About this file
This Amendment No. 4 document modifies the Request for Proposal (RFP) issued by the Palm Beach County Purchasing Department for Pre-Qualification of Providers for In-Home Services. The procurement seeks qualified providers to deliver respite care, companionship, homemaker, and chore services throughout Palm Beach County across three designated geographic lots. The deadline for proposal submission is June 6, 2023, at 4:00 p.m., with a selection committee meeting scheduled for June 20, 2023, at 9:00 a.m. Oral presentations are anticipated for June 27, 2023, at 1:00 p.m., with the Notice of Intent to Award posted June 29, 2023. The Board of County Commissioners will make the final award on August 22, 2023, with contract commencement on the same date.
Eligible providers must hold a current Home Health Agency license or Nurse Registry license issued by the State of Florida, or possess a Home Health Agency Exemption from the Agency for Healthcare Administration pursuant to Chapter 400, Florida Statutes. The amendment clarifies that licensed nurse registries and licensed home health agencies will be monitored under AHCA rules and DOEA guidelines respectively, and that annual staff evaluations documented in personnel files are required, with training methods and materials determined by the provider unless otherwise specified by law or regulation. Financial references must be provided by certified public accountants, and references must be from professional business entities rather than private clients. Proposers must submit OEBO Schedules 1 and 2 if utilizing subcontractors, and all current incumbents must provide satisfactory vendor performance reports, while new vendors may request documentation from the Division of Senior and Veteran Services confirming their status.

AMENDMENT No. 4 to
2. Section 4, SCOPE OF WORK/SERVICES, delete Subsection 4.5.4 and replace it with the following:
“4.5.4 PROVIDER(s) shall be established to recruit, train and schedule paid and volunteer staff. Procedures will include an annual evaluation of paid staff and documentation maintained in agency or personnel files. Unless stated otherwise in law, rule, or in this DOEA handbook, the number of hours training methods, and training materials are determined by the PROVIDER.
Florida Statutes and the Agency for Healthcare Administration (AHCA) rules and regulations take precedence over the DOEA Handbook. A nurse registry must be licensed by the State of Florida and in good standing with AHCA to be eligible for this contract. They will be monitored based on the AHCA rules and regulations they must follow.
Licensed Home Health Agencies will be monitored with the DOEA guidelines.”
3. Instructions for completing OEBO Schedule 1 and OEBO Letter of Intent –
Schedule 2 are provided in this Amendment as Attachment No. 1.
B. Questions received from Senior Care Navigator and the County’s responses:
Q.1. We are a homecare agency with the state of Florida and The Agency of Persons
Disability and we have an Home Health Agency Exemption with AHCA.
We provide the same services in the County currently to disabled adults, Senior citizens and Veterans.
Does this license type meet your requirements for this bid.
A.1. Entities that have a Home Health Agency Exemption with the Agency for Healthcare Administration pursuant to Chapter 400, Florida Statutes and Chapter 59A-8 of the Florida Administrative Code are eligible to submit a proposal in response to this Request for Proposals (RFP).
C. Questions received from Tri-County Homecare of Florida, Inc., and the
County’s responses:
Q.1. Would you be willing to extend the submission deadline? The time period is extremely short to gather all necessary information.
A.1. Please see Amendment No. 3 to RFP No. F-23-083/MD.
Q.2. Does the credit reference have to be a CPA or can it be from a Tax preparation company or Public Accountant?
A.2. In order to meet the requirements of Section 3.4 FINANCIAL/BUSINESS STABILITY, a certified public accountant would be necessary.
Q.3. As a Medicare certified agency, we are bound by their rules and regulations. When we admit a patient regardless of the services being provided, A RN must be the first clinician to see the patient and conduct an Initial Assessment as well as supervision every 60 days. We see that under Respite care/Companionship/Homemaker/Chore service the RN is not included. Please advise??
A.3. The services provided under this contract are not skilled nursing services and are not funded or regulated by Medicare.
Q.4. Under 3.1.2- the $$ amount and the number of full-time employees would NOT apply to the references as there is no coordination with the referral sources in terms of how many staff are assigned to their patients. The expectations are that we get a referral and we staff the patient accordingly. We staff based on an authorization for a varying number of hours from 4 hours per day to 24 hours. That is left up to the agency to make sure patients are staffed appropriately, timely and all authorized hours are covered. Please advise?
A.4. Staffing hours may range from one (1) hour to twenty-four (24) hours per day.
Anything that does not apply to your bid should be noted with N/A (not applicable).
Q.5. Would it be possible to get a copy of the prior award for said services?
A.5. This is considered a public records request. Anyone who would like this information should contact Angela Sims by e-mail at, PUR- PublicRecordsReq@pbcgov.org or by phone at (561) 616-6846. The information will be provided at the appropriate costs in accordance with PPM
CW-F-002.
Q.6. I had submitted a prior question a few days ago but I did not receive a response. I utilize a Public Accountant (PA) and not a CPA for our financial documents. Would the PA be able to sign off on our financial documents?
A.6. Please see Section C. A.2. above.
D. Questions received from Advanced Care Consultants and the County’s responses:
Q.1. Each proposer shall provide a copy of current home health agency/nurse registry license issued by the State of Florida.
We are a healthcare organization that provides in-home services to our clients.
Our team consists of several licensed professionals such as LPNs, RNs, licensed mailto:PUR-PublicRecordsReq@pbcgov.org mailto:PUR-PublicRecordsReq@pbcgov.org clinical social workers, and Advanced Practice Registered nurses. Each member of our staff holds an individual license and is qualified to offer services according to the solicitation response. However, if we as an organization, do not possess the specific licenses mentioned above but can still provide services based on the definition provided by the Florida Board of Nursing, would we be excluded from submitting a bid?
A.1. No. Please see Section B. A.1. above.
Q.2. 3.1.4 Each proposer, if currently a contractor with Palm Beach County, must provide a satisfactory vendor performance report
Since this is our first submission to Palm Beach County, we do not have the specific report mentioned above. Should we simply indicate this in our submission?
A.2. If a current incumbent for in-home services does not have a vendor performance report, they are to request documentation from the Division of Senior and Veteran Services stating such.
E. Questions received from CSI - Caregiver Services Inc. and the County’s responses:
Q.1. The references that are needed for RFP No. F-23-083/MD solicitation…..is there a specific form that should be used to document the payer/contact information, or should a letter be requested from the references?
A.1. There is no specific form for providing reference information.
Q.2. For any future bill rate increases from the awardee under this RFP No. F-23-
083/MB, please advise how far in advance Palm Beach County will allow for this request to be submitted for consideration, and the anticipated timeframe as to how long it will take for the committee to approve the request. Can Palm Beach County provide examples of supporting documents that should be submitted to request a price increase?
A.2. Please see Amendment No. 1 to the RFP.
Q.3. As a follow up to the Non-Mandatory Pre-Proposal Conference that was held on
5/9/2023, it would be greatly appreciated if additional information can be provided as to the In-Home Service changes that occurred, in which the County required this contract to be re-bid.
A.3. Palm Beach County is looking for a different approach in service delivery.
Q.4. As a licensed nurse registry through AHCA, we are prohibited from conducting direct evaluations of referred caregivers. Instead, we have processes in place to collect client satisfaction and feedback of services rendered by the contracting caregivers that produce the same quality control outcomes of evaluations.
In reference to section 4., 5.4 (page 40) of the RFP NO. F-23-083/MD, can you please confirm if the client evaluations (QAs) would be sufficient to meet the needs required of the annual evaluation required. As a point of reference, these QAs are completed each time a caregiver is referred to a client at the start of care (SOC) and three additional times throughout the year while the caregiver remains with the client. As an additional point of reference, this practice has been widely accepted with other contracts, and RFP responses with and without funding from DOEA that our registries have participated in.
A.4. Please see Section A. item 2. The structured processes described, with copies of client responses maintained in client and caregiver records, would meet the requirement for ensuring quality assurance and evaluating staff performance.
F. Questions received from Devine Care Plus and the County’s responses:
Q.1. As A Nurse Registry the caregivers are Independent Contractors so we can not train. The caregiver obtains the necessary training and gives to us the certifications which we keep in their records.
A.1. Please see Section A. item 3. above.
Q.2. Pg 35 3.1.4> I am a new vendor so how would I obtain a satisfactory report?
A.2. Please see Section D. A.2. above.
G. Questions received from JN Nursing Registry, Inc., and the County’s responses:
Q.1. Refer to page 2; 1.7-TIMETABLE-Enough time is needed to iron out the details for the next contract period, hence, the "Deadline for receipt of questions or comments" needs to be extended, after meeting (s), as mentioned before.
A.1. Please see Amendment No. 3 to the RFP.
Q.2. Refer to page 2; 1.7-TIMETABLE-Enough time is needed to iron out the details for the next contract period, hence, the "Deadline for receipt of Proposals" needs to be extended, after meeting (s), as mentioned before. In addition, the date of 5/26/2023 appears unattainable for any proposer, albeit, we already have a contract in place so this information will be for future contracts or for “new proposers” to the current contract, should you be able to legally add them, as the vast amount of information being requested will need time to be collated and provided.
A.2. Please see Amendment No. 3 to the RFP.
Q.3. No reasonable explanation, legal or otherwise, is being given for this new solicitation/request for proposal. An email was sent after the fact, but again, no reasonable explanation, legal or otherwise, was given. We have a contract already in place.
A.3. Please see Section E. A.3. above.
Q.4. Refer to page 9; 2.16-EVALUATION CRITERA-Nurse Registries are being requested/forced to perform outside their licensure. Please refer to the Agency for Healthcare Administration Aspen Regulation; G0153 & G0154
A.4. The evaluation criteria is not forcing anyone to perform outside of their licensure.
Q.5. Refer to Page 10; 2.19-Contract not standard for our industry. The contract needs to be applicable to the service being provided.
A.5. The selected proposer(s) will be required to execute a contract similar to the attached Sample Standard Contract (Attachment 1). Should any proposer and the County be unable to consummate a written contract, the County may proceed to the next most advantageous proposal as determined by the Selection Committee or issue a new Solicitation or cancel the procurement process in its entirety.
Q.6. Refer to pages 11-30; 2.24-Not applicable to our industry, refers mainly to construction work.
A.6. Section 2.24 Federal Terms and Conditions is composed of a number of subsections. While some are construction related, there are others that are applicable to this solicitation.
Q.7. Refer to page 35; 3.2-Please refer to the Agency for Healthcare Administration
Aspen Regulation; G0153 & G0154.
A.7. Please see Section A. item 2.
Q.8. Refer to page 40; 4.5-SERVICE REQUIREMENTS-Please refer to the Agency for
Healthcare Administration Aspen Regulation; G0153 & G0154.
A.8. Please see Section A. item 2.
Q.9. Page 106-APPENDIX A-Concern and issue with verbage and how rate increase proposal is to be done. Rates are service oriented, and discussion is needed.
A.9. Please see Amendment No. 1 to the RFP.
Q.10. Meeting held today; 5/9/2023- We were told we would have to bid on each Lot.
Please note that Caregivers/Independent Contractors choose to live in certain areas. We are being forced to bid on a Lot we might not be able to service. We would then be penalized because we will be unable to service a case/client, although we were aware and had explained this.
What is needed is to have a discussion on how to solve this problem. Maybe the County needs to make allowance for certain areas.
A.10. Please see Section 4.3 GEOGRAPHIC LOCATION, “PROVIDER(s) shall have staff available to start and continuously maintain services as required throughout Palm Beach County, including Lots #1, #2, and #3…”
H. Questions received from Ivory Homecare and the County’s responses:
Q.1. I'd like to confirm the place of performance for this contract. For example, will it be for Palm Beach County?
A.1. Services are required throughout Palm Beach County. Specific zip codes are included in the RFP by lot.
Q.2. And also in regards to licensing, is it required for the awarding agency to have a
License from Palm Beach county to service the contract, or will a license from another county such as Broward, Miami or Brevard be sufficient?
A.2. All vendors must have a current Home Health Agency, or Nurse Registry, license issued by the State of Florida. Entities that have a Home Health Agency Exemption with the Agency for Healthcare Administration pursuant to Chapter 400, Florida Statutes and Chapter 59A-8 of the Florida Administrative Code are also eligible to submit a proposal in response to this Request for Proposals (RFP).
I. Questions received from Home Health Services of the Palm Beaches, Inc., and the County’s responses:
Q.1. Is this proposal and actual bid solicitation or a prequalification for a bid solicitation?
A.1. This is a Request for Proposal. Vendors who are deemed responsive and responsible and, through an evaluation process, determined to be the most qualified may be placed on a closed pre-qualification list for the solicited good or service.
Q.2. Section 2- 2.15 Who comprises the "selection committee"? Also, who comprises the "public" in the public session for scoring?
A.2. The “public” in the public session is anyone from the public that attends the meeting(s). The Selection Committee is comprised of:
Allen Gray, Small Business Development Manager, Office of Equal Business
Opportunity Dr. James Green, Director, Community Services Department Kimberly A. Blair, MPA, BA, Quality Assurance Coordinator, Division of
Senior and Veteran Services, Community Services Department Michael Wright, MPA, Contracts, Compliance and Program Performance
Manager, Community Services Department Tony Moore, Financial Analyst II, Community Services Department
Q.3. Are private clients with whom the same scope of work is provided; considered appropriate references for this RFP? If not, please address the type of references that are appropriate if there are no other business to business entities to whom we supply the same scope of service?
A.3. No. Please see subsection 3.1.2 of the RFP, “Each proposer should submit a minimum of three (3) professional business references from agencies or companies, not to include Palm Beach County Division of Senior Services…” To clarify, private client, personal client, or client family member references will not satisfy this requirement.
J. Questions received from Quality Family Care and the County’s responses:
Q.1. We are a new PROVIDER to the Division of Senior Services, Therefore a Vendor performance report has not been completed. How should we proceed? Does an AHCA survey suffice for this request? Can the Division of Senior Services provide us with the status of our Vendor performance report at this time?
A.1. Please see Section D. A.2. above.
Q.2. The requirements state that “The proposer shall complete the attached Special
Contract Provisions (Appendix C) and submit with their proposal.
a. Does this require the completion of all sub-attachments (i.e., AA, AB, BA, BB, etc)? Or only the certifications on the Attachment A (reference pages 6-9 of Amendment 1) and Attachment B (reference page 15 of Amendment 1) which list the forms?
A.2. Complete all applicable attachments and sub-attachments included in the
RFP.
Q.3. Attachment A contains a list of required “Certifications and Assurances Provisions” and references forms AA-AE. However, there are several certifications for which forms are not provided (Nondiscrimination and Equal Opportunity Assurance;
Certification re Public Entity Crimes; ACORN Funding Restrictions Assurance;
Certification re Inspection of Public Records). Do those need to be created by the proposer? Or are those certifications incorporated into the Special Contract Provisions and, thus, do not require a separate certification?
A.3. Attachment A of the Special Contract Provisions, consists of four (4) pages, requiring a signature on page four (4) certifying that the representations outlined are true and correct. All required attachments are included and must be completed/signed as part of the proposal.
Q.4. Several forms - namely, BB (Background Screening) and BJ (Confidentiality Statement) - appear to require completion by employees of the proposer. Is this correct? If so, do the employees need to complete those forms at this time, or after a contract is awarded?
A.4. Attachments BB and BJ are to be completed by/for the Proposer in the RFP process.
Q 5. Forms BC, BO, BF, BH, Bl, BK, and BL appear to be informational or instructional only and do not appear to require any signatures or further action. Is this correct?
Do these forms need to somehow be acknowledged (e.g., receipt or agree to comply)?
A.5. Form BH must be completed by Proposer.
All changes addressed in this Amendment No. 4 shall be incorporated into RFP No.
F-23-083/MD and the final contract. All other terms and conditions of the RFP, except as previously amended, remain the same and unchanged.
NOTE: Please acknowledge receipt of this Amendment No. 4 by signing below and returning this page with your Proposal Response. Each Amendment to the RFP shall be signed by an authorized agent and submitted with the proposal or the proposal shall be deemed non-responsive.
