice, and other information that may be relevant to the qualifications and experience of the

Offeror. No reimbursement will be made for any expenses associated with the preparation of a step one technical proposal or a step two price proposal.

Obligation to Keep Team Intact: In connection with the services covered by this procurement process, any in-house personnel, subcontractors, and outside associates will be limited to the individuals or firms that are specifically identified during the step one technical proposal. The

Contractor shall obtain the Contracting Officer’s written consent before making any substitution for these designated in-house personnel, subcontractors, or outside associates.

Supplemental Work: Offerors are expected to provide qualified and experienced staff to develop appropriate pre-construction or construction protocols as designated by Federal, state, and local regulations/guidelines, including but not limited to the following:

• Work Plan.

• Accident Prevention Plan.

• Health and Safety Plan.

• Environmental Management Plan.

• Waste Management Plan.

• Recycling Plan.

Submittals: Each Offeror must provide the required number of Technical and Price Proposals as described below to EFLHD in separate, sealed envelopes/boxes clearly addressed and identified for “Project No: NP-BLRI 2D17.”

Submit three (3) bound paper copies, one (1) unbound copy, and one (1) CD-ROM copy of the Technical Proposal. Submit the Technical Proposal copies separately from the Price

Proposal in a sealed envelope/box and clearly labeled as the “Technical Proposal.”

Submit two (2) unbound paper copies and one (1) CD-ROM copy of the Price Proposal.

Submit the Price Proposal separately from the Technical Proposal in a sealed envelope and clearly labeled as the “Price Proposal.”

The Government will award the project to the lowest priced/technically acceptable responsible Offeror. The Contracting Officer intends to evaluate all proposals from all eligible Contractor firms/teams (Offerors) for technical acceptability. After all of the technical proposals have been evaluated, the Offerors that are found technically acceptable will be ranked according to price and the lowest Offeror will be awarded the contract.

EVALUATION OF PROPOSAL DOCUMENTS

STEP 1 - TECHNICAL ACCEPTABILITY – Experience in Construction of Segmental Bridges, Drilled Shafts and Stone Masonry Walls

1. A. TECHNICAL ACCEPTABILITY EVALUATION DESCRIPTION

Competing technical proposals will be evaluated against the solicitation requirements; they are not compared with each other. Each of the technical evaluation factors described below will be rated on a pass/fail (acceptable/unacceptable) basis, and must receive a passing score for an Offeror's proposal to receive further consideration. Failure to receive a passing score for any technical evaluation factor will result in rejection of an Offeror's proposal notwithstanding passing scores for other technical evaluation factors. Technical acceptability will be determined by evaluating each responsive proposal and comparing the results of that evaluation against the technical requirements specified in the solicitation. Proposals which satisfy the technical requirements of the solicitation, in light of the evaluation criteria, will be determined technically acceptable.

Offerors will be evaluated on the Offeror’s past performance and experience in construction of segmental bridges, drilled shafts, and stone masonry walls.

1.B. TECHNICAL PROPOSAL EVALUATION FACTORS

Submit the following qualifications and information, and label as the Technical Proposal. Include names, titles, phone numbers, and email address for all references submitted.

(a) Key Personnel - Submit resumes of key personnel proposed for this contract. The Government will review and evaluate each Offeror's proposed key personnel, including technical similarities between the Offeror's experience and the work described in this solicitation, of the Offeror’s proposed key personnel. Include names, titles, phone numbers, and email addresses for all references submitted. The Offerors will be required to submit the documentation for all key construction personnel to be involved in the construction of the project:

(1) Project Engineer: The Contractor/subcontractor’s engineer, responsible for all engineering decisions, judgements and work at the site. The Project Engineer shall be a registered Professional Engineer with five (5) years of experience of bridge construction of which three years is in precast post-tensioned concrete box girder segmental bridges.

Experience should include post-tensioning and grouting operations including at least one year in responsible charge of post-tensioning related engineering activities.

(2) Project Manager: The Contractor’s Project Manager shall have a minimum of ten years of bridge construction experience. This experience shall include at least three years of construction experience in precast post-tensioned concrete box girder segmental bridges and grouting operations.

(3) Superintendent: The Contractor’s Superintendent shall have a minimum of ten years of bridge construction experience. This experience shall include at least three years of construction experience in precast post-tensioned concrete box girder segmental bridges and grouting operations, including at least one year in responsible charge of segmental post-tensioning related operations. The Superintendent shall also be certified in accordance with Post-Tensioning Institute’s (PTI) Level 2 Multistrand PT Specialist program.

(4) Senior Structural Engineer: The Contractor/subcontractor’s senior structural engineer responsible for all the design support during construction. Provide their specific experience in the past seven (7) years in performing design and construction support similar in scope to the Laurel Fork Bridge project. The Senior Structural Engineer shall be a registered Professional Engineer in the State of North Carolina. In addition, they must have the experience below:

(i) Design of two (2) segmentally constructed curved post-tensioned concrete box girder bridges (superstructure and substructure) in the past seven (7) years similar in scope and size to the Laurel Fork Bridge project.

(ii) Construction support and shop drawings review for one (1) segmentally constructed curved post-tensioned concrete box girder bridges in the past five (5) years similar in scope and size to the Laurel Fork Bridge project.

(5) Bridge Foreman: The Contractor/subcontractor’s Bridge Foreman shall have a minimum of five (5) years of bridge construction experience, including two (2) years in post-tensioning related operations and a minimum of one (1) years as a foreman in responsible charge of post-tensioning related operations. The Contractor/subcontractor’s Bridge Foreman shall also be certified in accordance with PTI’s Level 2 Multistrand PT Specialist Program.

(6) Drilled Shaft Supervisor: The Contractor/subcontractor’s Drilled Shaft Supervisor shall have a minimum of three (3) drilled shaft bridge foundation projects in the past 5 years similar in scope to the Laurel Fork Bridge project.

(7) Stone Masonry Foreman: The Contractor/subcontractor’s Stone Masonry Foreman shall have a minimum of two (2) projects in the past five (5) years working with stone masonry wall repairs/installation on Blue Ridge Parkway or a similar scenic route for the National Park Service similar in scope to the Laurel Fork project.

The Contractor shall not change the key personnel listed above without the prior approval of the Contracting Officer.

(b) Construction Capability and Resources - The Government will review and evaluate the information about each Offerors' past performance in the design and construction of roadway and bridge projects based on the Offeror's record and reputation for satisfactorily completing projects similar in size and scope. The Offerors will be required to submit the following:

(1) Organizational structure, identifying major participants and describing their roles in the project. Identify how the Contractor/subcontractor involved with construction engineering support, drilled shaft construction, precast supplier, segmental bridge erection, post-tensioning and post-tensioning strand grouting, bridge approach wall construction and design, stone masonry walls, and bridge demolition will interact and fit into the overall construction team makeup.

(2) Documentation that shows direct experience of the Offeror, and/or experience of subcontractors that the Offeror proposes to utilize in the execution of this project. Submit documentation that shows direct experience of the Contractor/subcontractor in constructing precast concrete box girder segmental bridges by providing at least one (1), but no more than three (3) precast concrete box girder segmental bridge example projects completed in the past five (5) years similar in scope and size to the Laurel Fork Bridge project. Offerors are to include the experience of the entire prime and subcontracting team that will perform the work on this project.

(3) For each project included under (b)(2), provide owner contact information, including name, title, company, phone number, email address, and provide initial and final construction cost, reasons for cost changes, and initial and final durations, including reasons for schedule changes.

(c) Technical Approach to Design and Construction:

(1) Approach to bridge construction. Describe and/or define the replacement of the bridge, including demolition, concrete element fabrication and installation. Provide the name, experience and location of the concrete segment fabricator. In addition, describe and/or define the forms and falsework that will be used for the project.

(2) Construction Staging. Describe how you will stage construction to stay within the limits shown in the plans. Indicate how you will provide agricultural access to the project location at all times. Describe how you will maintain the temporary access roads and remove them at the end of the project. Indicate whether one or two temporary bridges will be used.

(3) Approach to Maintaining temporary traffic control. This project will require a temporary traffic control detour for the duration of the construction (over two years).

Describe how you will maintain the detour to minimize inconvenience to the traveling public.

(4) Environmental considerations and compliance during construction. Describe how your work will comply with the environmental documents for this project. State how you will comply with the following:

• Salvage and reuse the existing stone masonry on the new bridge (see Section 620);

• Work restrictions (See Section 108);

• Do not drive construction equipment across flowing waterways (see plans).

(5) Aesthetics/Workmanship - Approach to providing a finished facility in compliance with the NEPA documents (including construction of stone masonry walls facing matching the appearance of the existing stone masonry in the stone abutments and approach guardwalls).

(d) Project and Management Plan:

(1) Proposed Quality Assurance and Quality Control plans for construction in order to deliver a quality construction project (see Section 153). Describe how you will approach construction quality control.

(2) Project Schedule Control Plan - Describe the means and methods by which the Offeror will plan and control the scheduling of work to meet the contractual completion date. Discuss what measures will be taken to bring the schedule back if there are non-weather related delays. Provide a conceptual schedule for completion of the project work, incorporating the proposed work conditions, beginning with the Notice to Proceed.

(3) Approach to coordinating with the EFLHD, NPS, entities such as Fire & Rescue, Police and local jurisdictions; and, approach to public safety and public awareness. In order to be acceptable, the Offeror’s approach to coordinating with EFLHD, etc., must include meetings with stakeholders twice per month.

(4) Small Business Subcontracting Plan (if the Offeror is a Large Business).

1.C. TECHNICAL PROPOSAL SUBMITTAL

Technical Proposals shall not exceed 15 single sided pages of 8.5” x 11” size using Times New Roman font with a size of 12-point. All pages must be numbered. Only pages numbered 1 through 15 will be considered during the evaluation process. Additional pages consisting of photos, brochures, resumes, or other pre-printed material may be submitted as long as the exact item to be incorporated is identified. This material may not exceed an additional 20 pages. Gantt charts, site maps, or charts can be submitted on single sided sheets up to 11” x 17”. The technical proposal shall be bound. If tabs are used and contain project-specific information, they will be counted as pages.

Submit four (4) bound paper copies and one (1) unbound paper copy of the Technical Proposal.

In addition, submit one (1) electronic copy of the Technical Proposal on CD ROM. Submit the Technical Proposal copies separately from the Price Proposal in a sealed envelope or box and clearly labeled as the “Technical Proposal”.

STEP 2 - LOWEST PRICE - Cost to Perform the Proposed Work

2.A. LOWEST PRICE EVALUATION DESCRIPTION

Only Cost Proposals from Offerors that passed the technical acceptability phase will be evaluated. Cost Proposals from Offerors that did not pass the technical acceptability phase will be returned unopened. All acceptable Cost Proposals will be reviewed and evaluated for completeness and reasonableness.

2.B. COMPLETING THE BID SCHEDULE

Complete the Bid Schedule(s) by handwriting in ink or typing. Specify a Unit Bid Price, in figures with cents to only two decimal places, for each pay item in the Unit Bid Price column for which a quantity is given. Do not enter or tender a Unit Bid Price for any pay item for which no estimated quantity appears in the Bid Schedule. Determine the products of the respective unit prices and quantities, and show them, in figures, in the Amount Bid column. If a Unit Bid Price and Amount Bid have been inserted by the Government for a pay item, do not change the Unit Bid Price and Amount Bid for the pay item. Determine the Bid Total by adding the amounts of the listed items, and show in the block provided for Schedule of Work. In case of multiplication errors, the Amount Bid for the item will be based on the Unit Bid Price.

To be eligible for award, offerors must submit prices for each pay item.

Review Subsection 109.05 of the FP (standard specifications book) regarding scope of payment for direct and indirect payment work.

COMPLETION OF WORK

The Government has estimated the number of calendar days necessary to complete all contract work from the effective date of the Notice to Proceed to contract completion. The maximum number of calendar days allowed (i.e., the contact performance period) is shown in Block 11 of the SF-1442 and described below.

The Government will award the contract as Schedule A. The performance period to complete all contract work will be by September 30, 2024.

In developing a construction schedule to determine the number of calendar days, the Government considered and included the work limitations shown in Sections 108 and 156 of the FP and Special Contract Requirements (SCR’s). Specific work limitations may be (but are not limited to): National legal holidays, weekends, rush hours, night work, specified no work periods, work or traffic control phasing, etc. The Government also considered those work items that are weather sensitive and when those work items will be performed. Specific work items are (but not limited to): those that require a minimum ambient air temperature (asphalt paving and surface treatment, pavement striping, stone masonry, etc); those that require maintaining a minimum surface temperature (concrete pavement, structural concrete, painting, etc); and those that have specific planting seasons (turf establishment, sod, trees, plants, etc). The Government also considered time required for preparing material and drawing submittals, and the allowable Government review times for those submittals (Subsection 104.03 of the FP and SCR’s).

Bidders are to assume that the award of the contract and approval of the Contractor’s Performance and Payment Bonds (see Block 12a of the SF-1442 and FAR Clause 52.228-

15) may result in the Notice of Proceed being issued with an effective construction start date of no earlier than January 2022. See Subsection 108.01 of the SCR’s for additional details.
