About this file
This document is a Request Form to the Idaho Division of Purchasing (DOP) from the Idaho Military Division (IMD) requesting an exemption from competitive procurement for the disposal of personal protective equipment (PPE) that has reached the end of its useful life. The PPE, which includes gowns, face masks, N95 masks, and procedure masks, totals approximately 3.8 million gowns (1.3 million pounds), 300,000 face shields, 156,000 N95 masks, and 500,000 procedure/3-layer masks. IMD is seeking a one-time purchase to recycle or dispose of the PPE, with FEMA reimbursement support for the transportation and disposal costs until November 8, 2023.
IMD has determined that the vendor pool for textile recycling is small, and the large quantity of PPE requires a vendor that can handle the volume, making competitive procurement impractical, unreasonable, or disadvantageous under the circumstances. IMD has communicated with DOP and obtained concurrence to send samples to a requested vendor, who has confirmed the ability to dispose of the majority of the textile products. The requested exemption from competition is at the discretion of the DOP Administrator, and suppliers are invited to provide relevant information to support or contradict the claim that competition would be impractical, unreasonable, or disadvantageous.

Describe the circumstances
During Covid the State of Idaho accumulated PPE for distribution to health care facilities. This PPE includes gowns, face masks, N95 face masks, and procedure/3-layer masks. The accumulated amount of PPE was kept in a distribution warehouse and delivered to the needed health care facilities around the State as needed. At the end of the State emergency the PPE product was no longer needed and came to the end of its useful life/expired. It now needs to be disposed of and/or recycled with FEMA support of reimbursement to the State for the transportation/disposal of PPE until November 8, 2023.
Why would the competition be impractical, unreasonable, or disadvantageous under the circumstances?
IMD has discovered the vendor pool for textile recycling is small. The amount of textile disposal is large in quantity and needs a vendor that can handle the volume which is another factor in this request. There are approximately
3.8 million gowns adding up to 1.3 million pounds, 300,000 face shields, 156,000 N95 masks, and 500,000 procedure/3-layer masks. We did communicate with DOP, with concurrence, on sending samples to the requested vendor to determine if they could dispose of the property.
The response from the vendor is they can take all of the textile product which is the majority of the issue. The rest of the product they also can dispose of with a good degree of certainty.
Describe the extent to which competition is possible
Time is limited for State reimbursement from FEMA.
