This is an RFP selection package and evaluation documentation from the State of Maine Department of Health and Human Services, Office of Child and Family Services, for the procurement of an Implementation Reviewer to evaluate the Department's compliance with a Settlement Agreement regarding psychotropic medication administration to children and youth in foster care. The RFP sought a qualified contractor to gather, analyze, and report on statewide practices concerning psychotropic medication oversight, with key deliverables including developing a sampling and data analysis plan, collecting data within 60 calendar days of each reporting period, and producing draft reports within four months of each reporting period's close. The proposal submission deadline was December 30, 2025, at 4:00 p.m. local time. The initial contract performance period runs from April 1, 2026, to March 31, 2028, with three optional renewal periods that could extend the total contract term to five years. The RFP evaluation was conducted on a 100-point scale, with 30 points allocated for Organization Qualifications and Experience, 40 points for Proposed Services, and 30 points for Cost Proposal.

Medical Review of North Carolina, Inc. dba Constellation Quality Health received the conditional contract award with a total score of 88.00 points, scoring 26.00 points on qualifications and experience, 32.00 points on proposed services, and 30.00 points on cost. The awardee submitted the lowest cost proposal at $35,962.00 for a maximum of 90 completed case reviews over a 12-month period. Four other bidders were evaluated: Mathematica Inc. (67.00 points, with cost proposal deemed non-responsive), CertiSurv, LLC (33.98 points, $72,000.00 cost), Quality Healthcare Solutions LLC (34.48 points, $196,925.00 cost), and Jane Yoo dba Clarus Research (51.53 points, $195,055.00 cost). Team Notes Appendix G – Cost Proposal Form did not adhere to the requirements outlined in the RFP or as clarified in multiple entries in the related Question & Answer Summary or Amendment 1, specifically by providing “an all-inclusive cost for conducting a review for a maximum of 90 cases over a 12-month period.” In addition, the Cost Proposal Form provided as part of this RFP process was not used and instead costs were provided for each contract period, equaling the cost for a 7-year period.

Per Part I, B.3. of the RFP, “All proposals must adhere to the instructions and format requirements outlined in the RFP…” As the Cost Proposal Form did not present the cost in the correct format, the pro-rated score could not be calculated using the mathematical formula described in Part V, B.3. of the RFP.
