About this file

This is Addendum No. 1 to Request for Proposals (RFP) PR9169 issued by Orlando Utilities Commission for a Microgrid Energy Storage System. The addendum modifies the original solicitation for an Energy Storage System (ESS) capable of 250 kW of generation with a duration of 1-2 hours, co-located with DC Fast Charging (DCFC) infrastructure for electric vehicles. The system must be capable of exporting to the grid in response to utility-centric signals and operating as a small microgrid during outages. During grid-connected operations, the system will support grid services including peak shaving, solar smoothing, and Volt/VAR regulation, while during outages it must provide grid-forming capabilities to sustain DCFC operations. Suppliers are required to clearly indicate in their proposals whether the proposed solution meets the requirements listed in Attachment D, though non-compliance does not automatically disqualify a response as OUC will evaluate the best overall solution for its operational needs.

The addendum clarifies evaluation criteria and technical requirements for interested bidders. Suppliers must provide detailed information regarding their proposed system's capability to meet specified performance standards and operational parameters. The solicitation emphasizes that proposals will be assessed on their ability to deliver a solution that balances technical compliance with OUC's strategic objectives for grid modernization and electric vehicle infrastructure support. No specific pricing terms, award dates, contract duration, or renewal options are detailed within this addendum document.

To: All Prospective Proposers:

From: Bhumika Nathoo, Buyer Subject: Addendum No. 1, RFP PR9169 - Microgrid Energy Storage Solution System

The purpose of this Addendum is to address questions in response to the subject solicitation.

Questions:

Question 1. Is this budgetary or firm?

Response 1. Pricing should be firm.

Question 2. Do we need to comply with the wording below exactly to have an EMS outside of the BESS unit?

Response 2. The EMS may be part of the ESS skid and overall structure but should be accessible from a separate door or compartment that does not also expose the user to Lithium-ion modules.

Question 3. Ref. Section 5.7, Can the Energy Management System (EMS) be integrated within the battery container/enclosure, or is it strictly required to be installed in a separate control enclosure as specified in Section 5.7? Please confirm if any exceptions or alternative configurations would be considered acceptable.

Response 3. Please see Response 2.

Question 4. Ref. Attachment D, clarification on whether equipment manufactured in China can be included in the proposed solution, and what specific conditions apply, especially regarding FEOC restrictions, MACR thresholds, and eligibility for tax credits under IRC Sections 45Y and 48E

Response 4. Equipment manufactured in China is acceptable, however eligibility for tax credits and the associated price impact will be considered by the OUC evaluation committee during the evaluation of the RFP.

Question 5. Could you please confirm whether the scope of site work covered by the Owner (OUC) will include craning BESS of the trailer and the physical installation of the system in accordance with the Contractor’s (IMS) design and requirements, including all final cabling?

Response 5. OUC will provide craning off truck/on to pad, pad construction, and wiring. Vendor is expected to conduct commissioning including inspections to verify construction complies with vendor specifications.

Question 6. Can you provide a list of prohibited or restricted battery manufacturers?

Response 6. There is no prohibited list. OUC has a preference for hardware that complies with federal language (included in RFP) in order to qualify for investment tax credits, however non-compliance does not disqualify a bid.

Question 7. Would OUC be open to considering an exception for the use of EVE Energy cells?

Response 7. Please see Response 6.

Question 8. If OUC intends to make a single award to a prime contractor, could OUC share a list of approved construction vendors? Our team would like to support OUC with this project but we are not set up to be an engineering led prime so would subcontract to a construction prime that would perform the procurement and construction scopes.

Response 8. This RFP pertains to hardware, associated software, and commissioning only. OUC intends to manage construction in-house.

Question 9. Please provide a responsibility matrix identifying Owner- and Contractor-supplied scope for engineering, procurement, installation, commissioning, testing, and ongoing support.

Response 9. Contractor should provide a turnkey system. This is to include commissioning. OUC will expect an acceptance testing period once contractor declares the site commissioned.

Contractor should include ongoing O&M pricing options in the pricing schedule; however, this will be a separate contract/budget after RFP award. OUC will handle all other aspects of the project.

Question 10. In addition to the Owner-provided concrete pad, grading, fencing, and dewatering identified in Sections 3.1–3.5, please clarify responsibility for: equipment unloading, equipment setting, crane services, trenching, conduit installation, cable installation, cable terminations, grounding installation, and restoration of disturbed areas.

Response 10. OUC will provide craning operations and electrical work. OUC will request requirements from contractor and will conduct construction in accordance.

Question 11. Please confirm whether the Contractor is expected to perform all field installation activities associated with the ESS equipment and communications systems.

Response 11. Contractors shall perform all commissioning activities. Internal communications (e.g. BMS/EMS, HVAC, etc..) shall be completed by Contractor. OUC shall provide a WAN connection to communicate with the ESS including conduit and conductor (copper or fiber, this will be selected during design after RFP award).

Question 12. Please clarify responsibility for obtaining and managing building permits, electrical permits, fire department approvals, AHJ reviews, utility interconnection approvals, and associated permit fees.

Response 12. OUC shall obtain relevant permits. Contractor’s solution shall meet necessary standards from IEEE, NFPA, NEMA or IP, etc…

Question 13. Is the Contractor expected to act as Engineer of Record and prepare permit submission packages?

Response 13. No

Question 14. Section 2.1 requires grid-forming microgrid operation, while Section 5.8 references an ATS "if applicable." Please confirm whether an ATS is required for the project, whether the ATS is Contractor-supplied or Owner-supplied, and whether ATS procurement and installation should be included in the proposal.

Response 14. Turnkey solutions shall include an inverter that is grid-forming capable. Winning bids will likely include experience with such an inverter and specifically with forming microgrids with such an inverter. Contractor optionally may include an ATS as part of their response; if Contractor does not include an ATS in the proposal OUC will self-procure an ATS in accordance with Contractor requirements.

Question 15. Please clarify the boundary between Contractor and Owner responsibilities for communications equipment, network infrastructure, and remote connectivity.

Response 15. WAN connection forms the boundary between Contractor and Owner responsibilities. Solutions may include parallel cellular communications for cloud monitoring;

however, a copper/fiber connection is required for OUC’s SCADA controls.

Question 16. Please provide the anticipated project schedule, including notice to proceed, design milestones, equipment delivery milestones, construction milestones, commissioning schedule, and target commercial operation date (COD).

Response 16. OUC expects to take this to our Commission by mid-September and anticipates placing the order after Commission approval. OUC expects to begin design at that time and project construction timelines will emerge during the design phase.

Question 17. Are there any long-lead equipment constraints or project completion deadlines associated with anticipated grant funding or tax credit requirements?

Response 17. No lead time constraints are known currently, the installation location is an existing site requiring minimal equipment upgrades. OUC’s goal is to have hardware in the ground this calendar year to qualify for additional tax credits.

Question 18. “The pricing worksheet references a "turn-key ESS" solution. Please confirm whether OUC intends to make a single award to a prime contractor responsible for the complete ESS solution (design, equipment supply, integration, installation, commissioning, and warranty support), or whether OUC reserves the right to separately procure or contract portions of the overall project scope.”

Response 18. OUC intends to award a single contractor responsible for the ESS solution. Said contractor may optionally include an ATS in their proposal.

Question 19. On the cover, it says the Bid Bond is not required, but page 15 says “if applicable” so just wanted to confirm that it doesn’t apply in this case.

Response 19. Bid Bond is not required for this project.

Reminder:

Bids are due no later than 2:00 p.m. Local Time on July 7, 2026, via Vendorlink submissions to the OUC’s Strategic Sourcing Department located at, 100 W. Anderson Street, Attn: 1st Floor Security Guard, Orlando, FL 32801.

Your proposal response must acknowledge Addendum No. 1 was received or your bid may be considered non-responsive. In other respects, except as specifically stated above, the subject request for Proposal remains unchanged.

Note:

There shall be no communication between the supplier, their employees or subcontractors concerning this RFP to anyone within OUC except the buyer of record.

Sincerely, Bhumika Nathoo
