About this file
This is a Resident Vendor Preference Certificate issued by the State of West Virginia Purchasing Division in accordance with West Virginia Code 5A-3-37. The certificate does not apply to construction contracts and serves as an application form for vendors seeking preference consideration based on residency status at the time of bid submission. The document outlines the criteria and procedures for vendors to request preference evaluations, which are applied solely to cost bids during the procurement evaluation process.
The certificate establishes multiple preference categories with varying percentages applied to bids: 2.5% preference for resident vendors continuously headquartered in West Virginia for four years, resident vendors demonstrating 75% West Virginia employment, or nonresident vendors with significant state operations; 5% preference for vendors meeting multiple residency and employment criteria; 3.5% preference for veteran vendors meeting residency and employment requirements; and additional preference for certified small, women- and minority-owned businesses under West Virginia Code 5A-3-59. Bidders must certify the accuracy of submitted information under penalty of law and agree to immediately notify the Purchasing Division in writing of any changes to their status during contract performance. The Secretary of Revenue may reject bids or assess penalties up to 5% of the bid amount if vendors fail to maintain required qualifications, with penalties paid to the contracting agency or deducted from unpaid contract balances.
