About this file
This is a Purchasing Affidavit form issued by the State of West Virginia Purchasing Division that vendors must complete and notarize when submitting bids or proposals in response to state and local contract opportunities. The form serves as a legal certification mechanism to ensure vendor eligibility under W. Va. Code 5A-3-10a, which prohibits contract awards to vendors or their related parties that have outstanding debts exceeding one thousand dollars in aggregate or are in employer default status. The affidavit does not address specific products, services, quantities, response dates, or contract terms, as it functions as a procedural compliance document rather than a solicitation notice.
The form requires the vendor's authorized representative to affirm under penalty of perjury that neither the vendor nor any related party owes qualifying debts or is in employer default, with limited exceptions for contested taxes, workers' compensation premiums, permit fees, or environmental assessments that remain pending or for which valid payment plans are in effect and current. Related parties are defined broadly to include individuals, corporations, partnerships, and other entities with blood, marriage, ownership, or contractual relationships representing five percent or more of the total contract amount. The affidavit must be signed, dated, and notarized before submission, with the notary public's commission expiration date and seal required on the completed form.
