Solicitation: 693C73-22-R-000008
The purpose of this Amendment is to:
1) Revise plan sheet to include a biological monitor.
2) Revise B-Pages to add a biological monitor pay item.
3) Revise Special Contract Requirements (SCR)s (J-pages) to add biological monitoring requirements:
a) Revise Subsection 107.12;
b) Revise Subsection 108.01(f);
c) Add Section 623.
4) Respond to offeror questions.
5) The proposal due date remains January 18, 2022, at 2:00 pm EST.
Request for Proposal Changes
1) Replace plan sheet C02 with the attached plan sheet.
2) Replace B-Pages (B-1 through B-7) pages.
3) a) Add the following to Subsection 107.12 of the SCRs, page J-5:
In addition, protect bat species and their habitat as follows (these requirements are subject to Fish and Wildlife Service (FWS) approval):
(a) Do not cut trees from April 1 to November 1, unless cleared by qualified wildlife biologist. If tree removal cannot occur between October 31 and March 31, flag all trees larger than 3 inches in Diameter at Breast Height (DBH) needing removal after the
Preconstruction Conference.
(b) Provide a qualified wildlife biologist with expertise in bats to check trees for evidence of bats if a tree removal needs to occur between October 31 and March 31, when bats could be present. The qualified wildlife biologist with expertise in bats will check trees for evidence of
Info Page 2 of 4 bats and will complete the following determinations:
(1) Perform tree inspections within two days before starting tree removal activities.
(2) Document the survey using a tree assessment form approved by the National Park
Service (NPS) in consultation with FWS. When the form is finalized by NPS and approved by FWS, a copy of the most recent form will be provided to the Contractor by the CO prior to the survey.
(3) Check all flagged trees.
(4) Contact the CO if evidence of bats is seen. CO will coordinate with the FWS immediately to discuss appropriate avoidance measures. Do not start tree removal until discussions with FWS have concluded.
(c) If evidence of bats is not found during the tree inspections, but evidence or bat sightings are unexpectedly made during tree cutting, halt all work. Tree cutting work will not resume until approved by the CO.
(d) The preferred avoidance method is to wait for bats to leave for the season and conduct tree removal work between October 31 and March 31. If this cannot occur, the CO will reinitiate consultation with FWS to assess impacts of the proposed activity and determine additional conservation measures. A more detailed survey and implementation plan may be required. This could include potential night work after bats leave for the evening, hand removal of bats, or other techniques as appropriate.
(e) Send the “Tree Assessment Survey Form” documenting pre-tree removal checks to the
CO monthly or within one business day of encountering evidence of bats. NPS will provide a compilation of the reports to FWS every 90 days, or whenever bats are documented, whichever is sooner.
b) Delete Subsection 108.01(f) of the SCRs, page J-6 and substitute the following:
(f) No tree removal will be permitted during the active bat season from April 1 to November 1, unless approved by the biological monitor.
c) Add the following to page J-114 the SCRs:
Section 623. — GENERAL LABOR
Add the following after Subsection 623.02:
623.02A Biological Monitoring. Provide a qualified professional to perform the survey and monitoring outlined in Subsection 107.12.

Biological monitoring will be evaluated under Subsection 106.02.
623.05. Add the following:
Progress payments for biological monitoring will be paid as follows:
(a) 10 percent of the pay item amount will be paid upon approval of the biologist.
(b) An additional 75 percent of the pay item amount will be prorated based on work completed on the schedule.
(c) The remaining portion of the pay item amount will be paid after final acceptance.
4) Respond to offeror questions:
Question: The ADV Offeror’s Qualifications Form, on Page 3, Question 8.b. states: "Attach resumes of these key personnel as well as the on-site project manager(s) and superintendent(s), and specifically identify the following:...-Amount and type of highway construction experience, including position, responsibility, and a brief project description of each period of employment." But the RFP, in section 1.B.a Key Personnel (PDF pages 16-17), asks for segmental bridge construction experience. The requirement on the Qualification form is not the same as what’s required in the RFP, therefore, please clarify what is specifically required.
Response: These are two separate requirements that are needed for this project not dependent on each other. The ADV Offeror’s Qualifications Form includes requirements that are needed on all our projects. The RFP includes additional specific requirements for this project that are included in the technical proposal and will be judged as pass or fail on this project as part of the Lowest
Price Technically Acceptable (LPTA) criteria as outlined Bid Schedule Instructions of the RFP.
Question: With respect to pre-existing hazardous materials/hazardous waste or hazardous materials/hazardous waste not brought onto the site by the Contractor, will EFLHD be considered the “generator” of such hazardous materials/hazardous waste and sign any necessary generator manifests?
Response: All EPA regulations regarding hazardous material must be followed. If preexisting hazardous material is encountered, FHWA will coordinate to have the owning agency (NPS) sign as the generator. Please be advised that there are some circumstances in which the contractor may be considered a co-generator and would also be required to sign the manifests.
Question: Standard Specifications for Construction of Roads and Bridges on Federal Highway
Projects, FP-14, Section 107. - Legal Relations and Responsibility to the Public, 107.06
Contractor’s Responsibility for Work requires the Contractor to assume the responsibility for all work until final acceptance. Builder’s risk coverage ends upon Substantial Completion or when the Work is put to its intended use, whichever occurs earlier. It is not equitable to give the

Contractor the risk for loss it cannot insure. Contractor’s risk of loss should end upon Substantial
Completion or at the point the Work is put to its intended use by the Owner, whichever is earlier. Please consider amending to: “107.06 Contractor's Responsibility for Work. Assume responsibility for all work until final acceptance Substantial Completion, except as provided in
Subsection 106.07.”
Response: Section 107.06 will not be changed.
Question: Page J-112 states “use new masonry from Elberton, Georgia, for the mechanically-stabilized earth wall facing and capstones”. Is it possible to use suitable stone salvaged from the existing bridge for the MSE walls if a quantity is left over after construction the required headwalls, waterways, and parapets?
Response: There will not be sufficient stone left over after constructing the parapets and guard walls to completely construct the MSE wall facing. Mixing salvaged stone and existing stone is not acceptable. Please note that all salvaged stone must be used on parapets and guard walls before using any salvaged stone on headwalls or waterways.
Question: If there is left over existing stone that is still salvageable after the project is complete does the owner require the stone to be delivered to a certain location, and if so where?
Response: Deliver salvaged stone masonry to the NPS Cherry Hill Maintenance Yard at
Milepost (MP) 256.9.
