About this file

This document is an amendment to Request for Proposal (RFP) #05TO-S953 issued by the Nevada Department of Administration Purchasing Division for a Closed-Loop Payment Processing System. The amendment provides clarification on several aspects of the RFP, including the need for a Money Transmission License, server/hardware location requirements, user location requirements, funding and redemption methods, and financial stability criteria. The RFP seeks proposals for a closed-loop payment system pilot program, with responses due by January 3, 2020 at 2:00 PM PT. The RFP is open to out-of-state vendors, but participants in the pilot program must have a physical presence in Nevada.

The amendment also addresses questions related to cost-effectiveness, references for new operating companies, the extent to which funds can leave the state, and the treatment of optional features. The winning vendor will be selected based on a combination of factors, including cost, which is weighted at 15% of the total score. The pilot program will involve a small number of marijuana-related businesses and their regular business partners, but no MRBs or outside entities will be required to participate.

Closed-Loop Payment Processing System
DATE OF AMENDMENT:

DATE OF RFP RELEASE:
November 25, 2019
OPENING DATE:
January 3, 2020
OPENING TIME:
2:00 PM PT

The following shall be a part of RFP #05TO-S953. If a vendor has already returned a proposal and any of the information provided below changes that proposal, please submit the changes along with this amendment. You need not re-submit an entire proposal prior to the opening date and time.

2nd Questions and Responses to RFP:

7. Money Transmission License: Generally, federal guidelines do not require a Money Transmission License for the purchase of goods or services, such as a token identified in the RFP. Will that policy govern the closed loop payment system, or will a State of Nevada Money Transmission License be required for vendors and sub-vendors who participate in the pilot program?

Given the anticipated difference in each individual vendor’s system design, the State cannot provide guidance as to the required licensure of a system and its related functions.

8. Server/HW Location Requirement: Per section 2.2.5, will all back end processing servers, databases, and other components be required to be physically located in the State of Nevada? And given the utilization of cloud- based services (as well as the nature of transaction processing/account funding via electronic methods) should waiver for this provision be considered?

All physical components that facilitate a transaction must remain in the State.

9. Location of Users when Using/Transacting: Per section 3.2.2, will this in State Usage/Access only apply to physical POS or instore transactions? Given the fact that some participants (particularly in Business to Business based transactions) may access the system online. What impact will this have on the system functionality if this provision applies?

No. All transactions must occur when a user is physically located in Nevada.

10. Out of State Loop Participants: Per section 3.2.2, will out of state vendors be allowed to participate in the program? And would the 3.2.2 inadvertently limit that ability?

Out of state Vendors may apply to serve as outlined in this RFP.

Businesses or organizations will not be allowed to participate in the Pilot Program as users unless they have a physical Nevada presence.

11. Closed-Loop Funding Methods: What electronic funding methods will also be accepted for funding into the loop? ACH/eCheck only assumed, however if additional methods are available please clarify.

No electronic funding methods will be required for the duration of the Pilot Program. The input and receipt of cash is the only required method of funding for the Pilot Program.

12. Redemption Methods: - What will be the acceptable method for participants to redeem cash from the loop? (ACH, physical check, etc)

The appropriate and preferred redemption of cash from the system will be determined by the selected system(s) unique requirements. This will be determined during contract negotiations between the State and any selected vendor(s).

13. 9.2.1 - Financial Stability: 9.2.1 states: "Financial stability shall be scored on a pass/fail basis." What is the pass/fail criteria for financial stability?

The company’s balance sheet and profit and loss statement will be reviewed to evaluate company’s financial soundness and growth potential.

14. Modifications for Efficiency and Cost Effectiveness: I was wondering if the RFP can include some alternate proposals that would be more efficient and cost effective than the proposed requested solution?

Vendors are encouraged to submit any cost-effective solution that provides the same function as the requirements outlined in the RFP.

15. New Operating Company References: For new operating companies with little operating data but substantial experience of the operating personnel in the space, how should we approach the required references? Can we use other related reference sources from previous engagements?

Yes. The State will consider references from similar previous engagements.

16. To what extent, if any is the State willing to allow moneys to leave the State, whether to third party suppliers of service or depository banking?

All transactions involving cash must stay within the State.

17. Technical Requirements: Systems: Can the ATM system requested be left out if a viable more cost-effective alternative is provided to access cash/funds?

Vendors are encouraged to submit any cost-effective solution that provides the same function as the requirements outlined in the RFP.

18. How are the optional features qualified? ie: B to C features?

All proposals must address and will be scored on the B to B requirements set forth in the RFP. Providing a B to C solution is optional and will not provide a vendor with an advantage if included.

19. Implementation: On what basis would the winning vendor be chosen since cost is not an issue?

Cost will be factored into a winning vendor’s bid, specifically, the costs that will be passed onto users. Refer to RFP Sections 4 and 9 of the RFP. Cost is weighted at 15% of the total score.

20. Implementation: Are MRB's required to use the winning system(s) so that cost recover could be calculated?

No. The Pilot Program will include a small number of MRB and outside entities they regularly do business with. No MRB or any outside entity will be required to participate in the Pilot Program.

ALL ELSE REMAINS THE SAME FOR RFP 05TO-S953.

Vendor must sign and return this amendment with proposal submitted.
