About this file
This is an Equity Contractor Declaration Form issued by the City of Portland, Oregon's Procurement Services division, designed to establish and verify eligibility for businesses seeking to participate in city contracts under the Inclusive Contracting Policy. The form requires firms to demonstrate they meet the definition of an Equity Contractor through either Business Oregon COBID certification or alternative certifications from approved agencies such as the National Minority Supplier Development Council (NMSDC), Women's Business Enterprise National Council (WBENC), or Washington State Office of Minority and Women Business Enterprises (OMWBE). Applicants must provide comprehensive business information including registration details with the Oregon Secretary of State, business address, contact information, NIGP codes reflecting their service areas, and documentation of relevant business classifications such as Minority Business Enterprise (MBE), Women Business Enterprise (WBE), Veteran Business Enterprise (VBE), or other designated categories.
The form establishes that contracts awarded to non-COBID certified Equity Contractors under Portland City Codes 5.33, 5.34, or 5.68 may not exceed $150,000. Applicants must certify ownership demographics and ethnicity information for the controlling owner holding 51 percent or more ownership. The declaration requires business owners to sign under penalty of perjury, confirming the accuracy of all submitted information and understanding that misstatements constitute fraudulent concealment subject to penalties and financial sanctions under ORS 200.065 and Portland City Codes 5.33.540 and 5.34.535, which can include up to three years of probation from public contracting opportunities.
